The proposed CFT project site is part of Walmart's outlots at the northwest
corner of N Ten Mile Road and W McMillan Road in Meridian, ID.
The proposed project consists of an 8,465 SF retail building that includes a drive-
thru Panda Express restaurant, and a separate, freestanding, 2,500 SF drive-thru pad.
Both buildings have proposed outdoor dining areas. The site is located in Outlot "B",
which is southeast of Walmart. Outlot "B" is approximately 2.11 Acres. Total proposed
parking is 86 stalls.
The retail building drive-thru lane is located less than 300 feet from the existing
Walmart pharmacy drive-thru lane. This is what triggers the Conditional Use Permit.
We are submitting two, separate CUP applications for two drive-thru lanes. The
freestanding pad will be less than 300' from the retail building.

Our proposed alternative compliance complies with items number 2 and 3 in "Alternative Compliance
Findings."
ALTERNATIVE COMPLIANCE FINDINGS:
In order to grant approval for alternative compliance, the director shall determine the following
findings:
1. Strict adherence or application of the requirements is not feasible; OR
2. The alternative compliance provides an equal or superior means for meeting the
requirements; and
3. The alternative means will not be materially detrimental to the public welfare or
impair the intended uses and character of the surrounding properties.
1. Strict adherence or application of the requirements is not feasible to this site. The proposed layout
is ideal for the intended uses of the site. It invites both the pedestrian and vehicle into the site, with an
optimum parking layout. Locating the main retail building along the street will present an uninviting
"back of house" that is not pedestrian -friendly. In addition, people would have to cross a drive-thru
lane to access the site, then walk all the way around to the front of the building to patronize the
businesses.
2. The alternative compliance provides a superior means for meeting the requirements of landscaping
and aesthetics. If the main retail building were situated along the street, all that would be visible would
be the back of the building, drive thru menu, and drive-thru window. It would not be a pedestrian -
friendly setup, as the passer-by would feel like they were driving behind the building. The current site
plan invites the pedestrian into the site with the corner architectural feature, seating, and trellises. A 3'
high berm with 18" hedges on top serves to screen the main parking field from general street view. In
addition, diamond planters with parking lot trees have been placed within the parking spines to further
soften and screen the parking lot. An enhanced street corner, with trellises, floral fountain, and seating
provides a place to rest and also serves as a gateway into the site.
3. The alternative means is not materially detrimental to the public welfare, as it esthetically enhances
the streetscape with additional landscaping while inviting the pedestrian into the site. Clear signage
will further enhance and direct customers into the site from both the street and walmart parking lot. In
effect, setting the buildings away from the street corner helps to complement the southeast corner
development, as that one is also set back from the street.
The one property owner that attended my neighborhood meeting was excited to see new development
in the area, especially the Panda Express. He expressed that there is a need for restaurants in
Meridian, as most people have to leave the city to go eat. With all the new residential development,
there will be even more demand. The current layout will both accommodate the existing and future
demands of the area.

COMMITMENT OF PROPERTY POSTING
Per Unified Development Code (UDC) 11 -5A -5D, the applicant for all applications requiring a
public hearing (except for a UDC text amendment, a Comprehensive Plan text amendment
and/or vacations) shall post the subject property not less than ten (10) days prior to the hearing.
The applicant shall post a copy of the public hearing notice of the application(s) on the property
under consideration.
The applicant shall submit proof of property posting in the form of a notarized statement and a
photograph of the posting to the City no later than seven (7) days prior to the public hearing
attesting to where and when the sign(s) were posted. Unless such Certificate is received by the
required date, the hearing will be continued.
The sign(s) shall be removed no later than three (3) days after the end of the public hearing for
which the sign(s) had been posted.
