Jay Coles, Assistant City Planner SUBJECT: S & T Investments - CZC-15-055, DES -15-046 & ALT -15-015 OWNER: R2 Development Inc DESCRIPTION OF APPLICANT'S REQUEST The applicant, Gayle J. Jensen, requests Certificate of Zoning Compliance (CZC), Design Review (DES) and Alternative Compliance (ALT) approval to construct a new warehouse and office facility for an electrical contractor on 1.058 acres of land in the I -L zoning district. The site is located at 2860 E. Lanark Street. DECISION The applicant's request for Certificate of Zoning Compliance and Design Review is approved with the conditions listed in this report. Note: This is not a building permit. Please contact Building Services at (208) 887-22II to verb if you need a building permit and/or inspection. If you do need a building permit, you must complete that process before you commence the use or construction. Please contact Building Services for additional details about building permits and inspections. Process Conditions of Approval 1. No signs are approved with this application. Prior to installing any signs on the property, the applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3 Article D and receive approval for such signs. 2. The applicant shall complete all improvements related to public life, safety, and health as set forth in UDC 11 -5C -3B. A surety agreement may be accepted for other improvements in accord with UDC 11 -5C -3C. 3. Upon installation of the landscaping and prior to inspection by Planning Division staff, the applicant shall provide a written certificate of completion as set forth in UDC 1 I - 3B -14A. 4. The site plan prepared by Ronald W. Van Auker, Inc. on May 27, 2015, labeled SP -1, is approved as shown in Exhibit B. 5. The landscape plan prepared by South Landscape Architecture on May 5, 2015; labeled L-1, is approved as shown in Exhibit C. 6. The approved site plan, landscape plan and/or elevations may not be altered without prior written approval of the City of Meridian Planning Division. 7. The elevations prepared by Ronald W. Van Auker, Inc. on May 1, 2015, labeled A-2, Conditions Document I S & T Investments - CZC-15-055, DES -15-046 & ALT -15-015 are approved as shown in Exhibit D. 8. The applicant shall pay any applicable impact fees prior to the issuance of a building permit. 9. If any changes must be made to the site plan to accommodate ACHD requirements, the applicant shall submit a new site plan to the City of Meridian Planning Division for approval prior to issuance of the building permit. 10. The applicant shall complete all required improvements prior to issuance of a Certificate of Occupancy. It is unlawful to use or occupy any building or structure until the Building Official has issued a Certificate of Occupancy. 11. Prior to Certificate of Occupancy, it is recommended that the applicant record a cross- access/ingress-egress easement to the property to the east, 2890 E. Lanark Sheet, and submit a copy of said easement to the Planning Division in accord with the provisions of UDC 11 -3A -3A2. Ongoing Conditions of Approval 1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standards as set forth in UDC 11-313-6 and to install and maintain all landscaping as set forth in UDC 11-313-5, UDC 11-313-13 and UDC 11-313-14. 2. The applicant shall comply with the outdoor storage as an accessory use standards as set forth in UDC 11-3A-14. 3. The project is subject to all current City of Meridian ordinances and previous conditions of approval associated with this site (MI -05-009, Olson and Bush #2). 4. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. 5. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the area. 6. The applicant shall have an ongoing obligation to maintain all pathways. 7. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set forth in UDC 11-3A-11. 8. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping and constructed features within the clear vision triangle consistent with the standards in UDC 11 -3 A-3, 9. The applicant and/or assigns shall have the continuing obligation to meet the specific use standards for the proposed use as set forth in UDC 11-4-3-42. ALTERNATIVE COMPLIANCE REQUEST The applicant has submitted a request for alternative compliance in accord with Table 11-513-5, as follows: 1. The applicant requests alternative compliance to use metal siding as a primary finish material for the building. The applicant contends the proposed design theme contributes to the built environment along E. Lanark Street. The proposed elevations show the top portion of the building overhanging the main/substantial body of the building which provides variation in the wall plane through the use of two (2) distinct profiles. In addition, two (2) colors are used to provide contrast for these profiles, adding further variation. A stone or brick wainscot will be used to add character in addition to the metal siding. Conditions Document 2 S & T Investments - CZC-15-055, DDS -15-046 & ALT -15-015 UDC 11 -3A -19.2.b allows prefabricated steel panels as an accent material. However, the Meridian Design Manual (E-2.5.2.2.) encourages the use of complementary material combinations that contribute to a cohesive building design and metal is one of the supported material groups. Further, it (C-2:4.2.2) discourages blank wall segments adjacent to roadways or public spaces. The use of material combinations, textural changes and landscaping should be part of the overall design. 2. The applicant also requests alternative compliance to reduce the landscape buffer along E. Lanark Street from twenty feet (20'), per UDC 11-213-3, down to ten feet (10'). The applicant contends that until recently E. Lanark Street was classified as a local street and therefore only required the ten foot (10') buffer, but that changed and E. Lanark Street is now classified as a Collector Road per ACHD. Several sites have been developed on E. Lanark Street that have ten foot (10') buffers. The applicant requests the reduction so as to be consistent in design and function with the surrounding area. After reviewing the applicant's request, staff finds the proposal to use metal siding, stone or brick wainscot and the variation of wall planes, along with organized plantings meets the intent of the Meridian Design Manual and contributes to a cohesive design of the development and the surrounding area. Therefore, the proposed building materials depicted on the submitted elevations are approved and the submitted landscape plan is approved. ALTERNATIVE COMPLIANCE FINDINGS: In order to grant approval for alternative compliance, the director shall determine the following findings: 1. Strict adherence or application of the requirements is not feasible; OR The Director finds the architecture and landscaping is integrated into the overall design of the proposed development and the surrounding area in accord with the Meridian Design Manual; therefore strict adherence is not feasible. 2. The alternative compliance provides an equal or superior means for meeting the requirements; and The Director finds the proposed building materials and organized plantings contribute to the overall design of the development thereby providing an equal means to meeting the requirements of the UDC. 3. The alternative means will not be materially detrimental to the public welfare or impair the intended uses and character of the surrounding properties. The Director finds that the proposed alternative will not be detrimental to the public welfare or impair the use/character of the surrounding properties. Per the Meridian Design Manual, the applicant's proposal includes a mix of siding designs and planting materials that should preserve the character of the surrounding area. CITY COUNCIL REVIEW The applicant or a party of record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Division on or before June 13, 2015, within fifteen (15) days after the written decision is issued, and contain the information listed in UDC 11 -5A -6B. Conditions Document 3 S & T Investments - CZC-15-055, DES -15-046 & ALT -15-015 If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. You have the right to request a regulatory taking analysis under Idaho Code 67-8003. EXPIRATION Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if the use has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure shall expire if the construction or alteration has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Lanark Street, Lot #8 in the Olson and Bush Subdivision #2. The owner is proposing to construct a single user Electrical Contractor Office, Shop and Warehouse in an I -L zone. The new building will be 26'-6" above finish grade. The building will be a light gray with dark gray trim and flashing. We have used a 4'-0" fagade at the top of the building and brick on the walls below the windows for variety and to enhance the design. The large glass window area enhances the main entry facing the street. The windows will be clear aluminum with 1" thick bronze tinted windows. There is a covered storage area at the back of the building. This building will match the existing buildings in the area. Lanark Street, Meridian S&T Investments Building The proposed building is a warehouse and office for an electrical contractor currently employing 50. The site is zoned I -L and is surrounded by industrially zoned property and industrial buildings. Due to the industrial nature of the subject area and the look and feel of the previously constructed industrial buildings, we seek to design the proposed building in accordance with the established pattern in the area. Building Elevation Attached is a revised elevation of the building which includes the awning over the entrance and a note which specifies that the facade at the top of the exterior walls will contrast the body color of the building. In addition we are proposing a large glass entrance with stone or brick wainscot across the front of the building. Landscaping E. Lanark Street had been classified as a Local road and ACHD now classifies it as a Collector. The section of E. Lanark west of N. Olson Avenue is a dead end with no additional circulation. The existing E. Lanark Street industrial buildings were constructed with a front landscape buffer of 10' rather than the 20' required by the change in the classification of E. Lanark Street.
