RE: Request for Easement for Pathway Connection
Five Mile Creek Pathway
Dear Homeowners Association:
On behalf of Avebury Development, LLC and pursuant to the request of the City of Meridian,
we are requesting the Danbury Fair HOA's cooperation with the granting of an access and
construction easement for a pathway connection to the existing City pathway along the Five Mile
Creek. Initially, the request to NMID (Nampa Meridian Irrigation District) to extend the
pathway was rejected as it did not appear there was enough space. After the P&Z meeting, we
went back to NMID to discuss again. It appears there may be enough room to accommodate the
pathway extension and ditch maintenance, and we have a tentative agreement with NMID.
As developers of Avebury Subdivision, we would like to provide a 5 foot pathway connection
from the south end of S. Petersburg Way, through the Avebury property, and then through the
HOA property (Parcel #R1724220070) along the Five Mile Creek to the existing Five Mile
Creek pathway. Upon your approval and joint execution of the necessary agreements, the
Avebury Development will construct the 5 foot pathway just south of the fence and lot line of
Lot 58 and Lot 59, Block 8 and within Lot 46, Block 8 of Danbury Fair No. 5 Subdivision with
the construction of the proposed Avebury Subdivision. The length of the easement and 5 foot
pathway on the Danbury Fair HOA property is approximately 210 feet.
We are requesting your agreement, in concept, to the granting of the construction and pedestrian
access easement with no additional monetary compensation required for construction. We will
then prepare the necessary documents for execution. We believe the pathway will be an asset to
both subdivisions to facilitate direct, safe, and legal pedestrian access to the Five Mile Creek
pathway through our property.
Please contact us at your earliest convenience to discuss. We need a response by July 10th if you
are interested. If no response, we will take that as a rejection and move forward without the
pathway extension.
