FROM: C.Jay Coles, Assistant City Planner SUBJECT: Oral Surgery Center of Idaho - CZC-15-049 and DES -15-042 OWNER: Primeland Investment Group LLC DESCRIPTION OF APPLICANT'S REQUEST The applicant, neU design Architecture, requests Certificate of Zoning Compliance (CZC) and Design Review (DES) approval to construct a new two story healthcare office building, Type V -B on 1.255 acres of land in the L -O zoning district. The site is located at 4626 N. Penngrove Way (being changed to 4611 N. Coppercloud Way due to its main access from N. Coppercloud Way). DECISION The applicant's request for Certificate of Zoning Compliance and Design Review is approved with the conditions listed in this report. Note: This is not a building permit. Please contact Building Services at (208) 887-2211 to verify ifyou need a building permit and/or inspection. If you do need a building permit, you must complete that process before you commence the use or construction. Please contact Building Services for additional details about building permits and inspections. General Conditions of Approval 100 Watt and 250 Watt, high-pressure sodium street lights shall be required on all public roadways per the City of Meridian Improvement Standards for Street Lighting. All street lights shall be installed at developer's expense. Final design shall be submitted as part of the development plan set for approval. Applicant shall also include the location of any existing street lights in the development plan set. Street lighting is required at intersections, corners, cul-de-sacs, and at a spacing that does not exceed that outlined in the Standards. The contractor's work and materials shall conform to the ISPWC and the City of Meridian Supplemental Specifications to the ISPWC. Process Conditions of Approval 1. No signs are approved with this application. Prior to installing any signs on the property, the applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3 Article D and receive approval for such signs. 2. The applicant shall complete all improvements related to public life, safety, and health as set forth in UDC 11 -5C -3B. A surety agreement may be accepted for other improvements in accord with UDC 11 -5C -3C. 3. Upon installation of the landscaping and prior to inspection by Planning Division staff, Conditions Document I Oral Surgery Center of Idaho - CZC-15-049 and DDS -15-042 the applicant shall provide a written certificate of completion as set forth in UDC 1I - 3B -14A. 4. The site plan prepared by neU design on April 13, 2015, labeled A-101, is approved, with the following comments, as shown in Exhibit B. a. Compact parking stalls may be used for parking above the required number per UDC 11-3C-5. Compact stalls may be reduced in depth by two (2) feet. b. All mechanical equipment, including but not limited to HVAC, shall be fully contained and out of view from adjacent properties and public streets per UDC 11-3A-12. 5. The landscape plan prepared by neU design on April 13, 2015, labeled L-1, is approved, with the following comments, as shown in Exhibit C. a. One tree per thirty five (35) linear feet is required on perimeter of parking areas per UDC 11-313-8CL At least three (3) trees are required along the northern border of the parking area. At least two (2) trees are required along the western parking border. The landscaping area needs to be at least five (5) feet in width. 6. The approved site plan, landscape plan and elevations may not be altered, except for the requested changes, without prior written approval of the City of Meridian Planning Division. Requested changes shall be submitted with the Building Division Submittal. 7. The elevations prepared by neU design on April 13, 2015, labeled A-211 and A-212, are approved as shown in Exhibit D. 8. The applicant shall pay any applicable impact fees prior to the issuance of a building permit. 9. If any changes must be made to the site plan to accommodate ACHD requirements, the applicant shall submit a new site plan to the City of Meridian Planning Division for approval prior to issuance of the building permit. 10. The applicant shall complete all required improvements prior to issuance of a Certificate of Occupancy. It is unlawful to use or occupy any building or structure until the Building Official has issued a Certificate of Occupancy. 11. Prior to Certificate of Occupancy, the applicant shall record a cross-access/ingress- egress easement to adjoining properties and submit copy of said easement to the Planning Division in accord with the provisions of UDC 11 -3A -3A2. Ongoing Conditions of Approval 1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standards as set forth in UDC 11-313-6 and to install and maintain all landscaping as set forth in UDC 11-3B-5, UDC 1 I -3B-13 and UDC 11-3B-14. 2. The project is subject to all current City of Meridian ordinances and previous conditions of approval associated with this site (MDA -10-002; FP -10-001; RZ-07-018; PP -07-023; MI -07-014; PBA -15-005). 3. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. 4. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the area. 5. The applicant shall have an ongoing obligation to maintain all pathways. Conditions Document 2 Oral Surgery Center of Idaho - CZC-15-049 and DES -15-042 6. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set forth in UDC 11-3A-11. 7. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping and constructed features within the clear vision triangle consistent with the standards in UDC 11-3A-3. CITY COUNCIL REVIEW The applicant or a party of record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Division on or before July 9, 2015, within fifteen (15) days after the written decision is issued, and contain the information listed in UDC 11 -5A -6B. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. You have the right to request a regulatory taking analysis under Idaho Code 67-8003. EXPIRATION Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if the use has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure shall expire if the construction or alteration has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Parts of the subdivision are built - currently this site remains vacant, with approximately four remaining undeveloped parcels - with this being one of them. The entire subdivision has already been approved through the previous Design Review processes, which included civil drainage, landscape, overall site design, and other items associated to the neighborhood. Internal roads and parking do not currently exist but utilities have been stubbed to the site. Specifically, the items that will be new on this project will be drive aisles, parking, sidewalks interior to the subdivision curbs, and the building itself. This building will be of modern design, colors, materials and the like. It is our intent to have various features that add character to the community. In addition, we have addressed all four sides of the building to have similar design quality (not simply the front facade). With wall fagade modulations, stone accents, various fenestration assemblies, etc., we feel the beauty of the building is well within the guidelines criteria of the Meridian Design Manual. However, we will address each item below as it might relate to this building: 1. Architectural Character: a. Facades - there are enhancements such as changes in plane with recessed entries, popouts, etc. We have varied the color and materials as well. b. Primary Public Entrances - allowing the pronounced portions of the building to be the main entrances creates visual understanding as soon as one looks at the building as to where the entrances can be found on each side of the building. It enhances importance and creates a building language. c. Roof Lines - wall undulations accomplishes, in an aesthetic way, variation that allows the buildings to show different forms as one travels by, particularly at the entrance of the building. d. Pattern Variations - the differences in wall undulations, materials and colors creates a cohesive tapestry of natural elements. e. Fenestration - natural light is important to us, thus we have located numerous windows around the perimeter of the building. They also serve as a connection to the outside. f. Mechanical — the mechanical equipment will be located on the ground, but screened from the street and neighborring building views with various plantings/shrubbery. Private Utilities including sewer or water systems are prohibited from being located within the ACHD right-of-way. 3. In accordance with District policy, 7203.6, the applicant may be required to update any existing non-compliant pedestrian improvements abutting the site to meet current Americans with Disabilities Act (ADA) requirements. The applicant's engineer should provide documentation of ADA compliance to District Development Review staff for review. 4. Replace any existing damaged curb, gutter and sidewalk and any that may be damaged during the construction of the proposed development.
