Dear Ms. Watters:
We are pleased to submit the enclosed applications associated with Nesting Swan Ranch
Subdivision. The project is generally located at the northeast corner of S. Eagle Road and E. Amity
Road. As was discussed with city staff during our pre -application conference, the included
applications request annexation of the property, rezone to R-8, and approval of a preliminary plat
for the first phase of the development, which will include public roadways together with a
neighborhood of private/gated streets. The Land Group is pleased to represent the owners as the
applicant for this request.
Annexation/Rezone Application:
The applicant proposes annexation/rezone of three parcels totaling approximately 26.31 acres:
4617 S. Martinel Lane (R5475470011), 10.368 acres; Previously Lot 1, Block 1, Martinel Sub
4620 S. Martinel Lane (R5475470030), 11.39 acres; Previously Lot 3, Block 1, Martinel Sub
3570 E. Amity Road (S1128336506), 4.548 acres (Diamond View Assisted Living - included per
request by Meridian Planning Staff)
The properties are currently zoned RUT in Ada County but lie within the City of Meridian Impact
Area. The Meridian Comprehensive Plan designates the properties as Medium Density Residential
which is defined by the UDC as R-8. The proposed project and zone complies with the City of
Meridian's UDC, the R-8 zoning requirements and Meridian's Comprehensive Plan.

The properties will obtain sewer and water service from the City of Meridian once the
annexation/rezone application are approved. Pressure Irrigation will be coordinated with the New
York Irrigation District and Boise Project Board of Control.
Preliminary Plat:
In total, the proposed Phase 1 of the Nesting Swan Ranch Subdivision includes 10.368 -acres (parcel
85475470011 only) and will develop 31 single-family residential lots, 7 common lots -including
private streets, and one existing home that will remain. The homes are planned as single-family
detached dwellings. As proposed, the project's 31 building lots on 10.368 acres is a gross density of
3 units per acre. The northern 11.39 acres will be presented to the City as a separate preliminary
plat application, which we anticipate submitting in the near future.
New CC&R's and a new homeowner's association will be formed prior to the final plat application
for the subdivision. The building design of this project is to create quality livable housing. Pictures
of conceptual elevations are included in the application package. Specific materials will be finalized
prior to the final plat submittal.
With development of the project, all lots within the subdivision (including the existing home) will be
provided sanitary sewer service by the City of Meridian. As shown by the conceptual improvements
on the preliminary plat, a sewer main is expected to be extended to the project, along Eagle Rd from
the west. This route has been previously discussed with Meridian Public Works and approved in
concept, subject to final engineering design.
Water service for domestic and fire -protection will be provided by the City of Meridian via an
extension of the existing system which exists along both Amity and Eagle roads.
A pressurized irrigation system will serve all lots throughout the subdivision and will be owned and
operated by the Homeowner's Association.
The main access to the subdivision is proposed from Amity Road via Martinel Avenue at the existing
location of the private road intersection of Martinel Lane. No direct access to Eagle Road is proposed
with the exception of emergency vehicles, who are provided a secondary access to the project via the
existing easement / access -point. The main "spine street", Martinel Avenue, will run north -south
through the subdivision and will be dedicated to the public and constructed to Ada County Highway
District (ACHD) standards with curb, gutter and sidewalks. Direct access from individual lots will be
prohibited to both Eagle Road and Amity Road.
The Nesting Swan Ranch Subdivision proposes a network of private, gated streets, accessed from
the public street, Martinel Avenue. All proposed internal streets are private and will be owned and
maintained by the Homeowner's Association. These roadways provide access to lots for residents,
visitors and meet the requirements of emergency service providers. The 1.173 acre adjacent
property located at the NE corner of Eagle and Amity (3290 E. Amity), is not included in the project,
but the Developer proposes to provide access to this neighboring property via the internal private
streets should the property re -develop as single-family residential uses and lose its existing access
to Amity Rd.

At the project's main entrance from Martinel Avenue, a well -landscaped and elegant roadway
approaches the gated entry which enhances the privacy and security of the neighborhood. At this
entry, an entry plaza provides space for vehicles entering the project to queue while operating the
security gate. Adequate turnaround space is provided. As previously discussed, secondary
emergency/secondary restricted access enters the project from Eagle Road at the north property
boundary. This access will be restricted to emergency vehicles only by use of bollards or similar
facilities, subject to fire department approval.
Storm water will be retained on site. Preliminary groundwater analysis shows the groundwater in
this area is approximately 5.7-14.2 feet below the natural ground elevation. The private roadways
provide a zone adjacent to the paved surface for grass -lined bioinfiltration swales, which will
collect, treat and infiltrate stormwater from the roads. The proposed lots throughout the project
will be graded relatively flat, facilitating each lot to retain stormwater within the Limits of each lot.

COMMITMENT OF PROPERTY POSTING
Per Unified Development Code (UDC) 11 -5A -5D, the applicant for all applications requiring a
public hearing (except for a UDC text amendment, a Comprehensive Plan text amendment
and/or vacations) shall post the subject property not less than ten (10) days prior to the hearing.
The applicant shall post a copy of the public hearing notice of the application(s) on the property
under consideration.
The applicant shall submit proof of property posting in the form of a notarized statement and a
photograph of the posting to the City no later than seven (7) days prior to the public hearing
attesting to where and when the sign(s) were posted. Unless such Certificate is received by the
required date, the hearing will be continued.
The sign(s) shall be removed no later than three (3) days after the end of the public hearing for
which the sign(s) had been posted.

Hi Tamara, Swan Estates was recorded in 1991 by Fischer Land Surveying in the SE 1/4 of Section 26,
T2N, R1W, B.M. This proposed plat is not adjacent to the Swan Estates and the name is already
used. Do you have some other possible ideas for the name? The SoundEx function built into the
Subdivision Name Search on our website may be able to help find a name for the project. If you
