AZ-15-002; PP-15-004 Dear Planning & Zoning Commission: We have reviewed staff comments for the Planning & Zoning Commission meeting of April 16, 2015, and have the following responses: AGENCY & DEPARTMENT COMMENTS/CONDITIONS 1. PLANNING DEPARTMENT 1.1 Site Specific Conditions of Approval 1.1.1 The applicant will submit the required fee of $303.00 for the City Attorney's preparation of a Development Agreement to incorporate: a. Prohibition of direct access to N. Linder Road; b. Conformance with the preliminary plat and submitted building elevations; and c. Construction of a ten-foot-wide multi-use pathway along the White Drain within the subject property in accordance with the Pathways Master Plan. However, the applicant cannot be responsible for obtaining consent from the adjacent HOA and constructing 115 feet of off-site improvements on an unrelated property. We respectfully request that the City of Meridian Parks Department work with the appropriate property owners to make any needed connections or improvements which are off-site. d. The applicant respectfully requests a waiver from City Council to UDC 11-3A-6A in order for the White Drain to remain open and not be piped due to the large capacity of the facility. e. Root barriers and a 6-foot-wide parkway will be provided in accord with the standards listed in UDC 11-3A-17E. The root barriers are identified on the landscape plan in Note 6. b. The applicant has provided a 30-foot-wide buffer lot measured from the edge of new right-of- way. c. The applicant will comply. Fencing along the White Drain, central open space lot and micropaths will be wrought iron. d. The applicant will comply. The White Drain will be fenced with wrought iron fencing. e. The existing residence and majority of the existing trees were removed prior to submittal. Most of the trees were locusts along the ditch and right-of-way of Linder Road, along with old, decaying maples that needed to be removed.
