Applicant Request for CC Review Letter 4/6 - CCWHITE-LEASURE DEVELOPMENT COMPANY Mayor Tammy de Weerd April 6, 2015 Members of the City Council Meridian City Hall 33 East Broadway Avenue, Suite 300 Meridian, ID 83642 RE: Council Review Condition 1.3. C — Conditional Use Permit 15-005 Dear Mayor de Weerd and Members of the City Council, This letter shall serve as our request to you for Council Review of condition # 1.33 of CUP 15-005, Sonic Drive -In located at 4936 Linder Road. The CUP was approved by the Planning and Zoning Commission on April 2, 2015. Condition 1.3.13 requires a twenty-five (25') foot landscape buffer adjacent to residential use. Both the Sonic Drive -In and the Linder Springs Apartments are located in a C-G zone. The apartments are set back forty-five (45') feet from their property line and within the forty-five (45') feet are a lawn, landscaping, trees, and a six (6') foot solid board fence. Adjacent to this fence is a thirty-five (35') private drive aisle and adjacent to the drive aisle is the east or rear of the Sonic Drive -In. There is a separation of sixty-three (63') feet between the edge of the drive aisle and the rear of the Sonic building (see attached). Contained within the sixty-three (63') feet are two (2) drive aisles for ordering, thirty-seven (37') feet of cumulative landscaping, and a six (6') foot split -face block wall on top of a two (2') foot landscaped berm. The applicant believes the intent of the ordinance has not only been met, it has been exceeded. Unfortunately, the Planning Commissioner does not have the authority to waive the landscape condition; however, they said they would send the Council a recommendation supporting the applicants request for a waiver of the condition. The Linder Springs property owner stated at the hearing, that he has no objection to our development and the deletion of condition 1.3.B. Therefore, we would request your consideration to delete or waive the landscape condition based on the attached site plan. Thank you for your consideration of this request.
