CZC 15-02961P4 - CERTIFICATE OF ZONING COMPLIANCE REPORT Ci/ E IDIANI--- IOAHO DATE: March 24, 2015 TO: Will Krahn, Hummel Architects FROM: Bill Parsons, Planning Supervisor SUBJECT: Meridian High School Expansion - CZC-15-029 and DES -15-021 OWNER: West Ada School District DESCRIPTION OF APPLICANT'S REQUEST The applicant, Will Krahn, requests Certificate of Zoning Compliance (CZC) and Design Review (DES) approval to construct a 40,000 square foot building addition to the existing Meridian High School Campus. Concurrently, the Applicant has submitted a conditional use permit minor modification application to increase the square footage (from 40, 000 sf. to 50,500 sf.) of the building expansion approved with the previous conditional use permit (CUP -12- 015). The proposed addition represents the second phase of the Meridian High School expansion. The first phase consisted of a 10,500 square foot classroom addition which is currently under construction. The site consists of 33.7 acres of land in the R-4 zoning district. The site is located at 1900 W. Pine Avenue. DECISION The applicant's request for Certificate of Zoning Compliance and Design Review is approved with the conditions listed in this report. Note: This is not a building permit. You must complete this process before you commence the use or any construction. Please contact Building Services at (208) 887-22II to verify the building permit and/or inspection requirements. Site Conditions of Approval 1. UDC 11 -3B -2D does not require additional landscaping for additions less than 25% of the existing structure. The applicant is proposing a 40,000 square foot addition with this approval which is less than 25% of the existing structures on this site. The combined square footage of existing buildings on the site is approximately 298,000 square feet. Based on the approved CUP the site is allowed 74,500 square feet (25%) of additions before they are required to comply with additional landscape standards. This approval reduces the allowed expansion from 74,500 to 34,000 square feet before further landscaping is required. 2. The submitted plans show the extension of an 8" water main on south side of the proposed expansion. The Applicant shall coordinate water main size and routing with the Public Works Department, and execute standard forms of easements for Conditions Document Meridian High School Expansion - CZC-15-029 and DES -15-021 said main extension required outside of a public right-of-way. Minimum cover over sewer mains is three feet, if cover from top of pipe to sub -grade is less than three feet than alternate materials shall be used in conformance of City of Meridian Public Works Departments Standard Specifications. Process Conditions of Approval 1. No signs are approved with this application. Prior to installing any signs on the property, the applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3 Article D and receive approval for such signs. 2. The applicant shall complete all improvements related to public life, safety, and health as set forth in UDC 11 -5C -3B. A surety agreement may be accepted for other improvements in accord with UDC 11 -5C -3C. 3. The site plan prepared by Kin Engineering, dated March 6, 2015, labeled CIA, is approved by the City of Meridian Planning Division as shown in Exhibit B. 4. The landscape plan prepared by KM Engineering, dated March 6, 2015, labeled L1.1, is approved as shown in Exhibit C with the following modifications: a. Any existing landscaping near the construction zone must remain protected during construction on the site. b. The existing trees that are proposed to be removed on the landscape plan shall comply with the standards for mitigation set forth in UDC 11 -3B - 10C.5. The applicant shall coordinate with the City Arborist on the mitigation plan and revise the proposed landscape plan to include the additional trees proposed along the Linder Road frontage as stated on the proposed landscape plan. c. Upon installation of the landscaping and prior to inspection by Planning Division staff, the applicant shall provide a written certificate of completion as set forth in UDC 11-313-14A. 5. The elevations prepared by Hummel Architects, dated March 11, 2015, labeled A3.01, A3.02 and A3.03, are approved by the City of Meridian Planning Division as shown in Exhibit D. 6. The approved site plan, landscape plan and/or elevations may not be altered without prior written approval of the City of Meridian Planning Division. 7. The applicant shall pay any applicable impact fees prior to the issuance of a building permit. 8. If any changes must be made to the site plan to accommodate ACHD requirements, the applicant shall submit a new site plan to the City of Meridian Planning Division for approval prior to issuance of the building permit. 9. The applicant shall complete all required improvements prior to issuance of a Certificate of Occupancy. It is unlawful to use or occupy any building or structure until the Building Official has issued a Certificate of Occupancy. Ongoing Conditions of Approval 1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standards as set forth in UDC 11-3B-6 and to install and maintain all landscaping as set forth in UDC 11-3B-5, UDC 11-3B-13 and UDC 11-3B-14. 2. The project is subject to all current City of Meridian ordinances and previous conditions of approval associated with this site (CUP 12-015; CZC-14-025 and MCU -15-002). The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. 4. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the area. 5. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set forth in UDC 11-3A-11. 6. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping and constructed features within the clear vision triangle consistent with the standards in UDC 11-3A-3. 7. The applicant and/or assigns shall have the continuing obligation to meet the specific use standards for the proposed use as set forth in UDC 11-4-3-14. CITY COUNCIL REVIEW The applicant or a party of record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Division on or before April 8, 2015, within fifteen (15) days after the written decision is issued, and contain the information listed in UDC 11 -5A -6B. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. You have the right to request a regulatory taking analysis under Idaho Code 67-8003. EXPIRATION Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if the use has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure shall expire if the construction or alteration has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Meridian High School is a 244,772 square foot campus style school with multiple buildings on site. The previously approved conditional use permit allowed for the addition of 40,000 square feet. Our scope of work has been increased, and we would like to add 10,500 square feet to the addition, for a total of 50,500 square feet. This additional square footage will add classroom space within the foot print of the previously review building plans (see site plan). This two story addition will be located south of the existing classroom building and will connect to the recently completed (8) classroom addition. The landscaping will respond to the grade change from the parking lot to the main level of the school with plantings along the sidewalk adjacent to the parking lot, and a continuous pathway along the south facade at the first floor level. Regarding the site, parking and the drive lane in front of the classroom building will be modified slightly including the addition of landscape planters and parking re -striping. (see site plan). Facades – The existing classroom building (to be remodeled) has a Eddie Daniels, AIA uniform brick fagade 26'-0" tall with small punched window openings on NCARB the parking lot side. The new addition will be added between the Gary Sorensen, AIA classroom building and the parking lot. Primary entrance(s) – The primary entrance is clearly defined by signage on the sun shade screens, an entrance plaza with steps, a significant Associates glass presence on the fagade of the building, and a change in roof line. Pattern variations —The building fagade has a consistent type of storefront and curtain wall glazing on west, south, north, and east elevations. Two different metal panel types are used to create interest with color and texture. See elevations. e. Mechanical equipment — Mechanical equipment is located in the central plant building north of the classroom building, on the interior of the classroom building, and on the roof of the new addition. All equipment is screened from public view. 2. Materials — The primary material at MHS is a smooth faced, brown colored brick. The recently completed Vocational Technical building adjacent to the gymnasium has a grey and off-white metal panel skin. The proposed new addition to MHS has a similar metal panel skin. This exterior wall system is intended to accent the existing brick material. See elevations. 3. Parking Lots — The site is above 2 acres in size and the majority of parking is located between public roadways and the building fagade. This project is not intending to make modifications to the existing parking lots, other than re - striping and adding landscape islands along the south side of the drive isle. 4. Pedestrian walkways and facilities — Existing pedestrian walkways will be maintained throughout the majority of the project site. The District shall give reasonable notice to the Licensee prior to the District's performing such maintenance, repair or other work except that in cases of emergency the Districtshail attempt to give such notice as reasonable under the circumstances. Nothing in this paragraph shall create or support any claim of any kind by Licensee or any third party against the District for failure to exercise the options stated in this paragraph, and Licensee shall indemnify, hold harmless and defend the District from any claims made against the District arising out of or relating to the terms of this paragraph except for claims arising solely out of the negligence of the District. LICENSE AGREEMENT - page 2 g• Neither the terms of this agrcement, the permission granted by the District to the Licensee, the Licensee's activity which is the subject of this agreement, nor the parties exercise of any rights or performance of any obligations of this agreement, shall be construed or asserted to extend the application of any statute, rule, regula11 on, directive or other requirement, or the j urisdiction of any federal, state, or other agency Or official to the District's ownership, operation, and maintenance of its ditches, canals, drains, irrigation works and facilities which did not apply to the District's operations and activities prior to and without execution of this agreement. In the event the District is required to comply with any such requirements or is subject to the jurisdiction of any such agency as a result of execution of this agreement or the Licensee's activity authorized hereunder, Licensee shall indemnify, hold harmless and defend the District from all costs and liabilities associated with the application of such laws or the assertion of such jurisdiction or, at the Option of the Distric4 this agreement shall be of no force and effect and the Licensee shall cease all activity and remove any facility authorized by this agreement. 9. In addition to all other indemnification provisions herein, Licensee further agrees to indemnify, hold harmless and defend the District from any injury, damages, claim, lien, cost and/or expense (including reasonable attorney's fees) incurred by, or asserted against, the District by reason of the negligent acts or omissions of Licensee or its agents, contractors or subcontractors in performing the construction and activities authorized by this agreement 10. The Licensee agrees that the District shall not be liable for any damages which shall occur to any facility, structure, plant, or any other improvement of any kind or nature whatsoever which the Licensee shall install on the said easemen District in the courst area of the District in the reasonable exercise of the rights of the e of performance of maintenance or repair of said ditch or canal, The Licensee further agrees to suspend its use of the said easement area when the use of the easement area is required by the District for maintenance or repair under this or any other paragraph of this agreement. 11, Licensee shall place no structures, pathways orlandscapingofany kind above orwithin the District's easement area except as referred to in this agreement or exhibits hereto without the prior written consent of the District. Nor shall Licensee permit, authorize or grant any other person or entity to excavate, discharge, construct or place any structures, pathways or landscaping within the District easement without the prior written consent of the District. 12• Should either party incur costs or attorney fees in connection with efforts to enforce the Provisions of this agreement, whether by institution of suit or not, the party rightfully enforcingor rightfully resisting enforcement of the provisions of this agreement, or the prevailing party in cast sd, shall be entitled to reimbursement for its costs and reasonable attorney fees from the other party. e suiis intitute 13. Thepartics hereto understand and agree thatthe District has norightin any respect toimpair the uses and purposes of the irrigation works and system of the District by this agreement, nor to grant any rights in its irrigation works and system incompatible with the uses to which such Irrigation works and system are devoted and dedicated and that this contract shall be at an times construed according to such principles. 14. Nothing herein contained shall be construed to impair the right of way of the District in the said ditch or canal and all uses of said ditch or canal by the Licensee and the license herein provided therefor shall remain inferior and subservient to the rights of the District to the use of said ditch or canal for the transmission and delivery of irrigation water. In the event of the failure, refusal or neglect of the Licensee to comply with all of the terms and conditions of this agreement, the license of the Licensee under the terms hereof may be terminated by the District, and any facility, structure, plant, or any other improvement in or over said ditch or canal, and the right of way therefor, which may impede or restrict the maintenance and operation of such ditch or canal by the District with its equipment for the maintenance of its said ditch or canal may be removed by the District. 16. The Licensee agrees to pay attorney fees or engineering fees charged by the attorney for the District or by the engineers for the District in connection with the preparation of this License Agreement or in connection with negotiations covering the terms and conditions of this License Agreement. Licensee also agrees to pay any fees incurred in connection with the retarding of this Agreement. 17. Nothing in this agreement shall create or support a claim of estoppel, waiver, prescription or adverse possession by the Licensee or any third party against District. 18. This agreement is not intended for the benefit of any third party and is not enforceable by any third party. 19. If any provision of this agreement is determined by a court of competent jurisdiction to be invalid or otherwise unenforceable, 41I remainingprovisions of this agree ent shall remain in full force and 20. Cr SEWER EASMENT THIS INDENTURE, made this 17th day wf October , 19 77, between Joint School District No. 2, Ada and Canyon Counties, Idaho the partes of the first part, and hereinafter called the Grantor_, and the City of Meridian, State of Idaho, a municipal corpora- tion, the party of the second part, and hereinafter called the Grantee; WITNESSETH WHEREAS, the Grantor_ desired to provide a sanitary sewer right- i of -way across the premises and property hereinafter particularly bounded and described; and WHEREAS, the sanitary sewer is to be provided for through an under- ground pipeline to be constructed by the Grantee; and WHEREAS, it will be necessary to maintain and service said pipeline from time to time by the Grantee; NOW, THEREFORE, in consideration of the benefits to be received by the Grantor., and for the sum of Ten Dollars {510.00) and other good and valuable consideration, the Grantor do es hereby give, grant and convey unto the Grantee the right-of-way for an easement for the construction, operation and maintenance of a sanitary sewer line over and across the following described property: A strip of land 20 feet in width adjacent to and centered upon the following described line: Commencing at the Southeast corner of the NE 1/4 of Section 11, T. 3 N., R. 1 W., B.M., Ada County, Idaho, and running N. 89°10'57" W. 1306.35 feet along. the Southerly boundary of said NE 1/4, Section 11, to the TRUE POINT OF BEGINNING,OF THE EASEMENT; thence N. 0°34'33" E. 1307.06 feet to the POINT OF ENDING OF THE EASMENT on the Northerly bank of Ninemile Creek; EXCEPTING THEREFROM all existing rights of way for West Pine Avenue and Ninemile Creek. The easement hereby granted is for the purpose of construction and operation of a sanitary sewer line and allied facilities, together with their maintenance, repair, and replacement at the convenience of the Gran- tee, with the free right of access to such facilities at any and all times. TO HAVE AND TO HOLD, the said easement and right-of-way unto the said Grantee, its successors and assigns forever. IT IS EXPRESSLY UNDERSTOOD PND AGREED, by and between the parties hereto that the Grantee will timely complete the work of laying the 'sanitary sewer line and restore the premises used therefor to a condi- tion comparable with that existing prior to exercising this easement; that in making future repairs the Grantee will expediently replace and restore the premises to a condition comparable to that existent prior to under- taking such repairs and replacements. THE GRANTOR hereby covenants and agree s that it_ will not place or allow to be placed any permanent structures on the area described for this easement which would interfere with the use of said described ease- ment for the purposes stated herein. IT IS HEREBY FURTHER AGREED that the Grantor does hereby give and grant to the Grantee the right to use during initial construction an additional strip of land described as follows: A strip of land 30 feet in width adjacent to and Easterly of the above described permanent easement, IT IS UNDERSTOOD that the strip of land described in the previous paragraph is for the purpose of constructing said sanitary sewer line herein described, the same to expire when the initial construction is completed.
