CZC ApplicationCERTIFICATE OF ZONING COMPLIANCE REPORT (�Qi�E IDIAN' DATE: May 1, 2015 TO: Max Jensen, City Of Meridian FROM: Bill Parsons, Planning Supervisor SUBJECT: City Hall Westside Parking Lot - CZC-15-044, DES -15-040, ALT -15-013 OWNER: City of Meridian DESCRIPTION OF APPLICANT'S REQUEST The applicant requests Certificate of Zoning Compliance (CZC), Design Review (DES) and Alternative Compliance (ALT) to construct a new parking lot consisting of 54 stalls and associated landscape improvements on 0.79 acres of land in the I -L zoning district. The Alternative Compliance is requested to reduce the landscape buffer width adjacent to N. Meridian Road from 25 feet to 14 feet. The site is located on the west side of N. Meridian Road, between W. Railroad Street and W. Broadway Avenue. DECISION The applicant's request for Certificate of Zoning Compliance, Design Review and Alternative Compliance is approved with the conditions listed in this report. Note: This is not a building permit. You must complete this process before you commence the use or any construction. Please contact Building Services at (208) 887-2211 to verify the building permit and/or inspection requirements. Process Conditions of Approval 1. Per UDC 11 -5B -5B2, the Director (at the applicant's request) approved alternative compliance to reduce the landscape buffer width adjacent to N. Meridian Road (see Analysis section below for more information). 2. No signs are approved with this application. Prior to installing any signs on the property, the applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3 Article D and receive approval for such signs. 3. The applicant shall complete all improvements related to public life, safety, and health as set forth in UDC 11 -5C -3B. A surety agreement may be accepted for other improvements in accord with UDC 11 -5C -3C. 4. Upon installation of the landscaping and prior to inspection by Planning Division staff, the applicant shall provide a written certificate of completion as set forth in UDC 11 -3B - 14A. 5. The site plan prepared by Civil Survey Consultants Inc., dated April 1, 2015, labeled C3.00, is approved on May 1, 2015 by the City of Meridian Planning Division with the following change: Conditions Document City Half Westside Parking Lot a. The parking stall in the northeast corner of the parking lot does not meet the dimensional standards set forth in UDC Table 11-3C-5; this stall must be striped for motorcycle parking. 6. The landscape plan prepared by Breckon Land Design, dated April 15, 2015, labeled L1.1, is approved on May 1, 2015 by the City of Meridian Planning Division as shown in Exhibit C. 7. The approved site plan and landscape plan may not be altered without prior written approval of the City of Meridian Planning Division, S. The applicant shall pay any applicable impact fees prior to the issuance of a building permit. 9. If any changes must be made to the site plan to accommodate ACRD requirements, the applicant shall submit a new site plan to the City of Meridian Planning Division for approval prior to issuance of the building permit. Ongoing Conditions of Approval 1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standards as set forth in UDC 11-313-6 and to install and maintain all landscaping as set forth in UDC 11-313-5, UDC 11-313-13 and UDC 11-3B-14. 2. The project is subject to all current City of Meridian ordinances. 3. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. 4. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the area. 5. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set forth in UDC 11-3A-11. 6. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping and constructed features within the clear vision triangle consistent with the standards in UDC 11-3A-3. ALTERNATIVE COMPLIANCE REQUEST The applicant has submitted a request for alternative compliance to reduce the landscape buffer width adjacent to N. Meridian Road from 25 feet to a varied width between 14 and 17 feet respectively. The applicant states the following factors to justify the reduction: • The parking lot is an interim use to provide additional parking for City Hall, until such time as the City approves further development or redevelopment of the site; • Other properties in the area do not have a 25 -foot wide landscape buffer. If this property was zoned O -T a 25 -foot wide landscape buffer would not be required; • The proposed landscape buffer has been designed to complement the landscape buffer adjacent to City Hall; and • A wider landscape buffer has been provided on the west boundary to help mitigate the impacts to the adjacent single family residential along the west boundary. Staff has reviewed the applicant's request and approves the request in accord with UDC 1I- 5B-5B.2d. ALTERNATIVE COMPLIANCE FINDINGS: Conditions Document 2 City Hall Westside Parking Lot In order to grant approval for alternative compliance, the director shall determine the following findings: 1. Strict adherence or application of the requirements is not feasible; OR Strict adherence is not desired because the City is trying to increase the parking ratio for City Hall. The City also recognizes the parking area is an interim use until such time as this property is rezoned and further intensified with the redevelopment of the Downtown Core. 2. The alternative compliance provides an equal or superior means for meeting the requirements; and The Director finds the applicant's proposal provides an equal means for meeting the landscape requirements set forth in UDC 11-313 for the following reasons: If the property were to rezone to the O -T zone, a 25 -foot wide landscape buffer would not be required; • The landscaping proposed for the site has been designed to complement City Hall; and • A 17 -foot wide landscape buffer is proposed along the west boundary which exceeds the 5 -foot minimum required by UDC 11-313-8C. 3. The alternative means will not be materially detrimental to the public welfare or impair the intended uses and character of the surrounding properties. The Director finds that the proposed alternative will not be detrimental to the public welfare or impair the use/character of the surrounding properties because development of the site contributes to a cohesive landscape theme of City Hall and additional buffering (17 feet) is proposed on the west boundary to help mitigate any impacts to the adjacent single family residences. CITY COUNCIL REVIEW The applicant or a party of record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Division on or before May 18, 2015, within fifteen (15) days after the written decision is issued, and contain the information listed in UDC 11 -5A -6B. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. You have the right to request a regulatory taking analysis under Idaho Code 67-8003. EXPIRATION Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if the use has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure shall expire if the construction or alteration has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance.
