The parcel was, as noted above, zoned for that use and specifically approved by CUP 03-008 for 270 apartments on the 15.3 -acre parcel at a projected density of 18 units per acre. • The apartment project proposed by this application consists of 280 units on a reconfigured 15.62 acre, R-40 parcel, and, at a density of 17.9 units per acre, conforms with the original project's 18 -unit per acre density. [NOTE: The project's original unit counts for all residential components, including single family, townhomes, and apartments, and commercial square footage limits established by DA Instrument No. 103137116, were eliminated through the subsequent development agreement modification process (MDA -13-010) and DA Instrument No.113083665.] 3 ■ The apartment proposal has been the subject of extensive neighborhood review and discussion. • The required 300 -foot radius neighborhood meeting was held on April 22, 2014. • A second meeting with the Paramount community followed on May 1st More than 100 residents (99 signed in) attended the meeting. Among the concerns expressed were the potential impacts on traffic, schools, and neighborhood facilities. Some, unaware of the prior zoning and multi -family approvals, questioned whether apartments were appropriate for Paramount, or even allowed. • Following the meeting, a neighborhood committee was designated to work with Brighton to address their concerns not only for the impacts, but also the size, scale, and design of the project. The results of that effort were significant and are detailed in notices, memo's, and e-mail provided in the neighborhood outreach documentation submitted with this application. • A third neighborhood meeting was held on October 14, 2014. Invitees included not only the Paramount community (informed by Paramount's electronic HOA newsletter and the committee report to the neighborhood) but also property owners within 300 feet of the site. Oscar Avenue and two from the Motion Picture Drive loop connecting Meridian and McMillan. • Site Access: Pedestrian A pedestrian corridor "Boulevard" is provided through the center of the project to connect W. Studio Drive to the Meridian / McMillan c�ercial corner, in part, for the benefit of the Paramount single-family community. 5 • Perimeter Buffers The site plan provides the required landscape buffers of 25 feet on the McMillan arterial roadway frontage and 20 feet on the Studio Drive collector street frontage. There is a minimum 15 -foot landscape buffer along the interior local streets, N. Oscar Avenue and Motion Picture Drive. Given the lack of garage access from perimeter streets, it assumed that the 15 -foot buffer noted above satisfies the UDC's "street setback to garage" requirement. If that is not the case, we request specific approval of that standard. [NOTE: This item appears to be the only potential "variance" issue with regard to the standards and requirements of the UDC.J • In addition to the landscape buffers, all perimeter streets feature detached sidewalks with 8 -foot parkway planter strips. • Garages along the perimeter street frontages also add to the aesthetic "buffering, " particularly of the three-story, 24 -unit apartment buildings, as depicted below. Facing outward, the one-story garages capture the street view, featuring significant articulation of exterior wall elevations and roof structures, and varied architectural finishes as called out below and in the plans submitted herewith. Data is available for various holes on or near the property from 2000, 2002, 2005 and 2006. A map is attached which shows test pit locations on a 2011 photo image base. The site boundary is approximated. Monitor data for the selected test holes is displayed on the included tables. Monitor pipe TH1-05 is the only one of the 6 shown that occurs on the property. I selected other monitor pipes that are within 1/2 mile of the property. On this large terrace landscape position, readings some distance from the site are reliable data. Test hole 1-05 remained dry to a depth of 168 inches below ground level for the entire 2005 irrigation season. At 3-05 a peak of 110 inches was observed in 2006. Test hole 3B had a high of 86 inches in 2000, but was dry to 107 inches throughout 2002. Pipe 3-02 was dry to 171 inches while 2-05 and 4-02 were dry to more than 125 inches. A summary of these six holes indicates that peak ground water levels are generally below a depth of 10 feet and in some cases is not present to more than 14 feet. Keep in mind that the 2000 and 2002 values were collected when the entire area was still being irrigated. As development progresses and the area of irrigated cropland decreases, levels will generally drop. David responded that Brighton had gone back to the drawing board to change the site plans and architecture on the project and that they would likely be ready to talk further in late summer/early fall. On 9/17/2014 David Turnbull's assistant, Becky, reached out to us via e-mail to inform us that Brighton was ready to show the new plans for the apartments and would like to set up an appointment with the apartment core team they had met with in early May. All parties agreed to meet on 9/25 at 4 PM in the Brighton offices. We were told that David and his team took seriously the concerns and constructive input that so many of the community members had conveyed in the spring. Based on those interactions Brighton modified the original plans to incorporate resident input. The following are the details of the changes made over the summer and how they tie back to the original concerns voiced in the spring. Apartment Density Brighton has reduced density from 360 apartment units to 280 units, an almost 25% reduction. This was something we were told would be the case but no specific number was landed on in discussions in the spring. Commercial Space around Perimeter The original plan was to have commercial space on the outside perimeter of the apartments. The site plans still include commercial space, but separate from the apartments with no ingress to the apartments. A green space surrounds the commercial space as a bit of a barrier. These commercial spaces ingress and egress onto Meridian Rd and Mc Millan Rd. Now there is also a large commercial space between the Mormon Church and the apartments, facing Meridian Rd, which once was part of the apartment complex. This space is now planned for commercial, quite likely to be professional office space. However, if it does not lease in the future they will need to rethink that land and reserve the right to develop it out as they choose, including potentially more apartments. Perhaps this is one place where we as residents might be able to support Brighton through helping to find tenants for that space. Street and Traffic Flow into Paramount Brighton dropped the egress from the apartments into the neighborhood from 3 points to 2 and placed them off -center from Paramount/CBH Streets so that the apartment traffic does not have a straight shot emptying directly into neighborhood streets. You will recall that there is a half-moon street that is the outer neighborhood street that the apartments line. Originally there were 3 points of direct ingress from the apartments to the neighborhood, one at W Laughton, one at W Peck, and one onto a street that will eventually run down to W Producer by the Mormon Church (not developed yet). The middle straight shot down W Peck Street to Paramount Elementary School is now a grassy pedestrian corridor that will empty at W Peck Street for pedestrian traffic only and specifically for access to the elementary school children. This leaves us with two points of vehicle exit from the apartments, both off -center and near the Meridian Rd and Mc Millan Rd ends of the half-moon street lining the apartments:' As stated before, Brighton has limited pull with ACHD and therefore has limited say on the planned streets or on traffic slowing measures. The same 5 ingress points off of the half-moon street into the neighborhood remain on the plans and no planned traffic slowing measures have been directed by ACHD to date that Brighton is aware of. If we want to make impact here, we the community will need to study the collective impact and concerns to the community (not just Paramount) and approach ACHD as voting homeowners to impact change. Please see below for more details on a Traffic Impact Committee. Design Plans, Landscaping, and Barriers This is where there is significant improvement. The new plans eliminate the 3 -story 36 -unit buildings favoring mostly 2 -story 16 -unit buildings and 3 -story 24 -unit buildings. The green space between and around the apartments has significantly increased, with two toddler parks and one pool. The entire apartment complex will have solid garages lining the outside perimeter that faces the neighborhood, built in a way that will reduce noise but also in a way that is visually pleasing (faux windows and landscaping around each garage). The style of the buildings is in line with the community standards of craftsman style architecture and is a mix of stone and siding with stone and masonry accents and natural colors in keeping with the community standards. Each building has angled rooflines that vary to make them more visually appealing. The outside parameter of the apartment complex will have berms and trees and other landscaping that will be both visually appealing and act as a noise barrier. A side walk will surround the community with street trees consistent with the rest of the neighborhood. Community Meeting Brighton will prepare for a community meeting that will hallmark the changes made to the apartment complex in the coming weeks. They will notify the community when it has been scheduled. When will this Happen? We asked when Brighton thought that this plan would break ground, and we were told they estimated early next year (2015) after it goes through the Meridian Planning and Zoning Board. Brighton plans to meet with the community again and then file with the city. As is usual, the city will assign a city planner to the project and that person will schedule a public meeting. This meeting will be a good time for residents to testify as to how they feel about the plans. What's Next? The core team of folks that led the community effort in the spring felt strongly that this redesign of the plan by Brighton did indeed address the biggest concerns of the community and represented a significant good -faith effort that also represented a large labor and cost investment on their part. We understand that there were a number of folks that were only interested in stopping the apartments all together, and that was indeed the core teams sentiments when this all started in the spring. However, since then we have all learned that the property was zoned high-density in 2002 and whether it was disclosed to everyone or not, it was indeed the case. We feel this new plan represents a good compromise and reduces impact to the community. We hope you will take the time to attend the Brighton meeting about the newly proposed apartments and both review the new plans and discuss the changes with the Brighton team. However, there were a few things that were not addressed but were also identified as things that Brighton cannot impact, such as traffic, infrastructure, and school enrollment numbers. These are city and county issues that involve working with elected officials to impact change. On these items we the community will need to come together, study, and bring to the appropriate agencies documented evidence as to what the community feels needs to be changed and work with the appropriate agencies to find solutions that will work for all parties. As such, we are seeking three community members to step forward and lead those three committees: Traffic Impact Committee; School Impact Committee, and Infrastructure Impact Committee. Below are some brief descriptions of each but will be much further defined as leadership for each is found. Traffic Impact Committee: to study the impact to the entire community of the planned expansion both within Paramount and in its surrounding subdivisions and research solutions that might improve impact to traffic flow and both vehicle and pedestrian safety. This group will work with ACHD to find solutions that might work better for both parties and will work to include Brighton and surrounding businesses in these discussions. School Impact Committee: to study the impact to the four schools directly fed by the growth within Paramount and the surrounding feeder subdivisions in order to find potential solutions to diminish capacity issues and the resultant downstream impact. This group will need to work closely with the principals and teachers at each of the schools as well as with the West Ada School District to find solutions that will impact change and relieve pressure from the current and coming capacity issues. Infrastructure Impact Committee: to study how the community was placed in a situation where growth has far exceeded infrastructure investment and through working with community leaders find ways to relieve the resultant pressures on existing residents from the coming consequences of these decisions. This group will need to work with city officials, both elected and appointed, to better understand how we arrived in this position and what the plans are for impacting change while keeping the community informed and engaged. If you are interested in leading one of these committees please let me know ASAP. We hope to get these committees up and running immediately in order to be prepared for the Planning and Zoning Board public meeting on these apartments. Once we have a leader for each committee that person will seek membership and assign tasks accordingly. Remember, to complain but take no action simply amplifies problems, but to organi a with action to impact change creates solutions that improve lives. We were told that David and his team took seriously the concerns and constructive input that so many of the community members had conveyed in the spring. Based on those interactions Brighton modified the original plans to incorporate resident input. The following are the details: Apartment Density Brighton reduced density from 360 apartment units to 280 units, an almost 25% reduction. This was agreed to this spring but reduction was more than anticipated. Commercial Space around Perimeter Originally plans included professional space on the outside perimeter of the apartments, which is still the case. Now this space is separated from the apartments by an enlarged green space and no ingress/egress into apartments. There will be separate parking from the apartments and it empty onto Meridian and Mc Millan Rd's. To the south, toward the Mormon Church and facing Meridian Rd, Brighton converted a portion of the land for the apartments to "commercial or high density". This is now planned for professional office space and will be marketed as such. However, if it doesn't lease Brighton will need to rethink that land, reserving the right to develop as they choose, including potentially more apartments. Perhaps this is an area we as residents can help with ... finding tenants for that space. Street and Traffic Flow into Paramount Brighton dropped ingress/egress from apartments into the neighborhood from 3 points to 2 and placed them off -center from Paramount/Cedar Springs streets so that the apartment traffic does not have a straight shot emptying directly into neighborhood streets. You will recall a half-moon street that seperates the neighborhoods from the apartments. Originally there were 3 points where the apartments emptied directly into the neighborhood: W Laughton, W Peck, and onto the street that will eventually run down to W Producer by the Mormon Church (not developed yet). The middle straight shot down W Peck Street to Paramount Elementary School is now a grassy pedestrian corridor that will empty at W Peck Street for pedestrian traffic only and specifically for access to the elementary school children. This leaves us with two points of vehicle exit from the apartments, both off -center and near the Meridian Rd and Mc Millan Rd ends of the half-moon street lining the apartments. Brighton has limited pull with ACHD and therefore has only limited say on planned streets and traffic slowing measures. The same 5 ingress points off of the half-moon street into the neighborhood remain on the plans and no planned traffic slowing measures have been directed by ACHD to date. If we want to make impact here, we the community will need to work with ACRD. Design Plans, Landscaping, and Barriers New plans eliminate the three story, 36 unit, barrack -style apartments favoring mostly two story, 24 unit buildings with a few one story, 16 unit buildings. The green space between and around the apartments has significantly increased, with two toddler parks and one pool. The entire apartment complex will have garages lining the outside perimeter built in a way that will reduce noise but also in a way that is visually pleasing (faux windows and landscaping around each garage). The building style is in line with the community standards of craftsman style architecture and includes cut stone fronts and natural colors in keeping with the community standards. Each building has angled rooflines that vary to make them more visually appealing. The outside parameter includes berms, trees, and landscaping that will be both visually appealing and act as a noise barrier. A side walk will surround the community with street trees consistent with the rest of the neighborhood. When will this Happen? Brighton stated that if approved by the city they would likely begin the infrastructure early 2015. Brighton will meet with the community on October 14th and then file with the city. As is usual, the city will assign a city planner and that planner will schedule a public meeting for community input that will be advertised. Community Meeting Tuesday, October 14th at Paramount Elementary School in the cafeteria at 6:30 PM. Please try to attend. What's Next? We felt that Brighton did address the concerns the community expressed in the spring and represented a significant good -faith effort. We understand that there were a number of folks that strongly felt the apartments should be stopped all together. That was indeed the core teams sentiments when this all started in the spring. However, since then we have all learned that the property was zoned high-density in 2002 and whether it was disclosed to everyone or not, this would be a long and expensive battle that we might not win. We feel this new plan represents a good compromise and reduces impact to the community. However, there were a few things that were not addressed but were also identified as things that Brighton has little impact, such as traffic, infrastructure, and school enrollment numbers. These are city and county issues that involve working with elected officials to impact change and require community engagement. We are seeking three community members to step forward and lead those three committees: Traffic Impact Committee; School Impact Committee; and Infrastructure Impact Committee. Please let me know ASAP if you would like to lead or co -lead one of these committees. Once we have a leader for each committee that person will seek membership and assign tasks accordingly.
