Dear Mr. Parsons:
Attached to this letter is an application for a conditional use permit for a drive-thru use at the above referenced
property. This application includes parcel R1343770170.
This property was previously annexed and zoned under the name of Blue Marlin, application AZ -03-025, and
associated Development Agreements (instrument #105048793 & 106191305) processed in 2005. The property
is Lot 9, Block 2 of the Centerpointe Subdivision and totals 1.225 acres. The preliminary plat (PP -06-020) and
final plat (FP -06-035) were processed in 2006.
The property is currently zoned C -G and is a pad/parcel of the existing Centerpointe shopping center. The
property currently is improved with a restaurant, associated landscaping, and parking. The required 35'
landscape buffer including a 10' wide pathway exists along Eagle Road and will remain. The existing 6400 SF
building will be demolished and a new 5100 SF restaurant with associated drive-thru will be constructed in the
same general area of the site. The majority of the parking lot and landscaping will remain undisturbed.
However, the trash enclosure will be relocated from the north to the south side of the parking lot.
No changes to vehicular access are proposed. The access will be from existing shopping center accesses to Eagle
Road. ACHD has confirmed that a traffic study is not required.
The drive-thru design complies with the drive-thru standards set forth in the Unified Development Code.
