HAMILTON, HAS MADE A WRITTEN REQUEST FOR REZONE OF THE ZONING CLASSIFICATION FOR REAL PROPERTY LOCATED AT 1225 MAIN STREET, MERIDIAN, IDAHO, AND THAT LIES WITHIN THE BOUNDARIES OF THE CITY OF MERIDIAN FROM R-15 (MEDIUM HIGH DENSITY RESIDENTIAL DISTRICT) ZONING DISTRICT TO O-T (OLD TOWN DISTRICT) AS DEFINED UNDER MERIDIAN CITY CODE SECTION 11-7-2 L, REPEALING ALL ORDINANCES, RESOLUTIONS ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH; AND DIRECTING THE CITY ENGINEER TO ADD SAID REZONING DESIGNATION TO THE OFFICIAL MAPS OF THE CITY OF MERIDIAN, IDAHO. BE IT ORDAINED BY THE MAYOR AND THE COUNCIL OF THE CITY OF MERIDIAN, COUNTY OF ADA, STATE OF IDAHO: SECTION 1. FINDINGS: The owner of the following described property has made a written request for a re-zone of the zoning classification for the subject Real Property herein described from R-15 (Medium High Density Residential) District to O-T (Old Town) District as defined under Meridian City Code § 11-7-2 L; and STRICKLAND SUBDIVISION The South 83.00 feet to the North '/z of Block 2 of F.A. Nourse's Third Addition, located in the Northwest'/ of Section 7, T.3N., R.lE., B.M., Ada County, Idaho, as same is recorded in Book 7 of plats at Page 299, STRICKLAND SUBDIVISION (O-T) RZ-03-012 / RE-ZONE ORDINANCE PAGE 1 OF 4 records of Ada County, Idaho, more particularly described as follows: Commencing at the Northwest corner of said Section 7, from which the '/4 corner common to Section 12 of T.3N., R.lE., and said Section 7 bears South 00°23'21" West, 2652.11 feet; Thence South 00°23'21" West, 1507.93 feet; thence North 89°35'34" East, 40.00 feet to the Southwest corner of the North '/z of said Block 2 and the REAL POINT OF BEGINNING. Thence North 00°23'21" East, 83.00 feet; Thence North 89°35'36" East, 444.96 feet to a point on the West right-of- way ofMain Street (formerly E. First Street); Thence along said right-of--way South 00°32'24" West, 83.00 feet to the Southeast corner of the North 'h of said Block 2; Thence South 89°35'34" West, 444.74 feet to the Point of Beginning. Containing 0.85 acre, more or less. 2. The City of Meridian Planning and Zoning Commission and City Council having given notice and conducted all public hearings in accordance with law and having issued its findings of fact and conclusions of law and Decision and Order granting the application for rezone and which conditions and requirements Applicant shall comply; and 3. The real property which is the subject of this ordinance is legally described in Section 1.1. on page 1 and 2 of this Ordinance. SECTION 2. That the above-described Property be, and the same is hereby re-zoned and designed (O-T) Old Town District. SECTION 3. That the City Engineer is hereby direct to alter all use and area maps as well as the official zoning maps depicting the City of Meridian land use zones in accordance with this ordinance. STRICKLAND SUBDIVISION (O-T) RZ-03-012 / RE-ZONE ORDINANCE PAGE 2 OF 4 SECTION 4: All ordinances, resolutions; orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. SECTION 5. This ordinance shall be in full force and effect from and after its passage, approval and publication, according to law.
