SUBJECT: VAC-15-007 – Erickson Vacation
1. APPLICATION SUMMARY
The applicant, LeRoy Erickson is requesting to vacate a portion (4’X 24’ area) of the 10-foot wide
public utility, drainage and irrigation (PUDI) easement along the east boundary of Lot 10, Block 3
platted with Staten Park Subdivision.
2. STAFF RECOMMENDATION
Staff recommends approval of the subject vacation application.

5. PROCESS FACTS
The subject application is a request to vacate platted easements. Per Meridian City Code Title 11,
Chapter 5, the City Council is the decision making body on this matter. The UDC does not require the
site to be posted with a public hearing notice sign.

6. LAND USE
A. Existing Land Use(s): This property is currently a residential lots, zoned R-8.
B. Character of Surrounding Area and Adjacent Land Use and Zoning: The surrounding area is
developed with single family residences, zoned R-4.
C. History of Previous Actions: In 2001, the property was annexed into the city (AZ-01-009 and DA
#102119241) and received plat approval (PP-01-012 and FP-01-015) to develop twenty-three (23)
residential lots on approximately 8.15 acres in the R-4 zoning district. The portion of easement
proposed for vacation was created with the recordation of the plat.
7. AGENCY COMMENTS MEETING
No comments were received by the Planning Division from other City departments for the subject
application.
8. STAFF ANALYSIS
The applicant requests approval to vacate a portion (4’ X 24’area; south of the northeast property
line) of the 10-foot wide public utility, drainage and irrigation easement along the east boundary of
Lot 10, Block 3 platted with Staten Park Subdivision . The remaining 6 feet of the PUDI easement
will remain along the east boundary of the property line.
Approval of the subject vacation application will remove a portion of the PUDI easement and allow
the applicant to submit for a building permit to construct a new 12’X24’shed on the property; outside
of the 5-foot wide side yard setback. The applicant has also solicited input from the adjacent
neighbors who are in support of the larger shed.
All public utilities (Idaho Power, Century Link, Cable One, Intermountain Gas) have given consent to
relinquish the portion of said easement. The Nampa Meridian Irrigation District has stated they have
no jurisdiction over the easement area. Since none of the applicable utility providers object to the
proposed vacation, Staff recommends approval of vacating the easements as proposed in Exhibit A.2.
