I. SUMMARY DESCRIPTION OF APPLICANT'S REQUEST
The applicant, Morgan Development, requests an amendment to the existing development agreement
(MDA) to change the architectural design of the building proposed to be constructed on Lots 3 & 4, and
Lots Block 1, Woodland Springs Subdivision. A modification to the building materials is also proposed, to
remove the requirement for faux timbers and beams. See Section IXAnalysis for more information.
II. SUMMARY RECOMMENDATION
Staff recommends approval of the proposed MDA as requested by the applicant.

A. The subject application is for a development agreement modification. A public hearing is required
before the City Council on this matter, consistent with Meridian City Code Title 11, Chapter 5.

VI. LAND USE
A. Existing Land Use(s): This property has not yet been developed and is zoned C-N.
B. Character of Surrounding Area and Adjacent Land Use and Zoning: The area surrounding the subject
property consists of undeveloped property in Woodland Springs subdivision, a Maverik convenience
store and fuel facility, zoned C-N, and single-family rural residential property, zoned R-8.
C. History of Previous Actions:
• In 2007, this site received annexation and zoning (AZ-07-014) approval with C-N zoning. A
development agreement was required as a provision of annexation, recorded as Instrument
#108022886. A preliminary plat (PP-07-019) was also approved for Woodland Springs
Subdivision.
• In 2008, a final plat (FP-08-003) was approved and later recorded for Woodland Springs
Subdivision.
VII. ANALYSIS
A. Analysis of Facts Leading to Staff Recommendation:
The current development agreement (DA) for Woodland Springs requires all buildings on the site to
substantially comply with the elevations and building materials included in the agreement as shown in
Exhibit A.2. Building materials are required to consist of cultured stone, faux timbers and beams,
stucco and stucco accents, and metal standing seam roofing.
The applicant requests a modification to the existing DA to change the architectural design of the future
building on Lots 3 & 4, Block 1, Woodland Springs subdivision to the design shown in Exhibit A.3. A
modification to the building materials is also proposed to remove the requirement for faux timbers and
beams to be provided (see Exhibit AA).
The existing and proposed buildings appear to be approximately the same height and the building
materials are essentially the same (i.e. stucco with stone accents and metal standing seam roofing). Faux
timbers and beams were originally proposed as a design element but were not used on the Maverik
building and are not proposed to be used on future buildings. The form of the buildings is different; the
original structure incorporated a mix of metal hip roofs and parapets with cornices for variety. The
proposed building has parapets with cornices at varying heights; metal eaves/canopies over the building
entrances/windows; columns for vertical interest and modulation; and fenestration comparable with the
original building.

Due to economic changes since 2008 when the DA was approved, the applicant states he has not been
able to develop the site as planned and wishes to construct a speculative shell with the proposed
changes to the elevations. He states the proposed elevations reflect today's development and
construction costs equal to what current rents will accommodate.
Staff has reviewed the proposed changes to the elevations and building materials and found them in
substantial compliance with the design standards listed in UDC 11-3A-19. Further, the proposed design
and materials are consistent and tie in with the Maverik building that exists on the Woodland Springs
site to the west as discussed above. Therefore, Staff is in support of the applicant's request and
recommends approval of the MDA as requested by the applicant.

Provision #5.1.12 (pg.4):
"All buildings on the site shall substantially comply with the elevations in Exhibit C (subject to full
compliance with future design review). All buildings shall be substantially consistent with the square
footages shown on the concept plan: a maximum 11,000 square foot professional office and retail
building; a 4,500 square foot convenience store/fuel station (subject to CUP approval); and, a
maximum 33,000 square foot multi -tenant commercial building. Materials for the subject buildings
