891 City Code Notice of Mailing CITY OF MERIDIAN AN ORDINANCE OF THE CITY OF MERIDIAN AMENDING MERIDIAN CITY CODE SECTIONS 11-15-5 B. 1. b., 12-3-3 I. 1., and 12-3-5-B., PERTAINING TO MAIIANG OF NOTICES REGARDING HEARINGS ON LAND USE APPLICATIONS, AND PROVIDING THAT SUCH MAILINGS SHALL BE BY REGULAR FIRST CLASS MAIL; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, current City Code requires that certain notices be sent by certified mail; and WHEREAS, this type of mailing requires individuals to go to the Post Office to pick up the notices, which has created a significant inconvenience to those property owners to whom the notice is mailed; and WHEREAS, regular first class mail provides an adequate method for delivery of notices to individual property owners and is the method most likely to give them notice of the existence and pendency of a land use application; and WHEREAS, it has been determined that using regular first class mail, instead of certified mail, will not reduce the effectiveness of the notices, and will result in cost and staff time savings. NOW, THEREFORE, BASED UPON THE FOREGOING FINDINGS, AND BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF MERIDIAN, ADA COUNTY; IDAHO: Section 1: read as follows: Meridian City Code Section 11-15-5 B. 1. b. shall be amended to 11-15-5 B. 1. b. Contents of Notice: Said notice, by regular first class mail, must be deposited with the United States Post Office at least fifteen (15) days prior to the hearing and said notice shall contain a vicinity map of the property, a brief statement of the nature of the application, the name and address of the applicant. Section 2: as follows: Meridian City Code Section 12-3-3 I. 1. shall be amended to read 12-3-3 I. 1. Notification By Applicant: NOTICE OF MAILING ORDINANCE PAGE 1 OF 3 Notification Of Property Owners: The City shall notify all adjoining property owners 'by mailing, by regular first class mail, notice of the hearing to all property owners within three hundred feet (300) of the proposed boundaries of the subdivision. Section 3: as follows: Meridian City Code Section 12-3-5 B. shall be amended to read 12-3-5B. Notice Of Hearing: No final subdivision plat shall be approved until one public hearing before the Council has been held for the purpose of allowing public input on the proposed subdivision. This public hearing shall be held at the time of the presentation of the preliminary plat by the developer to the City Council. Notice of the public hearing shall be given by mailing, by regular first class mail, notice of the hearing to all property owners within three hundred feet (300') of the proposed boundaries of the subdivision, which mailing shall be completed by the developer and by publishing notice of said hearing in the City's newspaper of record at least one time fifteen (15) days prior to the date of such hearing, which publication shall be handled by the Administrator. The notice to be mailed to the adjacent property owners shall include a copy of the notice of hearing and a vicinity map of the area, which map shall show the proposed subdivision and the properties within three hundred feet (300'). Section 4: All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. Section 5: VALIDITY: The Meridian City Council hereby declares that any section, paragraph, sentence or word of this Ordinance as adopted and amended herein be declared for any reason to be invalid it is the intent of the Meridian City Council that it would have passed all other portions of this ordinance independent of the elimination here fi'om of any portion as may be declared invalid. Section 6: DATE OF EFFECT: This ordinance shall be in full force and effect within one (1) month after its passage, approval and publication, according to law.
