The Planning & Zoning Commission approved a conditional use permit (CUP-15-005) on April 2,
2015 for a drive-thru establishment for the Sonic Drive -In in a C-G zoning district within 300 feet of
a residential use. A condition of approval (# 1.3b) requires a 25-foot wide landscape buffer to be
constructed along the east boundary of the site adjacent to the residential uses (apartments) to the east
in Linder Springs in accord with UDC Table I 1-2B-3.
The width of the buffer required adjacent to residential uses is determined by the district In which the
property is located, unless such width is otherwise modified by City Council at a public hearing with
notice to surrounding property owners, per UDC 1 1-3B-9C.2. The applicant requests City Council
approval of a reduced buffer width of 10 feet with a 6-foot tall split -face block wall on tali of a 2 foot
landscaped berm as shown on the landscape plan submitted with the application (see attached).
In their motion, the Commission recommended approval of the reduced buffer width as proposed.
Because there is a separation of 90 feet from the east property litre of the site to the nearest residential
structure consisting of a 35-foot wide driveway and 45-1oot wide landscaped common area on the
residential property in addition to the buffer proposed by the applicant, staff has no objection to the
applicant's request.
