Broadway Ave., Suite 102 Meridian, ID 83642 RE: Jayker Village Subdivision Rezoning, Preliminary Plat, Conditional Use Permit, Alternative Compliance and Development Agreement Modification Applications Dear Bill, Oak Leaf Development Company, Inc. wishes to subdivide their 23 -acre property, located at the northwest corner of the intersection of Chinden Boulevard and N. Tree Farm Way, in Meridian. The property is bounded on the east by Jayker Subdivision — Phase 1 and on the north by Spurwing Grove Subdivision #6. The current use of the property is agricultural. A construction project is currently underway to relocate and pipe the Harrell Lateral, which historically traversed the property. The property is within the original Treehaven, LLC annexation and zoning and is subject to the associated Development Agreement, as amended. Exhibit C (Concept Plan) of the original Development Agreement (#106151218), recorded September 21, 2006, designates this area as Village Housing and Mixed Use Neighborhood Commercial. The property is currently zoned R-15 and C -N corresponding to the Concept Plan. A development application has never been submitted for this property. The applicant proposes to subdivide the property into 4 buildable lots and 3 common area lots. Development of the property will include extension of the existing N. Tree Farm Way to the west, from the existing terminus at the intersection with N. Tree Haven Way, to the westerly boundary of the property. This will be an ACHD residential collector and dedication of the right-of-way will create common area "buffer" lots on both sides. The third common area lot is an existing deeded lot, identified as Lot 1, which contains the existing entry feature to the west of the intersection of N. Tree Farm Way and Chinden Boulevard. This lot is owned by the Spurwing Greens Master Association, Inc. There will be no additional improvements to this lot. The two existing structures on Lot 2 will remain with use by their current occupants. One building is. occupied by a landscape maintenance service company. The second building is jointly occupied by a photo studio and a pest control business. Water and sewer services are currently provided by onsite well and septic. The applicant is requesting a waiver to allow continued use of the onsite services until a development application is submitted for lot 2. With some minor adjustment, the existing area that is zoned R-15 will be one, 6 -acre buildable lot (Lot 5) that will be subject to further development through a future application. This lot will be incorporated into the existing, adjacent Spurwing Green Master Association (Master Association) and will be subject to the existing Development Agreement (DA). The other 3 buildable lots (2, 3 & 4) will be subject to the accompanying rezoning application from C -N to C -C and will be excluded from the existing Master Association. The DA Modification application will remove the commercial lots from the existing DA and a new DA will be created based on the proposed 2447 S. Lot 4 is proposed to be developed as a self-service storage facility, which is addressed in the Conditional Use Permit (CUP) application, and will comply with the specific use standards set forth in UDC 11-4-3-34. The property to the west of lot 4 is currently zoned R-15 requiring a 25' buffer. The CUP application includes a request for reduction of this buffer width to 15'. There is existing, mature landscaping on lot 4 along the common boundary ( see attached photos) and, while the adjacent property is a residential zone, it is likely that it will be developed as a commercial use. The submittal package includes an application for Alternative Compliance. The applicant is requesting a waiver in the minimum buffer requirement adjacent to a road right-of-way in two locations. The Unified Development Code (UDC) requires a 35 foot buffer for commercially zoned property abutting an entry corridor, in this case Chinden Boulevard. The buffer is measured from the 30 foot right-of-way reservation dictated by ITD. Therefore, the northerly limit of the required buffer will be 65 fleet north of the existing right-of-way line. There is an existing barn structure, located on lot 2, which is to be preserved through the development process and is located 60 feet north of the existing right-of-way line of Chinden Boulevard. In addition, the current use of this building requires a 10 foot wide access along the south side of the building for a total encroachment into the required buffer of 15 feet. The applicant is requesting a reduction of the required buffer width from 35 feet to 20 feet along the 180 foot frontage lot 2 has on Chinden Boulevard. It should be noted that this project has a total of 1.268 feet of frontage on Chinden Boulevard. Of that, the 868 foot frontage along lot 4 will provide the required 35 foot buffer. Lot 1, to the east, is a common area lot that has been improved with landscaping and an entry feature to the Spurwing Greens Subdivision. Along that 220 foot frontage, there is a minimum lot depth of 60 feet beyond the right-of-way reservation providing an effective buffer width varying from 60 feet to 135 feet. The average buffer width provided along this project frontage will be 43 feet. In addition, the applicant is proposing a more intensive buffer along the lot 2 frontage, as indicated on the attached landscape plans. The second waiver request is for a buffer reduction along the north side of the proposed N. Tree Farm Way beginning at the intersection with N. Tree Haven Way and extending approximately 150 feet to the west. The UDC requires a 20 foot buffer forresidentially zoned property abutting a collector. Due to circumstances associated with the platting of the Spurwing Grove Subdivision to the north, adequate buffer width was not provided for the extension of N. Tree Farm Way. Within the 150 foot distance, the buffer width will -vary from 14 to 20 feet. Additional landscaping will be provided within the planter strip and the road median, along this distance, to compensate for the reduced buffer width. Republic Storage would prefer a parking reduction in lieu of paving more parking area than needed for business operations. Republic Storage has 17 facilities and they bave found that 5 - 6 parking stalls, including the handicapped stalls, are sufficient for a facility such as planned in this subdivision. The plan proposed currently has 7 parking stalls. The office space in the residence at the entry is 360 square feet, which only requires 1 space under Meridian code. This space would be used only when the relief manager is on-site. Time Resident Manager will have a company supplied storage unit and a separate parking area for his/her vehicle. Tree Farm Way. I have attached a draft of the Preliminary Plat for reference. N. Tree Farm Way will be extended to the west from the existing intersection with N. Tree Haven Way to the westerly property boundary as shown. Lot 1 is an existing parcel that has been developed with the entry feature on the west side of the intersection. This will remain a common area lot. Lots 2 and 3 will be commercial office/retail and lot 4 will be a self storage facility. Lot 5 is zoned for medium high density residential. This subdivision application will create these lots with no lot specific development. The individual lot development will require an additional application for either resubdivision into residential lots or a site plan. All of the lots will have access from N. Tree Haven Way. It is anticipated that the lot 5 future residential subdivision will include a road that loops through the lot from N. Tree Haven Way to a future intersection with N. Tree Farm Way near the northwest corner of the lot. The R-15 zone allows a gross density of 15 dwelling units per acre. Based on the acreage of lot 5, the maximum number of units is 92. NOE Plwne: 208.850.4926 Fax: 208.939-8602 As requested I have reviewed the available test hole and monitoring data to project groundwater conditions for the Jayker Village Subdivision site. Historical information is available for eleven test pits located near the subject site. An ACHD monitor well is also located north of the property. The locations of all reference test holes are shown on the attached map. The subject property is approximately 22 acres in size and lies south of N. Tree Haven Way and north of Highway 20-26. The approximate area of the total Spurwing Subdivision where the reference test holes are located is 140 acres. Monitor data shows all of the test pits shown on the map have remained dry to varying depths from 135 to 182 inches below ground level. The "dry hole depths" for each of the locations is depicted in the following table. The only point where groundwater was observed is at the ACHD monitor well. That measurement was taken on February 26, 2014. This alluvial terrace is quite uniform and groundwater levels are typically greater than 15 to 20 feet deep. Driller logs of nearby wells indicate first water was encountered at depths from 36 to 126 feet. The static level in those wells was 20 to 32 feet after levels had stabilized. The measured groundwater level in the ACHD monitor pipe was measured at 20.1 feet below the sidewalk surface. Based on the available elevation data, the groundwater elevation at that point would be 2527.9 feet. The substratum is freely drained coarse sand, gravel and cobbles and subsurface water moves north and west toward the Boise River floodplain in that material. This "pit run" material ranges from 50 to 100 feet thick. I have observed a large number of test pits on this particular fan terrace over the years and conducted groundwater monitoring on numerous properties. Peak groundwater levels of 3 to 6 feet below the ground surface are not uncommon in areas of irrigated cropland. However, after irrigation systems are removed and cropping discontinued, groundwater levels often drop to a more "natural" static level. Groundwater is also deeper near the edge of the terrace where it slopes off into the floodplain. An irrigation lateral runs diagonally through this site from southeast to northwest. It is possible that groundwater levels near the lateral may have been higher due to ditch losses. Development plans call for this lateral to be placed in pipe prior to construction. Therefore, ditch losses will no longer be a consideration. Data from the nearby test holes provides an accurate depiction of drainage conditions on the Jayker Village Subdivision site. The ACHD monitor well establishes the groundwater elevation at 2527.9 feet during winter months. Based on all the data, I would not expect ground water within 18 feet of the ground surface post -development on this site. I will provide you a signed hard copy of this report by mail.
