He also stated his preference for residential uses and that a carwash is not needed in this area of the city. • Other key points of discussion included the width and location of the driveways serving the carwash/fueUcoffee kiosk lot, the landscape buffer on the east boundary, the proposed striping of landscape islands and a potential bike lane on Venable Ln. Key Commission Changes to Staff Recommendation: • Remove the requirement for a bike lane on Venable Lane and the requirement for a fencing plan. • Add a condition to the PP that a new, 25-foot wide cross access easement be shown on the plat to the outparcel to the east. Outstanding Issues for City Council: • None BEFORE THE PLANNING AND ZONING COMMISSION IN THE MATTER OF THE ) Case No. RZ-03-013 REQUEST FOR REZONE OF 5.51 ) ACRES FROM R-4 TO C-N ZONE ) RECOMMENDATION TO CITY FOR CEDAR SPRINGS ) COUNCIL PROFESSIONAL CENTER ) Kevin Howell, Applicant ) The property is approximately 5.5 acres in size and is generally located at the northeast comer of Ustick Road and Venable Lane. The property is designated as Mixed Use-Community with a Neighborhood Center on the Future Land Use Map of the 2002 Comprehensive Plan. 2. The owner of record of the subject property is Howell-Murdoch Development Corp. 3. Applicant is Kevin Howell. 4. The subject property is currently zoned R-4 (Low Density Residential) and is proposed to be zoned C-N (Neighborhood Business District) and consists of vacant land. 5. The subject property is surrounded by the following properties and uses: North - A 12-acre site designated as a future elementary school and Cedar Springs Subdivision, zoned R-4. South -15-acre parcel with a single family dwelling, zoned RUT (Ada County). East -1.4 acre parcel with a single family dwelling, zoned RUT, and Meridian Settlers Pazk, zoned L-O. West - A 1.3-acre, undeveloped parcel and a 8.4-acre parcel with a single family dwelling, zoned RUT. 6. The property which is the subject of this application is within the Area of Impact of the City of Meridian. 7. The entire property is included within the Meridian Urban Service Planning Area as defined in the Meridian Comprehensive Plan. 8. The Applicant proposes to develop the subject property in the following manner: a five (5) lot commercial subdivision including four (4) office buildings, caz wash, two fuel pumps and adrive-through coffee stand. RECOMMENDATION TO CITY COUNCIL FOR APPROVAL OF REZONE FOR CEDAR SPRINGS PROFESSIONAL CENTER BY KEVIN HOWELL - RZ-03-013 -Page 1 9. The Applicant requests zoning of the subject real property as C-N, which is consistent with the Meridian Comprehensive Plan Future Land Use Map which designates the subject property as Mixed Use-Community. 11. There are no scenic features that affect the consideration of this application. 12. The Planning and Zoning Commission recognized the concerns of Mr. Joe Siminich expressed as verbal testimony at the 2-5-04 public hearing. RECOMMENDATION The Meridian Planning and Zoning Commission hereby recommends to the City Council of the City of Meridian that they approve the Rezone as requested by the applicant for the property described in the application, subject to the following: A. Adopt the Recommendations of the Meridian Planning & Zoning Department as follows: 1. The legal description submitted with the application meets the requirements of the City of Meridian and State Tax Commission. 2. The subject property is within the Urban Service Planning Area. Essential City services will be made available to the subject property. 3. Prior to the rezone ordinance approval, an Addendum to the recorded Development Agreement (DA) shall be entered into between the City of Meridian and the property owner. Specifically, Section 4.1 on page 4 of the DA (Instrument No. 102067381) shall be modified to allow a carwash, coffee stand/kiosk, fuel pumps and office uses. If other retail uses are anticipated in the future, this should be included in the Addendum to avoid future amendments, etc. 4. Any existing domestic wells and/or septic systems within this project will have to be removed from their domesfic service, per City Ordinance Section 5-7-517, when services are available from the City of Meridian. Wells may be used for non-domestic purposes such as landscape irrigation.
