Meeting of the Meridian Planning and Zoning Commission of February 19, 2015, was
called to order at 6:00 p.m. by Chairman Steven Yearsley.
Present: Chairman Steven Yearsley, Commissioner Patrick Oliver. Commissioner
Gregory Wilson, Commission Rhonda McCarvel and Commissioner Ryan Fitzgerald.
Others Present: Machelle Hill, Ted Baird, Sonya Watters, Bill Parsons and Dean Willis.

Yearsley: Good evening, ladies and gentlemen. At this time we would like to call to
order the regularly scheduled meeting of the Meridian Planning and Zoning Commission
for February 19, 2015. Let's begin with roll call.
Item 2: Adoption of the Agenda
Yearsley: Thank you. The next thing on the agenda is the adoption of the agenda. We
have no changes, so could I get a motion to adopt the agenda as presented?
Oliver: Mr. Chairman?

Yearsley: Next thing on the agenda is the Consent Agenda and the only thing we have
there is the approval of the minutes of the February 5th, 2015, Planning and Zoning
Commission meeting. Any comments or any changes? With that I would entertain a
motion to approve the Consent Agenda.
Oliver: Mr. Chairman?
Yearsley: Commissioner Oliver.

Yearsley: I have a motion and a second to approve the Consent Agenda. All in favor

Yearsley: Before we start this process I will explain kind of what the -- how this will go
for the next item. For the public hearing we will open each one one at a time. We will
begin with the staff report. The staff will present their findings as how it adheres to the
Comprehensive Plan and the Uniform Development Code, with their recommendations.
At that time we will allow the applicant to come forward and present their case for
approval and any comments to the staff's recommendations. The applicant will have 15
minutes to present his case. After that we will open it up to the public. There is a
sign-up sheet in the back. If -- anyone wishing to testify they will be given up to three
minutes. If they are speaking for a larger group and there is a show of hands, they will
be allowed up to ten minutes. After the public has had a chance to express their
testimony we will have the applicant come up to comment on the public's testimony and
to respond to any of their questions and at that time we will close the public hearing and
the Commission will have an opportunity to discuss and deliberate and, hopefully, make
a recommendation to City Council.

Yearsley: So, with that I would like to open the public hearing on AZ 15-001 and PP
15-Bellabrook and start off with the staff report.
Watters: Thank you, Chairman Yearsley, Members of the Commission. The first
application before you tonight is a request for annexation and zoning and a preliminary
plat. This cite consists of 5.14 acres of land. It's currently zoned RUT in Ada County
and is located at 398 South Locust Grove Road on the east side of Locust Grove south
of Franklin Road. Adjacent land uses and zoning. To the north are single family
residential properties and common area in Bellabrook Subdivision, zoned R-15. To the
east is property that's currently in the development process as a self-service storage
facility, zoned C -G. To the south are single family residential properties in Woodbridge
Subdivision, zoned R-4. And to the west is Locust Grove Road and single family
residential properties in Bellabrook Subdivision, zoned R-15. The subject property was
split in 2003 without approval from Ada County Development Services. The subject
application includes both of those properties that were part of the split and is, therefore,
considered a parcel for development. The Comprehensive Plan designates this
property as mixed use community. The applicant is requesting annexation and zoning
of 5.19 acres of land with an R-15 zoning district, consistent with the mixed use
community future land use map designation. The preliminary plat is proposed as shown
that consists of nine building lots, two common lots, and one other lot on 5.14 acres of
land in a proposed R-15 zoning district. No development is proposed on Lot 5, Block 2,
at this time and that's the large area you see here on the east side. Conceptual
development plan was submitted showing how this lot may develop in the future. That's
right here. So, it's this area. You can see my cursor here and on the east. There is an
existing home and outbuildings on the western 2.14 acre parcel. The home is proposed
to remain on a lot in the subdivision. The outbuildings are proposed to be removed.
The existing home is required to hook up to city water and sewer service within 60 days
of services being available. The gross density of the subdivision, including the large Lot
5 on the east, is 4.21 dwelling units per acre, with a net density of 8.11 dwelling units
per acre. Access is proposed via Kalispell Street, an existing stub street at the west
boundary of the site. That's right up here at the corner. Via South Locust Grove Road.
An emergency access is also proposed to Locust Grove Road down here in the
southwest corner. The Snoopy turnaround is proposed to the south boundary of the
site, which may extend to the east with future development and that's right here in this
area. A 25 foot wide landscape buffer is required along South Locust Grove Road on
the common lot where the emergency access is proposed. Open space is proposed in
accord with the UDC standards. One site amenity is required to be provided with this
development. The applicant has stated since the staff report was written that they
intend to propose a picnic table and they want to locate it off site within the Bellabrook
Subdivision here at the north boundary. There is a linear open space here that goes
down to the creek that they'd like to place in there. So, staff is okay with that. The
pathways master plan depicts a segment of the city's regional pathway on this site along
the east side of the Five Mile Creek. An easement for the pathway is required at this
time. However, construction of the pathway is not required until the east portion of the
site develops in the future and you can see the creek here on this plan. A portion of this
site along the east property boundary lies within the Meridian flood plain overlay district,

which does require a flood plain permit application to be submitted prior to any
development occurring in the overlay district and that's what the dark line you see here
is. Written testimony was received from Ben Thomas, the applicant's representative, in
response to the staff report conditions. Staff is recommending approval of the
application with the conditions in the staff report. Staff will stand for any questions at
this time.
Yearsley: Thank you. Are there any questions? So, Sonya, I have a couple. Is -- and I
didn't see it in the staff report. Is this new extension supposed to be a private street as
well or is it a public street?
Watters; Chairman Yearsley, Commissioners, it is a public street.
Yearsley: Okay.
Watters: Kalispell from Locust Grove is a public street. This loop is a private.
Yearsley: Okay. I think that's -- that's all I had.
Fitzgerald: Mr. Chairman?
Yearsley: Yes.
Fitzgerald: Could I ask --
Yearsley: Absolutely. Sonya, can you -- there was a discussion about a developer's
agreement -- or development regards to the next phase. Is that something that you're
recommending?
Watters: Yes. Uh-huh. Yeah. The provisions are in Exhibit B of the staff report.
Fitzgerald: Thank you.
Yearsley: Thank you. Would the applicant like to come forward? Please state your
name and address for the record.
Thomas: Mr. Chairman, Commissioners, my name is Ben Thomas with Civil
Innovations, PLLC. My address is P.O. Box 170811 in Boise. 83717. Representing the
applicant here this evening. First of all, I'd like to thank Sonya for her preparation of the
staff report and delivery of the presentation this evening. I think she's done a good job
of explaining our proposal here this evening and we are not going to take a bunch of
time trying to add onto that. I think she's covered it. Nine buildable lots on two acres.
So, we are in agreement with all of the conditions in the staff report except for one and
I'm not even sure that this is the appropriate forum to discuss it, but the applicant did
want to get on the record and say he was opposed to site specific condition of approval
2.1.1. This is from Public Works. They are asking for installation of a water line from

Locust Grove to the site in the long common lot there, Lot 1, Block 1, along our south
boundary. The applicant's position is that there is already an eight inch waterline
stubbed to the site. Presumably it's adequately sized to serve nine building lots. This
new waterline would presumably be to serve future developments and the applicant
feels that's an undue burden on a nine -- nine lot residential subdivision. What he's
proposing is to go ahead and grant the city an easement. In that case the city or even
a future developer, if they needed to, if they needed this -- this line for their
development, could come and build it at their expense. So, with that we would stand for
any questions. But, again, we are in agreement with all of the other conditions of the
staff report.
Yearsley: Thank you. Are there any questions? I have one question. The emergency
access road, you show it to be proposed gravel; correct?
Thomas: That's what we are proposing.
Yearsley: Okay. Would you have any heartburn about making it paved?
Thomas: Other than the cost, no.
Yearsley: Okay.
Thomas: But, yeah, we'd certainly prefer to keep it gravel. If the fire department comes
back and requires it be paved, obviously, it would be paved.
Yearsley: Okay.
Thomas: But we'd prefer to leave it. Not -- for no other reason to discourage traffic. It
will be barricaded off, there will be bollards on the other end, but we'd certainly like to
keep people out of that area with their vehicles.
Yearsley: Okay. Any other questions? Thank you.

Yearsley: I only have one signed up. Jerry Cunningham. Okay. Is there anybody else

Yearsley: Well, any thoughts, comments? Well, I will actually go first. I think it looks
good, you know, and I think the -- everything looks good. I think the issue that they are
having with the sewer line -- or water and sewer -- waterline is beyond our
recommendation, because we need Public Works to address that. I do believe, though,
from -- DEQ requires that if there is over 25 connections that they have a second line
and that's probably why they are requiring that second line, so -- but we will -- at this
point I don't think we can comment on that. I prefer to see that gravel access road as
paved. A lot of that is because I think for maintenance it will be a lot easier to keep it
clean and looking nice if it's paved versus gravel, because you will get a lot of weeds
and trying to maintain the weeds and stuff like that in the future will be troublesome and
becomes kind of a mess if no one takes care of it. So, I would recommend that that be
paved, instead of left gravel. But other than that I think it looks good. Any other
thoughts or comments? With that I would entertain a motion.
McCarvel: Mr. Chairman?
Yearsley: Commissioner McCarvel.
McCarvel: After considering all staff, applicant, and public testimony, I move to
recommend approval to the City Council of AZ 15-001 and PP 15-001 as presented in
the staff report for the hearing date of February 19th as recommended.
Oliver: Second.
Yearsley: I have a motion and a second to approve file number AZ 15-001 and PP
15-001. All in favor say aye. Opposed? Motion carries. Congratulations.

Commission with.

Watters: I'm very sorry to interrupt. Just clarification of the motion. Mrs. McCarvel, did
you mean to approve this per the staff recommendation per the staff report --
McCarvel: Yes.
Watters: Okay. So, no paved pathway. Thank you. Just wanted to make sure.
McCarvel: Yeah.
Watters: Okay. Sorry.
Parsons: Clarification. Thank you. So, we are trying to -- at least planning staff and
legal staff is trying to coordinate some training for the new commissioners and give you
some refresher. It's been a few years since that's come before you. Caleb sent an
e-mail out to me and he thought to coordinate with legal again and he's looking at
having that scheduled on the March 19th hearing, but in talking with Machelle this
evening there may be some conflicts with other commissioners. So, all I'm asking for
this evening is maybe all of you look at your calendars to maybe coordinate on what
works best for your schedules to maybe e-mail me or Ted -- myself and, then, I can go
ahead and get that coordinated and we can find a better date that everyone can at least
be in attendance and, then, get that training and get you refreshed up and to the public
hearing process and how to move forward. Do you guys have any ideas what your
calendars are looking like as far as April goes? Or you just want to e-mail me directly
with that?
Oliver: April or March?
Parsons: Oh, March -- we were going with March 19th, so we will have to push it if that
doesn't work. We will have to push it up to April.
Yearsley: So, we are looking at April 1st or the 15th for the next two meetings.
So, 2nd and the 16th. Sorry.
Parsons: What we are trying to do is actually get it scheduled on a hearing where you
don't have a lot of items and at this time we don't have anything scheduled for the April
hearings.
Yearsley: Okay.
Parsons: And we have three items for the 19th. So, we will have to play it by ear, but at
least look at that either first hearing in April or even the second. Want to just play it by
ear right now, but hopefully we could shoot for April 2nd would be the goal here. Get it
done as soon as possible.
Yearsley: Okay. Thank you. So, with that can I get a motion to adjourn?
