APPLICATION SUMMARY E IDIAN -. ll��at The applicant, SCS Brighton, LLC, requests approval of a 2 year time extension on the preliminary plat in order to obtain the City Engineer's signature on a final plat for TM Crossing Subdivision. The preliminary plat (PP -12-003) for TM Crossing Subdivision was approved by the Meridian City Council on October 2, 2012. Per Unified Development Code (UDC) 11-6B-7, approval of a preliminary plat shall become null and void if the applicant fails to obtain the City Engineer's signature on a final plat within 2 years of the approval of the preliminary plat. Per the conditions of approval, the preliminary plat would otherwise expire on October 2, 2014. The Applicant states in the application narrative that the project has been delayed due to caution within the commercial development market. Because the Applicant is unable to meet the time requirements specified in the UDC, a time extension is requested. A time extension will allow the applicant to continue with development of the project without resubmittal of the preliminary plat. The subject property is located at the northeast corner of I-84 and S. Ten Mile Road, in the SW 1/4 of Section 14, T.3N., R.1 W. H. STAFF RECOMMENDATION Staff recommends approval of a 2 year time extension on the preliminary plat to obtain the City Engineer's signature on a final plat for TM Crossing Subdivision to expire on October 2, 2016. M. STAFF ANALYSIS The City of Meridian's Unified Development Code (UDC 11 -6B -7C and UDC 11 -5B -6F) allows the Director to authorize one administrative time extension to obtain City Engineer's signature on a final plat, not to exceed 2 years, when the applicant files a written request for an extension prior to the expiration of the approved preliminary plat. The applicant has met the necessary deadline by filing a written request prior to the expiration date. Additional time extensions up to two years may be granted if approved by City Council. With all extensions, the City may require compliance with the current provisions of the UDC as a condition for granting a time extension (UDC 11 -6B -7C). In addition, the City Council provided staff with guidelines to use when evaluating time extension requests. These guidelines are meant for guidance and not as a mandate. Staff has reviewed the aforementioned guidelines provided by City Council in relation to this project and believes the project complies with current provisions of the UDC.
