Dear City Council:
On behalf of Meridian Land Development Company, L.L.C., we are requesting approval of the Final Plat
Of Thunder Creek Subdivision which occupies 6.40 acres in the SW '/4 of the NW '/4, Section 11, T.3N.,
R. IW., B.M., Meridian, Ada County, Idaho. This parcel has been used for agricultural activities for the
last 50 years:
This development proposes single-family housing in an existing R-4 zone. The property is bounded on
the north, east and south by unplatted ground and on the west by Ten Mile road. The streets through this
subdivision will be public and will connect with a future phase of the Haven Cove Development. This
subdivision will not,have direct lot access to Ten Mile road. All R-4 zone lots are 8,000 square feet or
larger.
We are not requesting any special considerations for setbacks or lot frontage requirements.
The roadways, curbs, gutters and sidewalks of this development will be constructed in accordance with
Ada County Highway District's standards and Meridian's city ordinance. All sidewalks will be five feet
wide.
The proposed use is in conformance with Meridian's Comprehensive Plan and complies with Meridian's
ordinances.
There are no existing wells and septic systems in this development. The houses in this development will
be connected to Meridian's sewer and water systems. All lots will have access to a pressurized irrigation
system. The irrigation system will be owned and maintained by the Nampa & Meridian Irrigation
District.
The Final Plat includes all appropriate easements. Street names are in accordance with the City's grid
system.

Re: Thunder Creek Subdivision
Dear Councilmen:
I have reviewed the final plat for Thunder Creek Subdivison and find that it includes approximately 20
homes assuming a median value of $110,000. We also find that this development is located in census
tract 103.10 and in the attendance zone for Chaparral Elementary School, Meridian Middle School and
Meridian High School.
Using the above information we can predict that these homes, when completed, will house 7 elementary
aged children, 6 middle school aged children, and 7 senior high aged students. This development will
cause additional overcrowding in all three schools. The cost per student for newly constructed schools,
excluding site purchase price and offsite improvements, exceeds $5,000 per elementary student and
$10,000 per middle or high school student.
Even though we are in a difficult position and need your help in dealing with the impact of growth on
schools, we will approve this subdivision.

Final Plat by Meridian Land Development Company, LLC
I have reviewed this submittal and offer the following comments, as conditions of the
application. These conditions shall be considered in full, unless expressly modified or deleted
by motion of the Meridian City Council:
GENERAL COMMENTS
1. Any existing irrigation/drainage ditches crossing the property to be included in this project,
shall be tiled per City Ordinance 11-9-605.M. Plans will need to be approved by the
appropriate irrigation/drainage district, or lateral users association, with written confirmation
of said, approval submitted to the Public Works Department.
2. Any existing domestic wells and/or septic systems within this project will have to be removed
from their domestic service per City Ordinance Section 5-7-517. Wells may be used for non-
domestic
ondomestic purposes such as landscape irrigation.
3. Submit a plan approval letter to the Public Works Department from the entity having
jurisdiction over design and construction of the pressurized irrigation system. A letter of
credit or cash will be required for this improvements prior to signature on the final plat.
4. Provide five -foot -wide sidewalks in accordance with City Ordinance Section 11-9-606.B.
5. Please submit a copy of the Ada County Street Name Committee's final approval letter for
the subdivision name, lot and block number, and street names. Make any corrections
necessary to conform.
6. Coordinate fire hydrant placement with the Meridian Public Works Department.
7. Please respond to the City Clerk's office, in written form, to all items contained in this
memorandum, by 5:00 p.m. Tuesday, August 4, 1998.

SITE SPECIFIC COMMENTS
1. Sanitary sewer service to this site shall be via an extension of the existing main line in N. Ten
Mile Rd. Subdivision designer to coordinate main sizing and routing with the Public Works
Department. Sewer manholes are to be provided to keep the sewer lines on the south and
west sides of centerline.
2. Water service to this site shall be via an extension of the existing main line in N. Ten Mile Rd.
Applicant will be responsible to construct the water mains to and through this proposed
development. Subdivision designer to coordinate main sizing and routing with the Public
Works Department.
3. Any proposal for a supplementary connection from the City's water system will need to be
reviewed closely due to the size of the area to be watered. The developer shall be responsible
for the payment of assessment fees for the common areas.
4. Two -hundred -fifty -watt and/or one -hundred -watt, high-pressure sodium streetlights will be
required at locations designated by the Public Works Department. All streetlights shall be
installed at subdivider's expense. Typical locations are at street intersections and/or fire
hydrants.
S. Construct six -foot -high, permanent, non-combustible perimeter fencing except where the City
has expressly agreed, in writing, that such fencing is not necessary. Fencing is to be in place
prior to applying for building permits. Fencing shall be set at the existing easement line of the
Eight Mile Lateral, unless an encroachment agreement is granted by the Nampa -Meridian
Irrigation District and/or Bureau of Reclamation.
6. A temporary turnaround shall be required at the southerly end of W. Gray Cloud Way. The
turnaround shown needs to meet the requirements of the Meridian Fire Department. Provide
written approval from the Meridian Fire Department for the configuration shown on Lot 8,
Block 3. As shown by note, this lot will be non -buildable until the roadway is extended in
the future.
7. Determine the "normal high groundwater" elevation, and submit a profile of the subsurface
soil conditions, as prepared by a soil scientist. This information shall be required prior to
approval of the development plans. Special attention should be given to the design of the
storm drainage system within this development, due to the suspected shallow depth to the
ground water in this vicinity. The design elevation of the street centerline shall be a minimum
of 3' above the established normal high ground water elevation.
8. All street signs, road base, street lights, pressurized irrigation system, domestic water system
(activated fire hydrants), and fencing are to be installed prior to obtaining building permits.

9. Provide a detailed landscape plan of the planting strip on N. Tem Mile Road, along with
details of the stormwater retention pond, for review and approval prior to signature on the
final plat. A letter of credit/cash will be required for these improvements prior to signature
on the final plat. Careful consideration needs to be paid to the design of the stormwater
retention pond to ensure it is aesthetically pleasing and does not become a public nuisance
problem.
10. Proposed restrictive covenants were submitted with the preliminary plat in March of this year.
It is unknown if legal counsel has reviewed these covenants. The covenants need to be
reviewed and approved by the Meridian City Council prior to signature on the final plat.
11. A development agreement was required as a condition of annexation of this property. The
Applicant shall submit a proposed development agreement for review of the City Attorney
and approval of the City Council, with recordation to be complete prior to signature on the
final plat. Add a note that the lots within the subdivision are subject to the terms of the
development agreement, including the instrument number.
12. A right-of-way dedication of 48 feet is required on N. Ten Mile Road. This will reduce the
required 20 -foot -wide planting strip to 17 feet. Lots should be shifted to meet the 20 -foot
minimum and still maintain 8,000 -square -foot lots.
13. As Ten Mile Road is not on ACHD's Five -Year Plan, staff requests that sidewalk be
constructed at this time.
14. Please revise the following notes:

Dear Commissioners:
The Nampa & Meridian Irrigation District's Eightmile Lateral courses along the northeast
boundary of the project. The right-of-way of the Eightmile Lateral is 60 feet; 30 feet from the
center each way. See Idaho Code 42 -1208 --RIGHTS-OF-WAY NOT SUBJECT TO ADVERSE
POSSESSION. The developer must contact John P. Anderson or Bill Henson at 466-0663 for
approval before any encroachment or change of right-of-way occurs.
The Nampa & Meridian Irrigation District requires a Land Use Change/Site Development
application be filed for review prior to final platting. All laterals and waste ways must be
protected. All municipal surface drainage must be retained on site. If any surface drainage
leaves the site, the Nampa & Meridian Irrigation District must review drainage plans. Contact
Donna Moore at 466-7861 for further information.
The developer must comply with Idaho Code 31-3805. It is recommended that irrigation water
be made available to all developments within the Nampa & Meridian Irrigation District.

Eddy: I had three belief systems coming in here today. One being death, one
being taxes, and the third being city council able to go through ten items in an
hour. So I apologize for being late and I appreciate the opportunity to present
this project to you. Staff should have received our comments today concerning
responses to their general comments and site specific comments. We are in
agreement with all the conditions. The project is unchanged from the preliminary
plat that was presented before you several months ago, and I'll entertain any
questions that you might have.
Corrie: Staff. Gary, do you have any comments?
Smith: Mr. Mayor and council members, I don't believe I have any comments on
the project. We did receive their comments concerning our comments and I don't
see a problem with their response.

Donesley: Thank you Mr. Mayor and Council. To prove I came for the duration I
brought the only book when I was on my way out, and it's a biography of
Napoleon Bonaparte. I figured to spend a few hours tonight indulging myself.
Thank you for a few moments. This liquor license application is in the same form
that one that the council approved two weeks ago. It involves different parties
with respect to the licensee. The same party with respect to Mr. Alidjani and the
127 Club. You may recall that the Frontier Club license on behalf of David and
Eric Sandquist was before you. This is precisely the same arrangement. The
background on this is that Barbara and Wesley Rhoades who live in McCall have
been on that waiting list and have now been authorized by the state and the
county for issuance of a liquor license hence this visit before the council. This is
proposed to go into the 127 Club. The 127 Club will be inactive for some period
of time, at least six months after which time, well this license will transfer to a
restaurant yet to be built in and about Meridian. This is an Applebee's Family
Bar and Grill. You may be familiar with them. They just opened by the mail in
Boise. They have stores now in Idaho Falls, Pocatello, Twin Falls and they are
about to buy one in Coeurd'Alene. As a matter of fact, there will be 23
purchased in the northwest by the folks who are behind this. RCI Idaho LLC, this
organization owns over 200 of these restaurants. They are a franchise and they
are very successful, and responsible citizens in these communities that they go
into. Basically we have an arrangement with Mr. Alidjani whereby we have
leased from his the 127 Club on behalf of Wes and Barbara Rhoades.

last month. That's why it's a little late, but if Findings are prepared, it could be
acted on for the August 18th, but I have no problem with the variance.
Bentley: I have a question for Becky. The Chief brought up the fire hydrants.
They are all in place?
Bowcutt: Yes, we meet all the hydrant requirements with a hydrant what — every
four or five hundred feet. Yes. I don't see any circulation problems.
Corrie: Any further discussion or questions? Hearing none, I'll close the public
hearing and entertain a motion from the council.
Bentley: I would move to instruct the city attorney to provide the Findings of Fact
and Conclusions of Law for the variance.
Bird: Second.
Corrie: Motion by Mr. Bentley and second by Mr. Bird to instruct the attorney to
prepare the Findings of Fact and Conclusions of Law.
Bentley: Is that feasible for the 18th.
Corrie: For August 18th. Any discussion? Hearing none, roll call vote.

ITEM NO. 11: REQUEST FOR FINAL PLAT FOR THUNDER CREEK
SUBDIVSION BY MERIDIAN LAND DEVELOPMENT, LLC — NORTH OF PINE
AND EAST OF TEN MILE.
Corrie: Is the representative of that final plat Thunder Creek here tonight? Okay.
Council we have a request for final plat. Is there any questions from staff?
Rountree: Well my position would be until the applicant is here to present the
final plat that we consider tabling this and have staff instruct them that they
should be present at the next meeting.
Bird: I would agree with that Charlie.
Rountree: Mr. Mayor, I move that we table item eleven the final plat for Thunder
Creek Subdivision until our next regularly scheduled meeting August 18th and
have staff notify the applicant that they will be on the agenda at that time.

Corrie: Motion made by Mr. Rountree and second by Mr. Bird to table the final
plat of Thunder Creek Subdivision until August 18`x' and the subjects to be

ITEM NO. 12: REQUEST FOR COOPERATIVE AGREEMENT FOR SEWER
AND WATER LINE MAIN EXTENSIONS AT LOS ALAMITOS AND SALMON
RAPIDS BY FARWEST DEVELOPERS.
Corrie: Is there a representative from Los Alamitos and Salmon Rapids here
tonight? Probably not. Cooperative agreement —
Smith: Mr. Mayor and Council members, this is a request by the applicant for
late comer fees to help pay for over sizing lines that he installed to extend from
previous limits of our services to and through his subdivision. It would be in
accord with the ordinance that's available for a cooperative agreement. We
would bring the written agreement back to you for official approval, of course and
signature by the Mayor and City Clerk based on analysis of the service area and
the over sizing costs for the lines. Thank you.
Corrie: Any further discussion or questions?
Rountree: I have another question for Gary. When would that be brought back
us depending on our action?
Smith: I would say conservatively we could have it back by the September 1"
meeting.
Rountree: We don't have to put you on the spot, but just to get an idea.
Corrie: If you wanted to, you could table it and bring it back on if you want to but
if you want a date certain, you can do that too.
Rountree: Mr. Mayor I move that (End of Tape)
Rountree: Mr. Mayor I move that the city work with the applicant Farwest
Developers to develop a cooperative agreement for the sewer line extension and
further that the city staff analyze the impact on our infrastructure prior to bringing
that back to council at a regularly scheduled council meeting.
