As you know, Shelburne Subdivision encompasses approximately 30.2 acres located south of Zaldia Lane in Ada County, Idaho. As a part of that project, several easements were dedicated and/or referenced on the final plat as follows: - Standard utility, drainage, and irrigation (PUDI) easements were put in place along the lot lines. With the new subdivision being proposed at this time, these old easements will need to be vacated and re -dedicated along the new lot lines within Shelburne Subdivision. - Irrigation -specific easements are also referenced on the plat. The associated irrigation and drainage facilities are private, and the facilities will be relocated and new easements dedicated as a part of the Shelburne platting process. - A 20' turnaround easement is dedicated on this plat, which became moot with the subsequent extension of Zaldia Lane and the turnaround now constructed at its terminus. Further, with the extension of the public street system through the new Shelburne site, this easement is not necessary, - The plat references Instrument No. 100059539 directly beneath the turnaround easement, though that appears to be an error. This instrument is actually a vehicular access and utility easement across the north 40' of the DeAngeli and Shoemaker parcels. As this area will now be converted to a public street which will continue to provide vehicular access and utilities, vacation of this easement seems moot. Should ACHD determine that they want the easement vacated as a part of the public street dedication process, we will coordinate that directly with ACHD staff. ENGINEERS I SURVEYORS I PLANNERS www.kmenglip.com Idaho Power also has two power -specific easements encumbering the DeAngeli and Shoemaker parcels that contain facilities serving the existing residences. Until such time as the new infrastructure for Shelburne Subdivision is installed and those homes can be converted to the new power service, these easements will need to remain in place. Once the conversion has happened and the old facilities have been removed, Idaho Power will allow us to make the formal vacation application request. Please see the attached letter from Idaho Power regarding these specific easements. If not, just let me know who I need to speak with. We are working on a new project called Shelburne Subdivision located on Zaldia Lane in Ada County (will be annexed into Meridian). I have attached a vicinity map so you can see the area. Two of the four parcels we will be subdividing were part of a previous subdivision called Zaldien Zerua Subdivision, and I have attached a copy of that plat. As you can see, there are standard public utility easements dedicated and described in Notes 5 and 6, which we need to vacate in order to re -plat the property. Obviously any existing facilities will be re- routed and placed within new public utility easements that will be dedicated with the new plat. As a part of our vacation application to Meridian, they require written verification from each utility that they have no objections to the vacation. Can you please review this information and respond in writing with Cable One's position on the vacation? There are no Boise Project /New York Irrigation facilities on site, however, the Nine Mile Drain that runs through this property may be a Nampa -Meridian Irrigation District facility and you should contact Mr. Greg Curtis, Water Superintendent, NMID, for any concerns he may have. We have no objection to the vacation of the current easements as they are private or community owned facilities, however, if there are downstream users they need to be protected and insured of receiving their irrigation water in a matter that is satisfactory to them. I have attached a vicinity map for reference. I imagine you have seen the preliminary plat files come through from the Cityfor comment, and I believe either you or one of your staff met with Tim Mokwa from our office onsite a couple of months ago to discuss the site irrigation and drainage. The DeAngeli and Shoemaker parcels shown on this map are presently part of an old subdivision plat called Zaldien Zerua Subdivision (plat also attached). Standard utility easements were placed along lot lines within this plat, which we now need to vacate as a part of re -platting to accommodate the new Shelburne Subdivision layout. I have attached a copy of the Shelburne plat for reference, as well. In addition to the standard easements, there appear to be a couple of irrigation -specific easements crossing the site, which we will also need to relocate when the onsite facilities are relocated. If I understand correctly, the owners have indicated that those are private irrigation/drainage facilities and not Board of Control/New York facilities. As a part of my vacation process with Meridian, I need to obtain consent from each of the utility companies as well as the applicable irrigation/drainage company. I have obtained consent from power, gas, phone, and cable, so you're my last stop. Would you be able to review this and, if you have no objection to vacation of the old easements, respond to this e-mail and state that? An e-mail will suffice for what I need to provide to the City. If you wouldn't also mind confirming in the same e-mail whether or not the irrigation -specific easements are Board of Control/New York easements, that'd be great. If they are yours and you have no issues with the easements being relocated with the new plat, please state as much. I have attached a vicinity map for reference. I imagine you have seen the preliminary plat files come through from the City for comment, and we have spoken with your staff a couple of different times regarding the property. The DeAngeli and Shoemaker parcels shown on this map are presently part of an old subdivision plat called Zaldien Zerua Subdivision (plat also attached). Standard utility easements were placed along lot lines within this plat, which we now need to vacate as a part of re -platting to accommodate the new Shelburne Subdivision layout. I have attached a copy of the Shelburne plat for reference, as well. In addition to the standard easements, there appear to be a couple of irrigation -specific easements crossing the site, which we will also need to relocate when the onsite facilities are relocated. If I understand correctly, the owners have indicated that those are private irrigation/drainage facilities and not NMID facilities. As a part of my vacation process with Meridian, I need to obtain consent from each of the utility companies as well as the applicable irrigation/drainage company. I have obtained consent from power, gas, phone, cable, and the Board of Control, so you're my last stop. Would you be able to review this and, if you have no objection to vacation of the old easements, respond to this e-mail and state that? An e-mail will suffice for what I need to provide to the City. If you wouldn't also mind confirming in the same e-mail whether or not the irrigation -specific easements are NMID easements, that'd be great. If they are yours and you have no issues with the easements being relocated with the new plat, please state as much. It is understood that this property is being developed and that it would be beneficial to the project to have die IPC easements released. IPC's review indicated that there are electrical facilities with the easement areas. As such, IPC requires that the easements must remain until the existing facilities are relocated. During our discussions, it was agreed that these relocations would take place during the development of the subdivision and would be placed within the newly dedicated public utility easements of Shelburne Subdivision. Once these facilities have been relocated within the planned public utility easements of Shelburne Subdivision, IPC would be willing to review the IPC easements and determine if they can be released.
