Attached are the Planning ft Zoning Commission's recommendations and the Staff Report for the proposed
annexation It zoning; preliminary plat 12 vacation for Shelburne Sub. These items are scheduled to be on the
City Council agenda on June 23rd. The public hearing will be held at City Halt, 33 E. Broadway Avenue,

RE: Shelburne Subdivision—Zaldia Lane—Ada County, Idaho
Dear Sonya:
We are in receipt of your staff report for the City Council hearing regarding the project referenced above and
offer the following in response to the conditions of approval contained therein.
Discussion Points
1. Open Space Calculations — our submittal indicated approximately 13.2% of open space for the site,
which specifically excluded the storm drainage area south of the pond. Your report adds that storm
drainage area back into the calculation, but we won't know if that area will be constructed as "qualified"
open space until the site gets into final design. Your conditions of approval also state that we are
required to provide 14.5% qualified open space, which is not our proposal. Please revise the conditions
of approval to state that we are proposing approximately 13.2% qualified open space so that the
developer has some flexibility with the storm drainage area.
2. Added Common Drive—the developer is agreeable to the condition to add a common drive for Lots 2
and 3, Block 4 and will do that with final design.
3. Pathway to School Site—the developer is agreeable to adding the pathway in Block 2 and can place it in
whichever location the City sees fit. Dr. Gestrin with the West Ada School District indicated that he may
like to see it further west (perhaps between Lots 15 and 16, Block 2).
4. Landscape Strips —the staff report indicates that we need to add 5' common landscape strip lots along
the common driveways to prohibit adjacent lots from using them for access if they also access via the
street. The preliminary plat already includes an extra S' within the applicable common driveway areas
to allow for this. Please seethe callouts on the preliminary plat.
Requested Considerations from Council
1. Existing House/Shop on Shoemaker Parcel — the developer will iterate to Council that we are
requesting the lines between Lots 4 and 5, Bock 2 to remain as proposed, which will allow the shop to
temporarily exist on a lot without a primary structure. If Council sees fit to add a condition to the
Development Agreement concerning this request, the developer is agreeable to that.
2. Block Lengths — the developer will iterate to the Council that we are requesting approval of the block
length along Elliana due to the pond, and that the addition of the pathway will satisfy the block length
question along Fratello.

3. Existing Lewis House Access to Collector —the developer will iterate to Council that we are requesting
approval for the existing house on Lot 5, Block 6 to access via Elliana due to the home's existing
orientation and the steep terrain around the driveway area.
4. Sidewalks — the developer will iterate to Council that we are requesting attached sidewalks along the
north side of Elliana due to the existing pond and proposed storm drainage facilities.
