Jackson Store 56 Parking Lot CZC 15-054CERTIFICATE OF ZONING COMPLIANCE REPORT DATE: June 3, 2015 TO: Scott Stom, Jacksons Food Stores FROM: Sonya Watters, Associate City Planner SUBJECT: Jacksons Store 56 Parking Lot Expansion - CZC-15-054 and DES -15-053 OWNER: Jacksons Food Stores DESCRIPTION OF APPLICANT'S REQUEST The applicant, Scott Stom, requests Certificate of Zoning Compliance (CZC) and Design Review (DES) approval of a parking lot expansion for the existing Jacksons store located on 0.2 acres of land in the O -T zoning district. The parking lot is proposed to expand from 7 spaces to 14, including one compact stall. A small outdoor seating area is also proposed. The site is located at 52 E. State Avenue. DECISION The applicant's request for Certificate of Zoning Compliance and Design Review is approved with the conditions listed in this report. Note: This is not a building permit. Please contact Building Services at (208) 887-2211 to verb if you need a building permit and/or inspection. If you do need a building permit, you must complete that process before you commence the use or construction. Please contact Building Services for additional details about building permits and inspections. Site Conditions of Approval 1. A standard historic street light will be required at the eastern property line of the subject parcel along State Ave. The lights will need to be metered, and lighting conduit will need to be extended to the western property line. Contact Austin Peterson, Public Works, at 489-0352 for more information. 2. The applicant shall construct all proposed fencing and/or any fencing required by the UDC, consistent with the standards as set forth in UDC 11-3A-7 and 11 -3A -6B. 3. Prior to issuance of Certificate of Occupancy, the applicant shall remove or relocate any existing structures that do not conform to setbacks and/or use in the zone. Process Conditions of Approval 1. No signs are approved with this application. Prior to installing any signs on the property, the applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3 Article D and receive approval for such signs. 2. The applicant shall complete all improvements related to public life, safety, and health as set forth in UDC 11 -5C -3B. A surety agreement may be accepted for other improvements in accord with UDC 11 -5C -3C. Conditions Document 1 Jacksons Store 56 Parking Lot Expansion - CZC-15-054 and DES -15- 053 3. Upon installation of the landscaping and prior to inspection by Planning Division staff, the applicant shall provide a written certificate of completion as set forth in UDC 1I - 3B -14A. 4. The site plan prepared by Scott Strom on May 6, 2015, labeled Sheet AS 101, is approved as shown in Exhibit B. 5. The landscape plan prepared by South Landscape Architecture on May 5, 2015, labeled Sheet L100, is approved as shown in Exhibit C. 6. The approved site plan and landscape plan may not be altered without prior written approval of the City of Meridian Planning Division. 7. The applicant shall pay any applicable impact fees prior to the issuance of a building permit. 8. If any changes must be made to the site plan to accommodate ACHD requirements, the applicant shall submit a new site plan to the City of Meridian Planning Division for approval prior to issuance of the building permit. 9. The applicant shall complete all required improvements prior to issuance of a Certificate of Occupancy. It is unlawful to use or occupy any building or structure until the Building Official has issued a Certificate of Occupancy. 10. If the subject property is part of a final plat that has not yet recorded, the applicant shall be responsible for all plat improvements prior to release of Certificate of Occupancy for the first structure within such plat. Ongoing Conditions of Approval I. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standards as set forth in UDC 11-313-6 and to install and maintain all landscaping as set forth in UDC 11-313-5, UDC 11-313-13 and UDC 11-313-14. I The applicant shall comply with the outdoor storage as an accessory use standards as set forth in UDC 11-3A-14. 3. The project is subject to all current City of Meridian ordinances and previous conditions of approval associated with this site. 4. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. 5. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the area. 6. The applicant shall have an ongoing obligation to maintain all pathways. 7. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set forth in UDC 11-3A-11. 8. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping and constructed features within the clear vision triangle consistent with the standards in UDC 11-3A-3. CITY COUNCIL REVIEW The applicant or a party of record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Division on or before June 17, 2015, within fifteen (15) days after the written decision is issued, and contain the information listed in UDC 11 -5A -6B. If City Council review of the decision is not requested, the action of the Director represents a Conditions Document 2 Jacksons Store 56 Parking Lot Expansion - CZC-15-054 and DES -15- 053 final decision on a land use application. You have the right to request a regulatory taking analysis under Idaho Code 67-8003. EXPIRATION Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if the use has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure shall expire if the construction or alteration has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. We recently purchased the adjacent property to the west (52 E State Ave) and propose to expand our parking lot to provide more efficient vehicular circulation area to serve our customers. Improvement work is not proposed for the existing building or fuel canopy island as part of this project. Overall, these improvements will provide a much more pleasing environment surrounding the store with dense vegetation at the west landscape buffer and added trees at interior landscape planters which don't currently exist. A 5' landscape planter will also be retained at the south to preserve an existing irrigation ditch line. Planters are proposed to be covered with permabark (rock) with low shrubs interspersed throughout. The landscape buffer at the west (adjacent to residential) will also be screened with new provided 6' high vinyl fencing. Pressurized irrigation is not available in this area. Landscape planters will be provided with drip line irrigation provided off City water supply. New asphalt paving will be installed at new parking area and provide access to the alley. Pole lights have been strategically located to illuminate the new parking area within the center interior planter and one within the west landscape planter. These lights will be installed at heights of 16' from grade surface (minimum for clearance of vendor trucks). The west light will be provided with a house -side shield to prevent glare facing the adjacent residential property. The light at the center interior planter will be partially screened with a new deciduous tree just west of the light. A photometric plan has been included showing the light falloff near zero foot candles at the property lines. Parking will be increased from (7) spaces to (14). This includes (1) compact space at the east end to allow maximum clearance from the existing drive access into the site. A new minimum 5' sidewalk has been provided for pedestrian access into the store and continuous access from the alley. Access will remain from the east public sidewalk. Integrated with the sidewalk, a small outdoor seating area will be provided for public and/or store employee use. Trash and recycling containers will remain in their existing locations at the rear of the store, accessed from the alley. This is consistent with all the businesses and residences that share this alley. OCCUPANCY SENSOR (IMS) - Optional internal passive infrared motion sensor activates switching of luminaire light levels. High level light is activated and increased to full bright in 1-2 seconds upon detection of motion. Low light level (30% maximum drive current) is activated when target zone is absent of motion activity for - 2 minutes and ramps down (10-15 sec.) to low level to allow eyes time to adjust. Sensor is located on the front of optical assembly. Sensor optic has a detection cone of approximately 45°. Examples of detection - occurs 30' out from a 30' mounting height pole; occurs 20' out from a 20' mounting height pole. EXPECTED LIFE - Minimum 60,000 hours to 100,000 hours depending upon the ambient temperature of the installation location. See LSI web site for specific guidance. LEDS - Select high -brightness LEDs In Cool White (5000K) or Neutral White (4000K) color temperature. 70 CRI. DISTRIBUTION/PERFORMANCE - Types 3, FT and 5. Exceptional uniformity creates bright environment at lower light levels. Improved backlight cutoff minimizes light trespass. HOUSING - One-piece, die -formed aluminum. Weather -tight housing contains factory prewired driver and field connections. Extruded ane -piece EPDM gasketed wiring access door (with safety lanyard) is located underneath and utilizes tool -less thumbscrew fastener. OPTICAL UNIT - Clear tempered optical grade flat glass lens sealed to aluminum optics housing creates an IP67 rated, sealed optical unit (includes pressure -stabilizing breather). Optical unit is recessed Into housing cavity and sealed to the housing with extruded one- piece EPDM gasket. Optical unit lanyard serves dual purposes of safety and provides positive ground between unit and housing. MOUNTING - Tapered rear design allows fixtures to be mounted in a quad pattern without the need for extension arms. Use with 3" reduced drilling pattern on round and square poles. A round pole plate (X4RPP, X5RPP) is required for mounting to round poles. Wall mount available by ordering wall mounting bracket (BKS-XBO-WM '-CLR). See Accessory Ordering Information chart for all brackets. ELECTRICAL - A terminal block for attachment of incoming primary wiring is supplied. Two- stage surge protection (including separate surge protection built into electronic driver) meets IEEE C62.41.2-2002, Location Category C. Available with universal voltage power supply 120-277VAG (50/6OHz input), and 347-480 VAC. Optional twistlock photocell receptacle is available. Photocell must be ordered separately. DRIVER - Available In SS (Super Saver) and HO (High Output) drive currents (Drive currents are factory programmed). Components are fully encased in potting material for IP65 moisture resistance. Driver complies with IEC and FCC standards. Driver and key electronic components can easily be accessed. OPERATING TEMPERATURE - -40°C to +50°C (-40°F to +122°F). FINISH - Fixtures are finished with LSTs DuraGrip® polyester powder coat finishing process. The DuraGrip finish withstands extreme weather changes without cracking or peeling.
