I was out of town last week without access to the information required to respond with greater clarity on our
two specific concerns; so I would like to do so in advance of the Council's consideration of our request for
continuance at tomorrow evening's meeting.
First - Preliminary plat Condition 1.1.1.b states that the "applicant shall dedicate an additiona130 feet of
right-of--way (70 feet total) as proposed on the plat and as requested by ITD for Chinden Boulevard (SH
20/26)." We did not pick up the distinction between the "preservation" language of the staff analysis on page
4 ("boxed"below) of the November 19, 2013 Council hearing staff report and the condition term "dedicate."
• "Encourage and promote the preservation and expansion of Chinden Boulevard (US 20/26) by ITD (3.03.02L).
The applicant must coordinate with ITD on the preservation of right of way (ROW) along the Chinden corridor. The total
ROW needed for this segment of corridor is 140 feet. The submitted plans depicts Lot 64, Block 1 which provides the 30-
feet of additional (70 feet total from centerline) ROW.
The final plat preserves the required additional 30 feet of future right-of-way as Lot 77, Block 1(see
attached final plat) in accordance with ITD's requirement but does not "dedicate" it to ITD. It is,
therefore, available for acquisition by ITD in the future when Chinden is widened.
o Requested condition 1.1.1.b modification: Replace the word "dedicate" with "preserve."
Second -Preliminary plat Condition 1.1.2.c concerning "shoulder" improvements does not take into account
the existing condition of Chinden along the frontage platted and improved with Jayker No. 1.
The second attachment shows the gravel shoulder along the 1319-foot Jayker No. 1 frontage and the
proposed 739-foot frontage of Spurwing Orchard No. 3. We believe that the conditioned "lawn or
vegetative ground cover" along the Spurwing Orchard No. 3 frontage will present a maintenance
challenge as compared to the adjacent gravel shoulder.
o Requested condition 1.1.2.c modification: Deleted the requirement for any shoulder
improvement except gravel.
As noted in my prior message, we have along-standing hearing conflict tomorrow evening and will not be able
to attend the Meridian City Council meeting, thus, the need to continue this matter.

E. Broadway Avenue, beginning at 6:00 pm. Please call or a-mail with any questions.

3:00 pm the Thursday prior to the meeting.

consent agenda items are passed in one motion by the Council at the beginning of the meeting. Note: If
you are in agreement with the staff report, it is still recommended you attend the meeting in the
event the item is pulled off of the consent agenda.
If you do not respond to the staff report by Thursday, or if you have concerns with the conditions of
approval, your project will be placed on the regular agenda.
