IdaPac CZC 15-053CERTIFICATE OF ZONING COMPLIANCE REPORT DATE: June 4, 2015 TO: Scott Grady, Dave Evans Construction FROM: C.Jay Coles, Assistant City Planner SUBJECT: IdaPac - CZC-15-053 and DES -15-048 OWNER: Southridge Farm LLC DESCRIPTION OF APPLICANT'S REQUEST C�Vf E IDIAN: �- The applicant, Dave Evans Construction, requests Certificate of Zoning Compliance (CZC) and Design Review (DES) approval of a single story office building on vacant lot in an existing commercial subdivision (Southridge) on 0.672 acres of land in the C -C zoning district and the Ten Mile Interchange Specific Area. The site is located at 1770 S. Spanish Sun Way. DECISION The applicant's request for Certificate of Zoning Compliance and Design Review is approved with the conditions listed in this report. Note: This is not a building permit Please contact Building Services at (208) 887-2211 to verify if you need a building permit and/or inspection. Ifyou do need a building permit, you must complete that process before you commence the use or construction. Please contact Building Services for additional details about huilding permits and inspections. General Conditions of Approval 100 Watt and 250 Watt, high-pressure sodium street lights shall be required on all public roadways per the City of Meridian Improvement Standards for Street Lighting. All street lights shall be installed at developer's expense. Final design shall be submitted as part of the development plan set for approval. Applicant shall also include the location of any existing street lights in the development plan set. Street lighting is required at intersections, corners, cul-de-sacs, and at a spacing that does not exceed that outlined in the Standards. The contractor's work and materials shall conform to the ISPWC and the City of Meridian Supplemental Specifications to the ISPWC. Process Conditions of Approval 1. No signs are approved with this application. Prior to installing any signs on the property, the applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3 Article D and receive approval for such signs. 2. The applicant shall complete all improvements related to public life, safety, and health as set forth in UDC 11 -5C -3B. A surety agreement may be accepted for other improvements in accord with UDC 11 -5C -3C. 3. Upon installation of the landscaping and prior to inspection by Planning Division staff, Conditions Document 1 IdaPac - CZC-15-053 and DES -15-048 the applicant shall provide a written certificate of completion as set forth in UDC 1 I - 3B -14A. 4. The site plan prepared by The Land Group on April 24, 2015, labeled C1.00, is approved as shown in Exhibit B. 5. The landscape plan prepared by The Land Group on April 24, 2015, labeled L1.00, is approved as shown in Exhibit C. 6. The approved site plan, landscape plan and/or elevations may not be altered without prior written approval of the City of Meridian Planning Division. 7. The elevations prepared by Dave Evans Construction on April 6, 2015, labeled A4.0, are approved as shown in Exhibit D. 8. The applicant shall pay any applicable impact fees prior to the issuance of a building permit. 9. If any changes must be made to the site plan to accommodate ACHD requirements, the applicant shall submit a new site plan to the City of Meridian Planning Division for approval prior to issuance of the building permit. 10. The applicant shall complete all required improvements prior to issuance of a Certificate of Occupancy. It is unlawful to use or occupy any building or structure until the Building Official has issued a Certificate of Occupancy. 11. Prior to Certificate of Occupancy, the applicant shall record a cross-access/ingress- egress easement to adjoining properties and submit copy of said easement to the Planning Division in accord with the provisions of UDC 11 -3A -3A2. The development agreement shows a concept plan which has cross access for each of the lots in this block. The lot located at 1716 5 Spanish Sun Way will require cross access, likely through the lot located at 1728 S Spanish Sun Way, which is adjacent to subject lot of this CZC. Cross access to 1728 S Spanish Sun Way should be granted and likewise cross access from 1728 S Spanish Sun Way to 1716 S Spanish Sun Way should be granted. 12. The City of Meridian requires that the owner enter into a Warranty Surety Agreement and post a Warranty Surety in the amount of 20% of the total construction cost for all completed public sewer and water infrastructure for a duration of two years. This surety amount will be verified by a line item final cost invoicing provided by the owner to the City. The surety can be posted in the form of an irrevocable letter of credit, cash deposit or bond, and must be in place prior to Certificate of Occupancy. Applicant must file an application for surety, which can be found on the Community Development Department website. Please contact Land Development Services for more information at 208-887- 2211. Ongoing Conditions of Approval 1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standards as set forth in UDC 11-313-6 and to install and maintain all landscaping as set forth in UDC 11-313-5, UDC 11-313-13 and UDC 11-313-14. 2. The applicant shall comply with the outdoor storage as an accessory use standards as set forth in UDC 11-3A-14. 3. The project is subject to all current City of Meridian ordinances and previous conditions of approval associated with this site (RZ-14-005; MDA -12-009; PP -06-031; FP -08- 017). 4. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. Conditions Document 2 idaPac - CZC-15-053 and DES -15-048 5. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the area. 6. The applicant shall have an ongoing obligation to maintain all pathways. 7. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set forth in UDC 11-3A-11. 8. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping and constructed features within the clear vision triangle consistent with the standards in UDC 11-3A-3. CITY COUNCIL REVIEW The applicant or a party of record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Division on or before June 19, 2015, within fifteen (15) days after the written decision is issued; and contain the information listed in UDC 11 -5A -6B. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. You have the right to request a regulatory taking analysis under Idaho Code 67-8003. EXPIRATION Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if the use has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure shall expire if the construction or alteration has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Itis divided into two separate spaces. 8,562 sf will be IdaPac's space and 2,800 sf will be unfinished. The project is located at 1770 S. Spanish Sun Way- Meridian, Id 83642 also known as Lot 5, Block 1 of Southridge Sub No. 1. The zoning designation is Community Business District (C -C). The site layout is based on the approved plat for the subdivision which is intended to house a business park. There are a total of two future entrances to the subdivision. IdaPac will be located next to the southernmost entrance off of S. Spanish Sun Way. The site work will include parking, drive aisles, utilities and landscaping. This additional construction is depicted in the site and landscape plans. The building design responds to the city's adopted design manual. As instructed by staff the applicant used the Urban/Suburban Design Guidelines. All of the facades are designed to address site influences as well as building scale and form. This is done with the use of two predominant main entry features for tenants. The entry features are raised gables with stained wood accents and details supported by wood columns with manufactured stone bases. The building's facades include consistent window layouts and two types of cement fiber cladding. The roof is gabled with its fascia line broken up by the entry gables as well as other small gable features. The roof itself is architectural composite shingle. Functioning gable ridge vents also help to break up the roof planes. Mechanical equipment will exist along the east and south elevations. This will include air conditioning condensers mounted at grade and a gas meter. All of this equipment will be screened by landscaping that is incorporated into the landscaping plan. We do need the PBA to record in order to issue the CZC. In addition, there are a few items we have come across in relation to this site as we have been working on it. • The development agreement states that the applicant shall incorporate and build at least one transit stop, including benches and covers in coordination with the requirements of the transit authority concurrent with the development of the village center at Overland Road and Linder Road. Said transit stop shall be completed prior to occupancy of the first building within this village center. If the transit authority determines that this location is not suitable for a transit stop and provides written confirmation of this determination, the applicant shall be relieved of this obligation. • The landscape buffer along Linder Road needs a few more trees. The trees that are currently portrayed are actually outside the buffer. We would like to see these trees remain, but a few more also be placed within the buffer. These two items will likely be conditions placed in the CZC report if documentation is not provided beforehand regarding these items. Also, I will be reviewing the Ten Mile Specific Plan for design guidelines to ensure the building design meets those. All proposed irrigation facilities shall be located outside of the ACHD right-of-way (including all easements). Any existing irrigation facilities shall be relocated outside of the ACHD right- of-way (including all easements). 2. Private Utilities including sewer or water systems are prohibited from being located within the ACHD right-of-way. 3. In accordance with District policy, 7203.6, the applicant may be required to update any existing non-compliant pedestrian improvements abutting the site to meet current Americans with Disabilities Act (ADA) requirements. The applicant's engineer should provide documentation of ADA compliance to District Development Review staff for review. 4. Replace any existing damaged curb, gutter and sidewalk and any that may be damaged during the construction of the proposed development. A license agreement and compliance with the District's Tree Planter policy is required for all landscaping proposed within ACHD right-of-way or easement areas. 6. Utility street cuts in pavement less than five years old are not allowed unless approved in writing by the District. All design and construction shall be in accordance with the ACHD Policy Manual, ISPWC Standards and approved supplements, Construction Services procedures and all applicable ACHD Standards unless specifically waived herein. Construction, use and property development shall be in conformance with all applicable requirements of ACHD prior to District approval for occupancy. 11. No change in the terms and conditions of this approval shall be valid unless they are in writing and signed by the applicant or the applicant's authorized representative and an authorized representative of ACHD. The burden shall be upon the applicant to obtain written confirmation of any change from ACHD. 12. If the site plan or use should change in the future, ACHD Planning Review will review the site plan and may require additional improvements to the transportation system at that time.
