However, Jany surface drainage leaves the site, the Nampa & Meridian Irrigation District (NMID) requires that .a Land Use Change Application is filed for review prior to final platting. Please contact Suzy Hewlett at 466-7861 for further information. This project lies outside of District boundaries as far as delivery of irrigation water is concerned. If this development is under a "rush" to be finalized, I would recommend that you submit a cashier's check, money order or cash as payment of the fees in order to speed the process up. If you submit a company or personal check, it must clear the bank before processing the application. Should this development be planning a pressure urban irrigation system that will be owned, operated and maintained by the Irrigation District, I strongly urge you to coordinate with Greg G. Curtis, Water Superintendent for the Irrigation District, concerning the installation of the pressure system. Enclosed is a questionnaire that you must fill out and return in order to initiate the process of contractual agreements between the owner or developer and the Irrigation District for the ownership, operation and maintenance of the pressure urban irrigation system. Lateral lie within the boundary of the above-mentioned location. The easements for these laterals are held in the name of the United. States through the Bureau of Reclamation under the authority of the Act of August 30, 1.890. (26 Stat. 391; 43 U-S.C. 945) The Boise Project Board of Control is contracted to operate and maintain these laterals. We assert a federal easement 20' northerly and 1.8' southerly of the Sundell Lateral. centerline and we assert a federal easement IT each direction of the Tumbler. Lateral centerline. Whereas these areas are for the operation and maintenance of our facilities, no activity should hinder our ability to do so. Fencing (as may be required) must be constructed just ofd' of Boise Project facilities, to insure public safety and prevent encroachments. Wording on the preliminary and ,fi.nal recorded plat needs to be noted that this development must adhere to Idaho Statutes, Title 42-1209. The Boise Project does not approve landscaping (other than grass) within its easements, as this will certainly increase our cost of maintenance. 07/16/2014 09:44 2083441437 BOISE PROJECT PAGE 02/02 Project facilities and/or easements that parallel, and are within and/or intended to be within road, right-of-ways due to any development of this property must be relocated outside of road right-of-ways. The easements of Boise Project facilities will remain the same unless agreed upon an.d/or approved with written permission frorri Boise Project Board of Control. Crossing agreements must be secured and signed by all parties prior to March 1s` of each year. A time schedule for the construction to be done during the n.on4rrigation season must be approved by Boise Project prior to any activity within Project easements. No construction will be allowed within the easement boundaries of the Boise Project Board { of Control facilities after March 15�h of each year. However, on a case by case basis overhead utilities and utilities boring underneath a Project facility may be allowed after March 15'' if reviewed and approved by the Boise Project. Whereas this property lies within the New York Irrigation District and the Boise -Kura Irrigation District, it is .important that representatives of this development contact the NYID and the SKID offices as soon as possible to discuss the pressure system prior to any costly design work. If applicable, the irrigation system will have to be built to specific specifications as set by the District / Project. Written response from the New York Irrigation District and the Boise -Kona Irrigation District is required. Storm Drainage and/or Street Runoff must be retained on site. Vocal irrigation/drainage ditches that cross this property, in order to serve neighboring properties, must remain unobstructed and protected by an appropriate easement. This development is subject to Idaho Code 31-3805, in, accordance, this office is requesting a copy of the irrigation and drainage plans.
