To Whom it may concern:
The owner of "adjusted" Lot 17, Block 11 of Jayker Subdivision - Phase 1 wishes
to vacate the 5'easement on the South line of Lot 17. The 5' easement was created by
Note No. 12 as shown on sheet 10 of the recorded plat.
The adjusted Lot 17, now includes all of Lot 18 whose common lot usage was
eliminated by the City of Meridian action MFD 11-003. However Lot 18 retains the public
utility easement over the entire 20' width.
The additional 5' created by Note No. 12 restricts the building envelope and is
redundant since it is adjacent to the 20' easement created in Lot 18.
Attached are the original plat, plat note, and lot line adjustment survey.
We had dig -line mark the area for utilities and other than the common trench along
the street frontage only Intermountian Gas has a line along the South portion of the
"adjusted" lot. The gas line lies in the 20' public utility easement shown on the plat (Lot
18) and does not encumber the 5' easement created by Note No. 12

Situated in the Northeast Quarter of Section 22, Township 4 North, Range 1 West, Boise
Meridian, Ada County, Idaho.
Dear Mr. Tealey:
This is in response to the Relinquishment Application submitted to Idaho Power Company on
November 10 2014, regarding the possible relinquishment of the 5' public utility easement
dedicated along the south boundary of Lot 17, Block 11 of Jayker Subdivision (Utility Easement
Area). This relinquishment request does not include any portion of the 10' public utility
easement along the roadway or the 20' public utility easement that is dedicated over the entirety
of Lot 18, Block 11 of Jayker Subdivision.
Idaho Power's review of the relinquishment request indicated that there are no facilities with the
Utility Easement Area. As such, Idaho Power agrees to relinquish what easement rights are
found within the Utility Easement Area.
Thank you once again for providing Idaho Power Company the opportunity to review and
comment upon the subject petition for relinquishment.

RELEASE AND HOLD HARMLESS AGREEMENT

This Release and Hold Harmless Agreement is made and entered into this day of
aA/N)AP 201!rby and between United Water Idaho Inc, ("United Water") and I£evin E.
Denison & Staci L. Denison ("The Denison's").
RECITALS
United Water owns and operates a potable water pipeline ("The Pipeline") located within
an easement ("The Easement") existing in the ]ayker Subdivision as shown on the plat thereof and
recorded as Book 101 of Plats, Pages 13341-13352, Instrument Number 108095133 records of
Ada County, Idaho and depicted on Exhibit A, attached hereto.
The Denison's have commenced construction of a structure, which encroaches into and
upon The Easement.
United Water desires to consent to vacate a portion of The Easement so as allow
construction of the encroaching structure.
In return, The Denison's desire to release and hold harmless United Water from any loss or
damage that may result to the encroaching structure due to United Water's ownership and operation
of The Pipeline.
AGREEMENT
NOW THEREFORE, in consideration of the foregoing, it is mutually agreed:
Release: The undersigned, Kevin E. Denison & Staci L. Denison in consideration of the
consent by United Water, to vacate a portion of The Easement, which is hereby given, do
irrevocably, personally and for their heirs, assigns and legal representatives, release and waive any
and all past, present or future claims, demands, and causes of action which the undersigned now has
or may in the future have against United Water, its members, directors, administrators,
representatives, officers, agents, employees, and assigns, and each of them (hereinafter jointly and
severally referred to as "Releasees"), for any and all past, present or future loss of or damage to
property, however caused, resulting from, arising out of or in any way connected with United Water
Idaho's operation of The Pipeline.
Hold Harmless /Indemnity: The undersigned agrees to defend, indemnify and hold
harmless the Releasees and each of them from any loss, liability, damage or cost they might incur
due to the operation of The Pipeline whether resulting from the negligence of the Releasees or
otherwise. The undersigned further covenants not to cause any action at law or in equity to be
brought or permit such to be brought in their behalf, either directly or indirectly, on account of loss
or damage to property against the Releasees, resulting from, or arising out of, or in any way
connected with any claims, demands, and causes of action which now or in the future may be
asserted against the Releasees arising out of or by reason of operation The Pipeline.
