Strict adherence or application o the requirements are not feasible; or A 4-foot tall solid fence in this instance does not provide adequate privacy for the lots that abut the common area on Lot 17, Block 1 and Lot 1, Block 2. The Director finds that strict adherence to this requirement is not feasible. 2. The alternative compliance provides an equal or superior means for meeting the requirements; and As alternative compliance, the applicant proposes a 4 foot tall solid fence with a 2- foot latticed or slatted top along the pathway of Lot 17, Block 1 and along the southern and eastern border of Lot 1, Block 2 that border homeowners'properties. The top 2 feet will allow for visibility of the common areas while still providing privacy for the homeowners. In addition, Lot 17, Block 1 exceeds the minimum fifteen feet width requirement by five feet,for a total oftwenty feetThe Director finds the proposed alternative is an equal means of meeting the requirement. 3. The alternative means will not be materially detrimental to the public welfare or impair the intended uses and character of surrounding properties.
