Development Agreement Modification Application
Dear Mr. Parsons:
On behalf of SanC Investments LLC, we are submitting an application for the modifica#ion of a
Developmen# Agreement between the City of Meridian and the Kennedy Commercial Center.
The subject property is located on West Overland Road, to the west of the University of Phoenix
campus.
Our client recently purchased property in the Kennedy Commercial Center; SanC Investments
LLC was not involved with the original Development Agreement for the property. The existing
Development Agreement was approved on October 16, 2008 and recorded on October 31, 2008
(instrument no, 108119853.)
Following is a brief overview of our proposed project and our application materials:
Proposed Modification of Development Agreement
The existing Development Agreement for Kennedy Commercial Center restricts the property to
commercial uses and is substantially more restrictive than the underlying CG zoning for the
subject property. After modification of the Development Agreement, our client intends to submit
a Master Site Plan Application proposing multi-family housing and office /retail uses for the
property; all proposed uses will be allowable under the CG zoning designation.
Meridian staff has recommended that the simplest approach to modifying the Kennedy
Commercial Center Development Agreement is to request that the SanC Investments property
be removed from the Development Agreement. Anew Development Agreement will be created
with the Master Site Plan approval for the proposed project.
Compatibility with Surrounding Land Uses
The subject property is located in an area which consists of primarily commercial uses. The
proposed uses are compatible with the underlying CG zoning designation and the

Comprehensive Plan designations for the area. A neighborhood meeting was recently held far
the proposed Development Agreement Modification; no concerns were expressed by neighbors
at the meeting,
A conceptual site plan and conceptual building elevations are attached. The conceptual
elevations are examples of projects which have been recently completed by the developer in
Utah. The developer's RiverWalk multi-family project in Midvale, Utah recently won the award
of Utah's Mufti-Family Project of the Year. 190 units with 104 attached garages are proposed
for the property along with Class A office and retail.

Per Unified Development Code (UDC) 11-SA-SD, the applicant for all applications requiring a
public hearing (except for a UDC text amendment, a Comprehensive Plaza text amendment
and/or vacations) shall post the subject property not less than ten (10) days prlox to the hearing.
