Gaines, requests Certificate of Zoning Compliance (CZC) and Design Review (DES) approval of construction of a shell building, type V -B, for future office use on .408 acres of land in the L -O zoning district. This CZC and DES is primarily for building elevations; all parking and landscaping exists on the site approved with the Southstone Subdivision. The site is located at 2650 S. Eagle Road. DECISION The applicant's request for CZC and DES are approved with the conditions listed in this report. Note: This is not a building permit. Please contact Building Services at (2 08) 887-2211 to verify submittal requirements. You must complete this process before you commence lice use or construction. As pact of the application submittal, you will need to provide one set of the final, stamped "approved" Planning Division plans, stamped and signed by the architect and/or civil engineer as applicable. You must provide these plans in PDFformat and hardcopy as sped, feed in the Building Services "Plan Intake Checklist" and include them with your building submittal set. Please contact Building Services for additional details about building permits and inspections. Site Specific Conditions of Approval 1. Business hours of operation within the L -O district shall be limited from 6 am to 10 pm asset forth in UDC 11 -2B -3A4. 2. All ground level mechanical equipment shall be screened to the height of the unit as viewed from the property line in accord with UDC 11-3A-19A.le. 3. The parking lot adjacent to the building shall be striped and maintained in accord with the required stall and drive aisle dimensions listed in UDC 11-3C-5. Process Conditions of Approval 1. No signs are approved with this application. Prior to installing any signs on the property, the applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3 Article D and receive approval for such signs. 2. The applicant shall complete all improvements related to public life, safety, and health as set forth in UDC I 1 -5C -3B. A surety agreement may be accepted for other improvements in accord with UDC 11 -5C -3C. 3. The site plan prepared by neU design Architecture, dated 2/26/15, labeled A-101 is approved, as shown in Exhibit B, with the following changes: Conditions Document 1 Silver Lining Office Shell — CZC & DES • The parking lot adjacent to the building shall provide substantial wheel restraint or add two feet (21) in width in the surrounding sidewalk as outlined in 11 -3C -5B3 and 11 -3C -5B4. 4. The landscape plan prepared by neU design Architecture, dated 2/26/15, labeled L-1 is approved, as shown in Exhibit C, with the following comments: • Protect any existing trees on the subject property that are greater than four -inch caliper and/or mitigate for the loss of such trees as set forth in UDC 11-313-10. 5. The elevations prepared by neU design Architecture, dated 2/26/15, labeled A-211, are approved as shown in Exhibit D. 6. The approved site, landscape plan and/or elevations may not be altered without prior written approval of the City of Meridian Planning Division. All of the requested changes to the plans noted above must be revised with the Building Division submittal. 7. The applicant shall pay any applicable impact fees prior to the issuance of a building permit. 8. If any changes must be made to the site plan to accommodate ACHD requirements, the applicant shall submit a new site plan to the City of Meridian Planning Division for approval prior to issuance of the building permit. 9. The applicant shall complete all required improvements prior to issuance of a Certificate of Occupancy. It is unlawful to use or occupy any building or structure until the Building Official has issued a Certificate of Occupancy. Ongoing Conditions of Approval 1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standards asset forth in UDC 11-313-6 and to install and maintain all landscaping asset forth in UDC 11-313-5, UDC 11-3B-13 and UDC 11-313-14. 2. The project is subject to all current City of Meridian ordinances and previous conditions of approval associated with this site (AZ -04-006, PP -04-008 and FP -04-048). 3. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. 4. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the area. 5. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set forth in UDC 11-3A-11. 6. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping and constructed features within the clear vision triangle consistent with the standards in UDC 1I - 3A -3. CITY COUNCIL REVIEW The applicant or a party of record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Division on or before March 27, 2015, within fifteen (15) days after the written decision is issued, and contain the information listed in UDC 11 -5A -6B. Conditions Document 2 Silver Lining Office Shell — CZC & DES If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. You have the right to request a regulatory taking analysis under Idaho Code 67-8003. EXPIRATION Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if the use has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure shall expire if the construction or alteration has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. It was our intent to have some varying features so as to break up monotony within the subdivision while still ensuring the character of all the buildings mesh well together. In addition, we have addressed all four sides of the building to have similar design quality (not simply the front facade). With wall fagade modulations, stone accents, various fenestration assemblies, etc., we feel the beauty of the building is well within the guidelines criteria of the Meridian Design Manual. However, we will address each item below as it might relate to this building: 1. Architectural Character: a. Facades - there are enhancements such as changes in plane with recessed entries, popouts, etc. We have varied the color and materials as well. b. Primary Public Entrances - allowing the pronounced portions of the building to be the main entrances creates visual understanding as soon as one looks at the building as to where the entrances can be found on each side of the building. It enhances importance and creates a building language. c. Roof Lines - wall undulations accomplishes, in an aesthetic way, variation that allows the buildings to show different forms as one travels by, particularly at the entrance of the building. d. The entire site has already been approved through the previous Design Review processes, which included all civil drainage, all landscape, overall site design, and other items associated to the resulting leftover pad only sites. In addition, the previously built structures, which are very similar to ours, have been approved through the design review process. Specifically, internal roads and parking currently exist, curbs around each pad currently exist, utilities stubbed to each pad currently exist, and the like. Specifically the items that will be new on this project will be sidewalks interior to the existing curbs and the building itself. This building will be of very similar design, colors, materials and the like to the existing buildings that have already been previously approved and are currently constructed/occupied on site. It was our intent to have some varying features so as to break up monotony within the subdivision while still ensuring the character of all the buildings mesh well together. In addition, we have addressed all four sides of the building to have similar design quality (not simply the front facade). With wall facade modulations, stone accents, various fenestration assemblies, etc., we feel the beauty of the building is well within the guidelines criteria of the Meridian Design Manual. However, we will address each item below as it might relate to this building: 1. Architectural Character: a. Facades - there are enhancements such as changes in plane with recessed entries, popouts, etc. We have varied the color and materials as well. b. Primary Public Entrances - allowing the pronounced portions of the building to be the main entrances creates visual understanding as soon as one looks at the building as to where the entrances can be found on each side of the building. It enhances importance and creates a building language. c. Roof Lines - wall undulations accomplishes, in an aesthetic way, variation that allows the buildings to show different forms as one travels by, particularly at the entrance of the building. d. Fenestration - natural light is important to us, thus we have located numerous windows around the perimeter of the building. They also serve as a connection to the outside. f. Mechanical —the mechanical equipment will be located on the ground, but screened from the street and neighborring building views with various plantings/shrubbery. 2. Color and Materials — using similar color qualities to the existing buildings, thus creating a cohesive appearance throughout the site, has been an important consideration. The well composed mixture of stone to stucco, combined with a complimentary colored asphalt shingle creates an attractive building with variations in textures, colors and materials - similar (and even improved) to other attractive buildings in the Meridian area. 3. Site Plan and Building Layout: a. Building Location - already pre -established b. Parking areas - same note as above c. Access — to the north and west of the property and currently used for the existing businesses as previously approved d. Street Layout and Internal Circulation - existing as approved via previous Design Review process. e. Pedestrian Walkways and Facilities —a concrete sidewalk will be added along existing sidewalk to the entrances allowing for multiple access to the building, a pad will be provided at the egress door, which will typically not be used for everyday access. Cohesive Design - This building is similar in finishes, style, and scale to the existing buildings within the subdivision/neighborhood. Connectivity is present through unified use of existing drives and walkways throughout the area. Additionally, landscaping and site work will enhance the existing. Our project building relates well to the overall character and intent, while still allowing for some noticeable differences between each structure in the subdivision.
