FROM: Bill Parsons, Planning Supervisor SUBJECT: High Desert Riding Academy - CZC-15-009, DES -15-007, ALT -15-004 OWNER: TMI Group Inc. DESCRIPTION OF APPLICANT'S REQUEST The applicant requests Certificate of Zoning Compliance (CZC) and Administrative Design Review (DES) to construct and operate a driver's education facility (private education) on 1.36 acres of land in the C -G zoning district. Alternative Compliance (ALT) is also proposed in regard to parking lot landscaping requirements set forth in UDC 11-313-8C. The site is located at 2358 E. Cinema Drive. DECISION The applicant's request for Certificate of Zoning Compliance, Design Review and Alternative Compliance is approved with the conditions listed in this report. Note: This is not a building permit. You must complete this process before you commence the use or any construction. Please contact Building Services at (208) 887-2211 to verb the building permit and/or inspection requirements. Site Conditions of Approval 1. The applicant shall construct all proposed fencing and/or any fencing required by the UDC, consistent with the standards as set forth in UDC 11-3A-7 and 11 -3A -6B. 2. Per an email from ACHD, dated December 12, 2014, ACHD will complete the construction of E. Cinema Drive (curb, gutter, sidewalk & cartway) when the property to the east develops. At this time the owner is only responsible for installing a portion of the 10 -foot wide landscape buffer adjacent to the roadway as shown in Exhibit C (See email included with the application). 3. The applicant shall provide stamped civil drawings detailing the drainage of the vehicle use area to the Land Development Division of the Community Development Department for review and approval. Process Conditions of Approval 1. Per UDC 11-513-5132, the Director (at the applicant's request) approved alternative compliance to UDC 11 -3B -8C in regard to parking lot landscape requirements (see Analysis section below for more information). 2. No signs are approved with this application. Prior to installing any signs on the property, the applicant shall submit a sign permit application consistent with the standards in Conditions Document High Desert Riding Academy UDC Chapter 3 Article D and receive approval for such signs. 3. The applicant shall complete all improvements related to public life, safety, and health as set forth in UDC 11 -5C -3B. A surety agreement may be accepted for other improvements in accord with UDC 11 -5C -3C. 4. The site plan prepared by Larson Architects, dated on February 11, 2015, labeled SP -1 is approved by the City of Meridian Planning Division as shown in Exhibit B. 5. The landscape plan prepared by South Architecture, dated February 12, 2015, labeled L- 1, is approved by the City of Meridian Planning Division as shown in Exhibit C. 6. Upon installation of the landscaping and prior to inspection by Planning Division staff, the applicant shall provide a written certificate of completion as set forth in UDC 1I - 3B -14A. 7. The approved site plan and landscape plan shall not be altered without prior written approval of the City of Meridian Planning Division. 8. The applicant shall pay any applicable impact fees prior to the issuance of a building permit. 9. If any changes must be made to the site plan to accommodate ACHD requirements, the applicant shall submit a new site plan to the City of Meridian Planning Division for approval prior to issuance of the building permit. Ongoing Conditions of Approval 1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standards as set forth in UDC 11-313-6 and to install and maintain all landscaping as set forth in UDC 11-313-5, UDC 11-313-13 and UDC 11-313-14. 2. The applicant shall comply with the outdoor storage as an accessory use standards as set forth in UDC 11-3A-14. 3. The project is subject to all current City of Meridian ordinances and previous conditions of approval associated with this site (PP -04-042 and FP -05-014). 4. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. 5. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the area. 6. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set forth in UDC 11-3A-11. 7. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping and constructed features within the clear vision triangle consistent with the standards in UDC 11-3A-3. 8. The applicant and/or assigns shall have the continuing obligation to meet any applicable specific use standards for the proposed private education use as set forth in UDC 11-4- 3-14. ALTERNATIVE COMPLIANCE REQUEST The applicant has submitted a request for alternative compliance pertaining to the parking lot landscaping, as follows: The applicant requests approval of alternative compliance to UDC 11 -3B -8C.1 which requires, at a minimum, a 5 -foot wide landscape buffer adjacent to the east boundary. Conditions Document 2 High Desert Riding Academy The required buffer must consist of one tree per 35 linear feet and shrubs, lawn, or other vegetative groundcover. The seven (7) required trees cannot be accommodated along this boundary due to an existing 15 -foot wide ACHD storm drain easement. The applicant states that the riding course should have, at a minimum, a 25 -foot wide safety zone to accommodate the riders waiting to enter the course. By installing the required landscape buffer 10 -feet from the ACHD drainage easement the safety zone would be reduced to 17 feet. To mitigate for the loss of the trees the applicant is proposing the following: • Construct a northeast and a southeast corner planter island; each to accommodate a tree; and The landscape buffer width on the east boundary is proposed to increase from 5 feet in width to 8 feet in width and the five (5) required trees would be replaced with a mix of 2 -gallon woody shrubs (ivory halo dogwoods and dwarf blue artic willows). Staff has reviewed the applicant's request and because ACHD's requirements conflict with the City's in this instance, staff approves the request in accord with UDC 11-5B- 5B.2d. ALTERNATIVE COMPLIANCE FINDINGS: In order to grant approval for alternative compliance, the director shall determine the following findings: 1. Strict adherence or application of the requirements is not feasible; OR Strict adherence is not feasible due to ACHD's desire for no trees within their easement. Further, the applicant preference is to provide, at a minimum, a 25 -foot wide safety zone between the riding course and the east boundary to maintain an adequate buffer for driver safety. 2. The alternative compliance provides an equal or superior means for meeting the requirements; and The Director finds the applicant's proposal to provide the woody shrubs in lieu of the five (5) trees, construct the two (2) planter islands to accommodate two (2) of the required trees and construct the 8 -foot wide landscape buffer on the east boundary provides an equal means for meeting the perimeter landscape requirements set forth in UDC 11 -3B -8C. 3. The alternative means will not be materially detrimental to the public welfare or impair the intended uses and character of the surrounding properties. The Director finds that the proposed alternative will not be detrimental to the public welfare or impair the use/character of the surrounding properties and contributes to a cohesive landscape theme within the proposed development. CITY COUNCIL REVIEW The applicant or a party of record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Division on or before March 9, 2015, within fifteen (15) days after the written decision is issued, and contain the information listed in UDC 11 -5A -6B. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. You have the right to request a regulatory taking Conditions Document 3 High Desert Riding Academy analysis under Idaho Code 67-8003. EXPIRATION Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if the use has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure shall expire if the construction or alteration has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. The classes are administered by the Idaho STARS organization who prepare riders at every level of experience with the skills and knowledge for safe riding. STARS offer a variety of courses led by Idaho -certified instnictors who provide each rider with hands-on experience and individual feedback based on the skill set they bring to class. The course layout is used to teach street -strategies and hazard -response skills as well as low -speed maneuvers and advanced cornering, braking, and swerving skills. There is a 24'-34' asphalt buffer around the course for transition from the course to stopping. There is a 5' landscape buffer around the property lines with a 10' landscape buffer along E. Cinema Drive. The concrete curb separating the asphalt buffer zone from the landscaping is sloped to minimize any potential impacts with a motorcycle wheel. The asphalt area is sloped to the sides for drainage with the inverts at the course boundaries to minimize any influence with the riders. The asphalt area will also be used by Harley Davidson for additional car parking during special events. No car striping will be included in the project. C2c- 15'001 February 12, 2015 High Desert Harley Davidson Riding Academy Alternative Compliance Narrative The proposed project is to build a motorcycle skills training course. The course is a 155'x 180' asphalt area with painted lines and movable safety cones. There is a STARS requirement of a 25' asphalt buffer around the course for transition from the course to stop. There is a 5' landscape buffer requirement along the east property line. With trees required every 35' this would constitute a requirement of 6.5 trees. Also along the east property line is a 15' ACHD storm drainage easement with a 36" drain pipe. ACHD does not allow any trees within 10' of this pipe. Trees require a minimum 5' wide landscape area. If the landscape strip is required to be 10' away from the pipe this would put the landscaping and curb 20'-6" from the east property line and reducing the asphalt buffer to 17'. This is an unrealistic scenario and therefore the reason for the alternative compliance. We propose to create north-east and south-east corner islands for one tree each. To mitigate the remaining 4.5 trees we propose to increase the landscape buffer from 5'-0" to 8'-0". The 8' landscape area would support clusters of large scale shrubs and bushes. The proposed 2 gallon dwarf fountain grass would be replaced with Ivory Halo Dogwoods which are 5'x5' and groups of Dwarf Blue Arctic Willows, these mature about 8' x 8' in size. The property to the east is undeveloped and there are no immediate plans for its development. The wider landscape area and shrub clusters would provide an aesthetic long term landscape buffer.
