Dear Shari.
The following are statements of compliance with regard to the above mentioned preliminary
subdivision:
Street improvements in compliance with the City of Meridian Standards exist along
the frontage of proposed Lots 2 and 3 and the public right-of-way of South Teare
Avenue. The remaining street improvements along South Weare Street and Overland
Road will be completed at the time of development of proposed Lot 1 or by other
arrangements with the City and ACHD.
2. This development is in compliance with the current City of Meridian comprehensive
plan.
3. Proposed Lots 2 and 3 currently conned to City services apo proposed Lot a is
stubbed for sewer and water.
4. This development does and will comply with City Ordinances.
5. This preliminary plat will include all appropriate casements.

NOTICE OF HEARING
NOTICE IS HEREBY GIVEN pursuant to the Ordinances of the City of Meridian
and the Laws of the State of Idaho, that the Planning and Zoning Commission of the
City of Meridian will hold a public hearing at the Meridian City Hall, 33 East Idaho
Street, Meridian, Idaho, at the hour of 7:00 p.m., on January 13, 1998, for the purpose
of reviewing and considering the Application of Ronald Van Auker, for a Preliminary
Plat for land located in the SE % of Section 18, T.3N. R.1 E, Boise Meridian, Ada
County, Idaho, and which property is generally located at the Northwest corner of
Teare Avenue and Overland Road.
The applicant requests Preliminary Plat approval of the parcel of land above
described for 3 commercial lots for Teare Commercial Subdivision.

NOTICE IS HEREBY GIVEN pursuant to the Ordinances of the City of Meridian
and the Laws of the State of Idaho, that the City Council of the City of Meridian will hold
a public hearing at the Meridian City Hall, 33 East Idaho Street, Meridian, Idaho, at the

Jenson: Primarily we are subdividing this property into three lots to make it a legal
conforming subdivision. We have two buildings on it and need to just clean this up so
we can develop the third lot. That is really what we are attempting to do and working
with the City on.

with Ada County by Meridian Nampa Irrigation District. That is the easement of irrigation
water along Overland, eastbound going uphill. I would assume that Ron is going to
address this in his developing and I would assume that he would prioritize it depending
on when you let him start building it.

said there or would like clarification? We are going to open that public hearing as
scheduled because we are obligated to do so. The applicant was here they are not
prepared to make a presentation based on the fact they can't proceed or can't see any
sense in proceeding because the Idaho Department of Transportation and ACHD have
not arrived at a conclusion for the site for the traffic signal. So we also have a request
from the homeowners association for a deferral of this item as well. It would be my
supposition that when that item comes and we open the public hearing we will take
whatever testimony you want to present tonight, there will a brief or no presentation by
the applicant and that item will be tabled until our next meeting on February 1 e. So that

Don Carnihan I am with Civil Survey Consultants and I represent Fuller Scott
Development for this Meridian Greens Unit No. 4. This is a 7.2 acre plan development
residential and as originally proposed it consists of 20 lots, 18 of which are residential.
This is situated South of Overland Road, at the intersection of SE 5"' Way. It is
bordered on the south by other units of Meridian Greens to the east by Hunts Bluff and
to the North by the Caterpillar Equipment dealership. The current zoning for this parcel
is R-4 and the reason that we have requested this as a PDR is because of the
landscaping and the alley way arrangement. These are the two main components of this
project. I would like to start with the first one, the first reason for this development is to
take the existing entrance into the Meridian Greens Units and to improve on those. The
way that we would do that would be with the 20 foot landscaped areas. There would be
one in front of the frontage of Overland Road and then both sides of SE 5"' Way. This

(Request for Preliminary Plat)
We have reviewed this submittal and offer the following comments, as conditions of the
application. These conditions shall be considered in full, unless expressly modified or deleted
by motion of the Meridian City Council:
GENERAL COMMENTS
Any existing irrigation/drainage ditches adjacent to or crossing the property shall be tiled per
City Ordinance 11-9-605.M. Plans will need to be approved by the appropriate
irrigation/drainage district, or lateral users association, with written confirmation of said
approval submitted to the Public Works Department. No variances have been requested for
tiling of any ditches crossing this project.
2. Any existing domestic wells and/or septic systems within this project will have to be removed
from their domestic service per City Ordinance Section 5-7-517. Wells may be used for non-
domestic purposes such as landscape irrigation.
3. Determine the seasonal high groundwater elevation, and submit a profile of the subsurface soil
conditions as prepared by a soil scientist with street development plans.
4. Submit copy of proposed restrictive covenants and/or deed restrictions for review by the
Meridian City Attorney.
5. Provide five-foot- wide pedestrian walkways in accordance with City Ordinance Section
11-9-606.B.
6. Water service to this development is contingent upon positive results from a hydraulic analysis
by our computer model.
7. Submit letter from the Ada County Street Name Committee, approving the subdivision and
street names. Make any corrections necessary to conform.

8. Coordinate fire hydrant placement with the Meridian Public Works Department.
9. Respond, in writing, to the each of the comments contained in this memorandum, prior to the
scheduled January 13, 1998 hearing by the Meridian Planning and Zoning. Submit ten copies
of the revised Preliminary Plat Map to the City Clerk's office a minimum of one week prior
to the hearing by the Meridian City Council.
PUBLIC WORKS DEPARTMENT SITE SPECIFIC COMMENTS
Sanitary sewer service to this site will be via the existing main in Teare Avenue. Approval
of this application needs to be contingent upon our ability to accept the additional sanitary
sewage generated by this proposed development.
2. Water service to this site will be via the existing main in Teare Avenue. Applicant will be
responsible to construct services into Lot 1, Block 1. It appears that an additional fire
hydrant will be needed along Teare Avenue, roughly 350' south of the existing hydrant.
3. Indicate any existing ditch easements on the preliminary plat map.
4. The subdivision will be required to install a pressurized irrigation system, unless a variance
is applied for and granted by the City Council. The preliminary plat map must show the
source of the pressurized irrigation system as well as the piping. Any proposal for a
supplementary connection from the City's water system will need to be reviewed closely due
to the size of the area to be watered. As indicated in General Note No. 2, existing wells may
be utilized for non-domestic purposes.
5. 250 -watt, high-pressure sodium streetlights will be required at locations designated by the
Public Works Department. All streetlights shall be installed at subdivider's expense. Typical
locations are at street intersections and/or fire hydrants.
6. How is the storm water drainage from Teare Avenue going to be handled?
7. Please clarify the lot lines on the plat so they are more readily distinguishable from the exterior
boundary line of the subdivision.
PLANNING & ZONING DEPARTMENT SITE SPECIFIC COMMENTS
1. The Applicant is platting this property in cooperation with the City's request to clear up
previous lot splits that took place.
2. Two buildings currently exist on the site of the proposed subdivision. The two existing
buildings do not quite meet the setback requirements for an I -L zone (35 feet).

3. The City of Meridian needs to clear up the zoning of this property. The 1993 Zoning and
Development Ordinance shows the property as being zoned I -L. Somewhere the County has
designated the entire parcel as C -G, but an ordinance has not been located. The City has
permitted construction of the two existing buildings based on the assumed I -L zoning. The
name of the subdivision should be changed to Teare Industrial Subdivision if the zoning is
industrial to avoid confusion for prospective buyersibuilders.
4. As Overland Road is an entrance corridor to the City of Meridian, a 35 -foot landscape setback
is encouraged. The Applicant needs to show this landscape setback either graphically or by
note on the plat. Council has previously required this landscape setback to be designated as
a common lot; however, due to the fact that only one lot will remain for construction, an
easement included as part of this remaining lot should be sufficient.
5. Additional right-of-way dedication for Overland Road needs to be shown on the plat. Section
line roads currently require a 96 -foot -wide total right-of-way per Ada County Highway
District and City of Meridian policy.

Dear Commissioners:
The Nampa & Meridian Irrigation District requires that a Land Use Change/Site Development
application be filed for review prior to final platting. Contact Donna Moore at 466-7861 for
further information.
All laterals and wasteways must be protected. All municipal surface drainage must be retained
on site. If any surface drainage leaves the site, the Nampa & Meridian Irrigation District must
review drainage plans. The developer must comply with .Idaho Code 31-3805. It is
recommended that irrigation water be made available to all developments within the Nampa &
Meridian Irrigation District.

Dear Bruce and Shari:
The following is a response to your comments concerning the conditions of the preliminary plat
application for Teare Commercial Subdivision dated January 7, 1998.
GENERAL COMMENTS
1. Complete design plans will be generated on the unimproved Lot 1, Block 1 when a
buyer and or specific layout is determined. The drainage district will then be notified
for their approval. Lots 2 and 3 are already tiled.
2. Any existing domestic wells will be abandoned.
3. No high ground water was encountered during construction on Lots 2 and 3, these sites
were approved by the City.
4. So noted, CC&R's will be submitted for final plat approval.
5. Sidewalks exist on Lots 2 and 3 and additional sidewalks will be banded for or built at
the time of development of Lot 1.
6. So noted, per phone conversation with Bruce Frekleton this should not be a problem.
7. So noted, we are not changing or creating street names, should not be an issue.
8. So noted, to be included in design plans.
9. Revised preliminary to follow.
PUBLIC WORKS DEPARTMENT SITE SPECIFIC COMMENTS
1. The existing manhole adjacent to Lot 1 has a stubout serving said Lot, it is assumed
that the existing sewer main can service this development.
2. So noted.
3. A revised preliminary plat will follow showing a 10 foot wide drainage and utilities
easement adjacent to public right -of --ways.
4. Lots 2 and 3 are currently connected to City water for irrigation which was approved at
the time of the development of said lots. We anticipate connecting to City water at the
time of development of Lot 1 and a detailed plan will be created at that time. A
irrigation lateral will be indicated on the revised preliminary plat to follow.
5. The owner would like to install lights on one or two of the existing power poles on the
East side of Teare Avenue only, the neighbors were sensitive to the current site lighting
on Lots 2 and 3.
6. This issue will be addressed per ACRD requirements during the development of Lot 1.

1. With the direction and help of the City the Owner desires to clear up the previous lot
split situation by pig this property.
2. At the time of the development of Lots 2 and 3, Teare Avenue was concidered the street
side yard. With this proposal it appears that Teare Avenue will be concidered the front
yard. The owner seeks approval of the preliminary plat with the setbacks as they exist.
3. To the best of the owners knowledge and documentation of the ordinance this property
is I -L zoned and assumes the City will clear up the zoning issues with the County. So
noted, Subdivision name.
4. The owner will attempt to create a landscape setback as wide as possible on Lot 1,
to best fit the size, configuration and potential site layout of said Lot 1.
5. The owner will dedicate 5 feet along Overland Road as required by Ada County Highway
District.

Facts and Findings:

A. The Ada County Highway District (ACHD) staff has reviewed the above referenced
application requesting preliminary plat approval to construct a 3 -lot commercial subdivision.
The 5.26 -acre site is located on the north side of Overland Road approximately 2/3 mile east of
Meridian Road, abutting Teare Avenue. This development is estimated to generate 510
additional vehicle trips per day based on the Institute of Transportation Engineers Trip
Generation manual.
B. The applicant has not proposed any access to Overland Road with this application. There is an
existing street, Goldsmith Place, on the south side of Overland Road located 145 -feet east of
the site's western boundary. District policy requires 220 -feet of separation between an
uncontrolled intersection and a driveway for full access and 150 -feet of separation for a right-
in/right-out driveway on collector streets. There is no location on this site to locate a driveway
on Overland Road and meet District policy's driveway separation.
C. The application and site plan received by the City of Meridian and submitted to the District on
December 19, 1997, have been reviewed by the ACHD Planning and Development staff and
conforms to applicable District standards/policy, or can be made to conform with the change(s)
to the plan described in the requirements stated below.
This is a staff level approval and will not be heard by the ACHD Commission unless the site
plan is changed in such a manner as to not conform with District standards/policy or an appeal
of the Development Services staff decision is submitted as described within the Standard
Requirements outlined below.
The following Site Specific Requirements and Standard Requirements must be met or provided
for prior to submitting the final plat for approval by the District:

Site Specific Requirements:
1.
Dedicate 45 -feet of right-of-way from the centerline of Overland Road abutting the parcel by
means of recordation of a final subdivision plat or execution of a warranty deed prior t
issuance of a building permit (or other required permits), whichever occurs first. The owner
will be compensated for this additional right-of-way from available impact fee revenues in this
benefit zone. If the owner wishes to be paid for the additional right-of-way, the owner must
submit a letter of application to the impact fee administrator prior to breaking ground, i
accordance with Section 15 of ACHD Ordinance #188.
2. Construct a 5 -foot wide concrete sidewalk located 2 -feet within the new right-of-way
Overland Road abutting the parcel.
3. Construct' curb, gutter, 5 -foot wide concrete sidewalk and match paving on Teare Aven e
abutting the parcel including missing sidewalk at the northeast corner of Lot 3 of Block 1.
Improvements shall be constructed to one half of a 41 -foot street section.
4. Utility street cuts in new pavement less than five years old is not allowed unless approv d in
writing by the District. Contact Construction Services at 387-6280 (with file number) for
details.
5. Construct a 24 to 30 -foot curb cut driveway on Teare Avenue located a minimum of 50 feet
north of Overland Road. Pave the driveway its full required width to at least 30 -feet be and
the edge of pavement of Teare Avenue.
6. Submit to ACHD plans for all the existing and proposed pedestrian ramps on Teare Avenue for
review and approval by District staff. Some pedestrian ramps may need to be reconstructed.
7. As required by District policy, restrictions on the width, number and locations of drive ays,
shall be placed on future development of this parcel.
8. Provide a recorded cross access easement for the parcel to the west (abutting proposed Lot 1
Block 1) to use this parcel for access to the public streets prior to issuance of a building perr
(or other required permits). The District intends to require a similar agreement of the o nel
of the parcel to the west if they are the subject of a future development application.
9. Direct lot or parcel access to Overland Road is prohibited. Lot access restrictions shall
noted on the final plat.

Standard Requirements:
1. This decision of the Planning and Development Supervisor may be appealed to the Ada County
Highway District Commission by the applicant or by another party within 15 calendar clays
from the date of this report. The request shall specifically identi each requirement to be
substantial hardship or inequity. The request will be heard by the District Commission at an
evening meeting within 20 calendar days of the District's receipt of the appeal letter. he
appellant will be notified of the date and time of the Commission meeting.
2. After ACHD Commission action, any request for reconsideration of the Commission's ctioi
shall be made in writing to the Planning and Development Supervisor within two days of the
action and shall include a minimum fee of $110.00. The re uest for reconsideration shaJl
data that was not available to the Commission at the time of it's original decision. The request
for reconsideration will be heard by the District Commission at the next regular meeting of the
Commission. If the Commission agrees to reconsider the action, the applicant will be notified
of the date and time of the Commission meeting at which the reconsideration will be heard.
Payment of applicable road impact fees are required prior to building construction in
accordance with Ordinance #188, also known as Ada County Highway District Road
Fee Ordinance.
4. All design and construction shall be in accordance with the Ada County Highway D
Policy Manual, ISPWC Standards and approved supplements, Construction Services
procedures and all applicable ACHD Ordinances unless specifically waived herein.
The applicant shall submit revised plans for staff approval, prior to issuance of buildin� permit
(or other required permits), which incorporates any required design changes.
6. Construction, use and property development shall be in conformance with all of
requirements of the Ada County Highway District prior to District approval for
7. Any change by the applicant in the planned use of the property which is the subject of t is
application, shall require the applicant to comply with all rules, regulations, ordinances plans,
or other regulatory and legal restrictions in force at the time the applicant or its successors in
interest advises the Highway District of its intent to change the planned use of the subject
property unless a waiver/variance of said requirements or other legal relief is granted p irsuant
to the law in effect at the time the change in use is sought.
8. No change in the terms and conditions of this approval shall be valid unless they are in
and signed by the applicant or the applicant's authorized representative and an authoriz
representative of the Ada County Highway District. The burden shall be upon the applicant to
obtain written confirmation of any change from the Ada County Highway District.
Conclusion of Law:
1. ACED requirements are intended to assure that the proposed use/development will not
an undue burden on the existing vehicular and pedestrian transportation system within 1
vicinity impacted by the proposed development.
