Enclosed please find our short plat application the Newton's Nook Subdivision No. 2 project located at
397 SW 51h Ave in Meridian, Idaho. This application is being submitted with two other "sister"
applications where we are also asking for short plat approval on two nearby parcels in the same
development.
The letter was written on behalf of the developer, Pennwood 111, LLC, and provides a brief overview of
the project and outlines how the application meets the City's requirements.
The property was platted most recently as: FP -05-068 and CUP -05-030.
As you know Newton's Nook Subdivision was platted in 2007, with 4 buildable lots (Lots 1, 3, 4 and 5)
placed around a central common lot (Lot 2) that contained driveways, parking stalls, and trash services
for the lots. As of today, only one lot (Lot 4) has be developed by the construction of a large building
around the time of the original plat. The building in Lot 4, has since been resubdivided into a 4 -unit
condo plat in 2008.
What the developers are observing, is a challenge in selling and developing these mid-size lots that are
still vacant after 8 years. They believe that dividing each of the vacant lots into two (2) smaller lots will
provide more opportunity for potential users to find a smaller lot that may be more affordable and
conducive to a small building footprint, if desired. The lots could still be used for a larger building after
being subdivided by going through a property boundary adjustment process if needed. This means
that the development could handle a range of potential building sizes ranging from around 2,400 sf to
around 5,000 sf.
As shown on the attached final plat, the existing lot would be divided by creating a lot line running
north and south which will create 2 each around 0.1 acre. I have prepared an engineering plan that
shows how each lot will be served by either using the existing sewer and water services that were
constructed when the lot was created, or by constructing new sewer and water service to the new lot.
Since the size and need for these new water and sewer services will depend on how the buildings in
the lots actually develop, it is anticipated that these services will not be constructed until needed for a

future building. Therefore it is expected that the City may choose to require the posting of some type
of financial surety for these future infrastructure improvements.
There is already landscaping improvements around the exterior of the east, south and west sides of
the Newton's Nook Subdivision, so as we discussed no landscape plan or landscape improvements will
be required as part of this short plat. It is expected that future CZC and Design Review applications for
the future buildings will demonstrate the landscape requirements for each lot which will be
constructed as part of their future building.
We believe that will the existing utility, parking and driveway infrastructure already in place, this
platting of the vacant parcels is a perfect example of why the short plat ordinance was created.
Therefore to the best of our knowledge, this final plat and construction drawings were prepared in
substantial conformance with the conditions of the City Code and the original plat.
Therefore, to the best of our knowledge the plans and plat were prepared following common local
engineering and surveying practices and are in substantial conformance with the UDC.

As we discussed on the phone, I have a client who owns 3 parcels at 397, 381 and 413 SW 51' Ave that he is planning to
subdivide in 3 separate plats (Newton's Nook No. 2, No. 3 and No. 4). 1 have attached a parcel map showing the 3 lots as
highlighted. Each of the 3 lots will be divided into 2 lots, so, we are in essence creating 3 new lots in this area. This will
allow the opportunity to put in smaller buildings if desired by future owners.
As part of the short plat application, the City requires us to obtain approval from the Fire Department. Can you please
look things over and approve our dividing these lots as proposed?

The purpose of this letter is to confirm there is at least 3 feet of vertical separation from the grades of
the existing pavement to the seasonal high groundwater. There are not any new roadways proposed
for this project.
I have personally observed storm drain excavation and verified groundwater separation as part of the
construction of storm drains for several nearby parcels and can attest that groundwater is in this area
is more than 8'-9' below ground surface.
