CZC 15-026CERTIFICATE OF ZONING COMPLIANCE REPORT �.�Vl E IDIAN -- DATE: March 31, 2015 TO: The Land Group Inc. FROM: Bill Parsons, Planning Supervisor SUBJECT: Panera Bakery - CZC-15-026 & DES -15-020 OWNER: Interface Properties DESCRIPTION OF APPLICANT'S REQUEST The applicant requests certificate of zoning compliance (CZC) and design review (DES) approval to construct a 5,100 square foot restaurant with associated drive through on approximately 1.22 acres of land in the C -G zoning district. The site is located at 3421 N. Eagle Road. DECISION The applicant's request for Certificate of Zoning Compliance and Design Review is approved with the conditions listed in this report. Note: This is not a building permit. You must complete this process before you commence the use or any construction. Please contact Building Services at (208) 887-2211 to verify the building permit and/or inspection requirements. Process Conditions of Approval 1. No signs are approved with this application. Prior to installing any signs on the property, the applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3 Article D and receive approval for such signs. 2. The applicant shall complete all improvements related to public life, safety, and health as set forth in UDC 11 -5C -3B. A surety agreement may be accepted for other improvements in accord with UDC 11 -5C -3C. 3. The site plan prepared by The Land Group Inc., dated 02/16/15, labeled C2.00, is approved by the City of Meridian Planning Division as shown in Exhibit B with the following comment: a. The parking lot shall be re -striped and maintained in accord with the stall and drive aisle dimensions set forth in UDC 11-3C-5. 4. The landscape plan prepared by The Land Group Inc., dated 02/24/15, labeled L1.00, is approved by the City of Meridian Planning Division as shown in Exhibit C with the following comment: a. Upon installation of the landscaping and prior to inspection by Planning Division staff, the applicant shall provide a written certificate of completion as set forth in UDC Table 11-313-14A. 5. The elevations prepared by Norr Architects, dated 02/25/15, labeled A-5.1 and A-5.2, are approved by the City of Meridian Planning Division as shown in Exhibit D with the Conditions Document 1 Panera Bakery - CZC-15.026 and DES -15-020 following comment: a. All ground level mechanical equipment shall be screened to the height of the unit as viewed from the property line and/or all rooftop mechanical equipment shall be screened as viewed from the farthest edge of the adjoining right of way in accord with UDC 11-3A-19A.1e. 6. The approved site plan, landscape plan and/or elevations may not be altered without prior written approval of the City of Meridian Planning Division. 7. The applicant shall pay any applicable impact fees prior to the issuance of a building permit. 8. If any changes must be made to the site plan to accommodate ACHD requirements, the applicant shall submit a new site plan to the City of Meridian Planning Division for approval prior to issuance of the building permit. 9. The applicant shall complete all required improvements prior to issuance of a Certificate of Occupancy. It is unlawful to use or occupy any building or structure until the Building Official has issued a Certificate of Occupancy. Ongoing Conditions of Approval 1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standards as set forth in UDC 11-3B-6 and to install and maintain all landscaping as set forth in UDC 11-3B-5, UDC 11 -313- 13 and UDC 11-313-14. 2. The applicant shall comply with the outdoor storage as an accessory use standards as set forth in UDC 11-3A-14. 3. The project is subject to all current City of Meridian ordinances and previous conditions of approval associated with this site (CUP -14-017 and CZC-06-214). 4. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. 5. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the area. 6. The applicant shall have an ongoing obligation to maintain all pathways. 7. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set forth in UDC 11-3A-11. 8. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping and constructed features within the clear vision triangle consistent with the standards in UDC 11-3A-3. CITY COUNCIL REVIEW The applicant or a party of record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Division on or before April 14, 2015, within fifteen (15) days after the written decision is issued, and contain the information listed in UDC 11 -5A -6B. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. You have the right to request a regulatory taking analysis under Idaho Code 67-8003. Conditions Document 2 Panera Bakery - CZC-15-026 and DES -15-020 EXPIRATION Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if the use has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure shall expire if the construction or alteration has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. The existing 6400 SF building will be demolished and a new 5100 SF restaurant with associated drive-thru will be constructed in the same general area of the site. The utility stubs are existing and will be utilized. Storm drainage will be retained on site. The majority of the parking lot and landscaping will remain undisturbed. However, the trash enclosure will be relocated from the northeast corner of the parking lot to the north central area of the parking lot. The existing parking lot light fixtures will remain, so no photometric test report is required at this time. No changes to vehicular access are proposed. The proposed building is similar in scale, both in height and in footprint, to the adjacent single tenant buildings. All four fagades of the building are fully developed and interconnected. Raised parapets wrap the northeast and southwest corners of the building and create volume and depth in the fagade. A variety of materials and architectural details is used on all sides of the building. Four primary materials — brick, stucco, wood cladding and glazing — bring variation and texture to the fagade. The visual interest is further enhanced by architectural elements including metal canopies and wall hung trellises. The canopies add depth and shading to the fagade and help articulate the human scale of the building. The trellises allow landscape to be integrated into the fagade. The materials include the following: • Pacific Clay Dark Ironspot Velour Brick • TruGrain Wood Siding in Color Siam • Stucco painted to match Benjamin Moore Plymouth Rack (BM1543) • Dark bronze anodized aluminum storefront and picture windows • Steel channel canopies with wood decking • Green screen wall hung trellises The primary building entrance is emphasized by the use of architectural elements including a raised parapet and a metal canopy that wrap the two sided entry point. Additionally, a change in material calls attention to that portion of the building. The proposed building design includes modulation in height, depth and material of the parapets. The roof mounted mechanical equipment is screened on all four sides of the building by the parapet. The existing parking lot is located away from the street frontage between the building and the rest of the shopping center. The accessible parking spaces are located adjacent to the building entrance and are connected to the building entrance with a pedestrian walkway that includes accessible curb ramps. A pedestrian walkway wraps the building on two sides to provide access to the main entrance, secondary entrance and outdoor seating area. The pedestrian facilities are enhanced by the addition of an outdoor seating area that includes both dining seating and lounge seating.
