ZEBULON COMMONS SUBDIVISION
NARRATIVE
On behalf of The Traditions by Amyx II, LLP, we hereby apply for a final plat for 38 single-family
residential lots and four common lots on 13.65 acres in an R-8 zone. The property is located west of
N. Eagle Road and north of E. Wainwright Drive. The subject site is zoned R-8 (Medium Density
Residential) and was annexed in 2006 as the Milford Creels development (AZ -05-047 and PP -05-
050). The project was originally annexed under Ordinance 05-1208, and no development agreement
was required for the project.
The final plat is in conformance with the approved preliminary plat and meets all requirements or
conditions thereof. The final plat conforms with all requirements and provisions of the UDC and was
prepared in conformance with acceptable engineering, architectural and surveying practices and local
standards. The proposed minimum lot size is 9,000 square feet, with an average lot size of 10,846
square feet. The gross density of this project is 2.80 dwelling units per acre (du/acre), and the net
density is 3.44 dwelling units per acre.
The original developer of the project encountered financial difficulties. The existing home was
illegally divided from the parent parcel and was sold in 2007. The parent parcel, excluding the
home, was foreclosed upon by a bank and the property was acquired by Todd Amyx, the developer
of the adjoining Zebulon Heights and Village Subdivisions (Alpine Pointe). The existing home,
constructed in 1976, has changed ownership multiple times. The home is currently owned by Mark
Thompson and has been included in the preliminary and final plats to rectify the illegal division of
the property.
The project includes 4 common lots totaling 2.5 acres, or 12.09 percent of eligible open space. The
primary open space of 1.05 acres is located in the center of the project. The proposed amenities
include a pathway in the central park and playground equipment. The project will be integrated into
the Alpine Pointe Homeowners Association (Zebulon Heights Subdivision). Recreational
opportunities will be shared between the subdivisions with access to the pool facility for all residents.
The project will take primary access to Wainwright Drive, which is designated as a collector
roadway east of this project. The intersection of Wainwright Drive and Eagle Road was signalized in
July 2013. The applicant is proposing detached sidewalks with six-foot landscape buffers. The trees
within the landscaped parkway will have root barriers consistent with ACRD standards. Sewer and
water will be extended into the site via the existing Zebulon Heights Subdivision. The development
will connect to the existing pressure irrigation pump station located in Zebulon Heights Subdivision.
The proposed secondary source for the pressure irrigation system will be provided by United Water.
The Settlers Canal abuts the north boundary of the subject property. A waiver was granted for the
piping requirement for the Settlers Canal. No pathway opportunities are available along this section
of the Settlers Canal. No variances are being requested as part of this development.
Alternative Compliance - The applicant is seeking relief from UDC 11-3B-7C.2.a to not provide the
street buffer on Lot 4, Block 4 (the existing home) along Wainwright Drive. The City Council
specified in their motion that, due to unique circumstances, a street buffer along E. Wainwright Drive
on Lot 4, Block 4, is not required and the existing fencing adjacent to the roadway may remain.
