Ten Mile Road,Meridian, Idaho 83642 Dear Mr.Neer: This letter is in response to your application for alternative compliance to the structure and site design standards set forth in UDC 11-3A-19 for the property located at pli5001 N. Ten Mile Road. Specifically,Unified Development Code 11-3A-19A.4,requires a continuous 5-foot wide walkway to be provided from the perimeter sidewalk to the main entrance of the building. This walkway is also required to be distinguished from the vehicular driving surface through the use of pavers, colored or scored concrete or bricks. During an inspection of the site, following the construction of the Walmart store, it was observed that none of the walkways from the perimeter sidewalks were delineated as noted above however;the asphalt was delineated with painted walkways. In your letter,you are requesting to allow the striped asphalt in lieu of the delineated scored concrete walkway. Further,you have stated that the striped asphalt complies with the ADA guidelines and addresses safety concerns but not the aesthetics desired by the City. UDC 11-5B-5 allows the City to provide for alternativemeans to certain development regulations, including the design standards set forth in UDC 11-3A-19. In reviewing the criteria for allowing the alternative compliance request,the Director shall determine the following Findings: 1. Strict adherence or application of the requirements is not feasible; OR The Director finds replacing the striped asphalt with scored concrete is not feasible at this time due to the completion of the development however; the Applicant must install signage at all crossings and delineate all walkways using thermoplastic paint for added durability and maintenance. 2. The alternative compliance provides an equal or superior means for meeting the requirements; and The Director finds striped asphalt provides an equal means for meeting the requirement if the Applicant installs pedestrian crossing signs and delineates all walkways as noted above. 3. The alternative means will not be materially detrimental to the public welfare or impair the intended uses and character of the surrounding properties. The Director finds that the proposed alternative will not be detrimental to the public welfare or impair the use/character of the surrounding properties if the Applicant enhances pedestrian safety by delineating the crossings as noted above and complies with all ADA guidelines. Based on the above Findings above,your request for Alternative Compliance is approved,as amended. The signage and the new thermoplastic painted pedestrian crossings must be installed prior to the issuance of the certificate of occupancy. The Applicant,Director, or a party of record may request City Council review of a decision of the Director.All requests for review shall be filed in writing with the Planning Division of the Community Development Department on or before April 24, 2015,within fifteen(15)days after the written decision is issued, and contain the information listed in UDC 11-5A-6B. If City Council review of the decision is not requested,the action of the Director represents a final decision on a land use application.You have the right to request a regulatory taking analysis under Idaho Code 67-8003. Ten Mile Rd; Application for Alternative Compliance Dear Bill: You will recall that Walmart has received its Certificate of Zoning Compliance ("CZC") for the store referenced above based on plans for the store. The plans and narrative associated with the CZC describe pedestrian walkways constructed with striped asphalt. This construction was completed in reliance on the issued CZC and approved plans. None of the City's approvals reference scored concrete walkways as being required for this site. The City also approved the construction drawings with striped crosswalks as is illustrated on the attached City approved Site Plan. During an inspection of the site following construction, you observed the approved walkways with striped asphalt instead of scored concrete, and indicated that the walkway should be reconstructed with scored concrete. Please accept this letter, the enclosed application for Alternative Compliance, and the enclosed application fee of$160.00 as our request for approval of the existing striped asphalt walkway as Alternative Compliance. The striped asphalt complies with ADA guidelines and addresses safety concerns. We appreciate that scored concrete may be desirable from an aesthetic perspective, but it does not enhance safety. In fact, striped asphalt may offer more visibility making Alternative Compliance just that much more desirable. Walmart held its grand opening for this store on January 21, 2015. To now rip up and replace the walkway is impractical, would cause (in addition to considerable expense) disruption of traffic circulation patterns and, could pose a potential safety hazard to pedestrians. The striped asphalt does provide an equal or even superior means for meeting Code requirements, is consistent with the Meridian's Design Manual, and will not be materially detrimental to the public welfare or impair the intended uses and character of surrounding properties. We believe that our application meets the standards applicable to a request for Alternative Compliance, and that the City can make the findings under Section 11-5B-5.E of the City's Code in order to grant this application for Alternative Compliance.
