Corrie: Item No. 9 is Ordinance No. 02-946. This is a request for a rezone from R-8 to
L-O zone for Meridian Water Department by Meridian Water Department, 2235
Northwest 8th Street. Mr. Clerk, if you will read Ordinance No. 946 by Title only at this
point.
Berg: Thank you, Mr. Mayor, Members of the Council. Ordinance No. 02-946, an
Ordinance finding that the owner, City of Meridian, for certain real property has made a
written request for rezone of the zoning classification for real property that lies within the
boundaries of the City of Meridian from R-8 (Medium Density Residential District)
Zoning District to L-O (Limited Office District) as defined under Meridian City Code
Section 11-7-2 G, repealing all ordinances, resolutions, orders or parts thereof in conflict
herewith; and directing the city engineer to add said rezoning designation to the official
maps of the City of Meridian, Idaho.
Corrie: Okay. You have heard the reading of Ordinance No. 946 by Title only. Is there
anyone from the public that would like to have it read in its entirety? Hearing none, I'll
entertain a motion by Council on Ordinance No. 946.

Campus. At this point I will open the Public Hearing on Items 10, 11, and 12. Item 10
being the request annexation and zoning of 85.36 acres from RUT to a C-C and C-G
zones for proposed EI Dorado Subdivision by W. H. Moore Company. Public Hearing on
request for Preliminary Plat approval of 32 building lots and 17 other lots +/- on 85.36
acres by EI Dorado Business Campus. And also open the Public Hearing on the request
for a Conditional Use Permit for mixed use with office, retail, restaurant and hotel/motel
for proposed EI Dorado Business Campus by W.H. Moore, southwest corner of East
Overland Road and South Eagle Road. So with that being said, the Public Hearing
being open, I'll entertain -- or ask the staff to give comments first and then we will have
the developer's comments. After the developer's comments we will have any public
comments for or against it and then the developer will have the last of the Public
Hearing. Mrs. Stiles.
Stiles: Mr. Mayor and Council, this is for approximately 85 acres of property located at
the southwest corner of Eagle Road and Overland Road. It is directly west of
Silverstone Subdivision being developed by the Sundance Company. They are -- to the
south is the Thousand Springs Subdivision and then there is vacant land that is
currently owned by other developers ready to come in. As part of the Thousand Springs

Corrie: I want to thank all of you for being here this cool evening. I think it's
cooler in here than it is outside. Again, thank you for being here tonight. Item
No. 2 is adoption of the agenda. Are there any questions on the agenda?

Bird: We'll take them as we come to them I believe won't we? I would move that

the request for Preliminary Plat.

Corrie: Item No. 18 is a continued Public Hearing from June the 5th. Request for
rezone from R-8 to L-O zone for Meridian Water Department by the Meridian
Water Department 2235 Northwest Eighth Street. At this time I will open the
continued Public Hearing. Staff, comments.
Stiles: Mr. Mayor and Council. This is for the property that currently houses the
water department. They desire to make some changes to the interior of the
building and wanted to make sure they are in compliance with our ordinances. It
is currently in an R-8 zone, which does not permit the use. So, John Shawcroft of
the sewer department requested that we get the paperwork together to make that
an L-O zone so they would be compliant with our ordinances. We would
recommend approval.
Anderson: Mr. Mayor.
Bird: Who's representing the developer? Brad, or Gary?
Stiles: Brad.
Anderson: Mr. Mayor.
Corrie: Mr. Anderson.
Anderson: I just have one question Shari? When are they going to start this
project?
Stiles: Which one? The interior remodel?
Anderson: Yeah, that one.
Stiles: I believe that the public works director informed me that that might have
already been occurring out there.
Corrie: Thank you.
Stiles: Unbeknownst to the Planning and Zoning Department.
Bird: How about the City Engineer, Brad?
De Weerd: Yeah, didn't they get a permit?
Stiles: They did not receive a certificate of zoning compliance.

Corrie: I assume that the applicant has spoken then?
Bird: He's hanging his head.
Corrie: Is there anyone from the public like to issue testimony on this very
serious development that has come before the City Council tonight? Hearing
none, I hope the Council's wise in making their decision correctly here.

Corrie: Item No. 22 is a request for annexation and zoning Bridgetower Crossing
Subdivision AZ 01-003. At this point I'll open the Public Hearing and entertain a
motion to continue the Public Hearing. Do we still need to see if anybody wants
to talk? It's a formality but -
Bird: Go ahead.
Corrie: Mr. Bird.
Bird: Mr. Mayor. I move that we continue the Public Hearing on the request for
annexation and zoning of 371.42 acres from RUT to R-4 and C-G zone for
proposed Bridgetower Crossing Subdivision to -

Corrie: Shari, did Bridgetower ask for an extension?
Stiles: Yes. They did. I thought maybe -your packets. Since the -
Bird: Oh, yeah. That's right. Yeah, they did.
Stiles: Since the Conditional Use and the plat aren't up until the 19th but now
we're going to have a problem even with the 19th because the planned
development ordinance isn't going to be until the 26th. So, I guess it can still be
continued and heard on the 19th but you couldn't act on the plat or the conditional
use.

Borup: I would entertain a motion to accept the application - or the letter of
withdrawal for the CUP 01-012. Do we have a motion to that effect? Just for
clarification we do have a letter requesting that.
Shreeve: So noted. I move as noted there.
Borup: All in favor?
Centers: And they don't even want to come back right?
Borup: Well I don't know if we're going to get through this next one should we
continue it?
Centers: But Item 14 doesn't want to come back correct?
Shreeve: Yes they had a full withdraw they said they had another site.
Item 16. Public Hearing: RZ 01-004 Request for a rezone from an
R-8 to L-O zone for Meridian Water Department by
Meridian Water Department - 2235 Northwest 8th Street:
Borup: I would like to open the Public Hearing on request to rezone from R-8 to
L-0 zone for the Meridian Water Department by the Meridian Water Department.
Didn't this come up once -open the Public Hearing and start with staff report.
Didn't this come up once before and this was just kind of a housekeeping thing
that needed to be taken care of? Did it come up once before?
Siddoway: It needs to be cleaned up. The Water Department is in a R-8 zone.
They want to do a remodel and we basically told them they're at the wrong zone.
We're trying to clean up the zoning. It also happens to house the Boise State
University Electrical Lineman's Training Facility. We do note that if either the
Water Department or the BSU use ever proposes to expand they will have to
bring the site into compliance with current Landscape Ordinances which currently
does not meet those. We can - it standard to require those changes when there
is a Building Permit request which there is not at this time. We simply noted that

and we recommend approval with the conditions in the staff report dated April

Borup: I wanted to know if this was -okay thank you.
Centers: I don't have any questions.
Shreeve: Can we put Bruce on the spot?
Borup: Yes. So if we deny this does the Water Department have to move?
Freckleton: That would be one way of controlling (inaudible) Chairman.
Borup: Shut down the Water Department.
Siddoway: Actually they could stay as grand fathered use they just couldn't
remodel their building to look nicer.
Shreeve: Mr. Chairman I recommend that we close the Public Hearing of RZ
01-004.

AN ORDINANCE FINDING THAT THE OWNER, CITY OF MERIDIAN, FOR
CERTAIN REAL PROPERTY HAS MADE A WRITTEN REQUEST FOR
REZONE OF THE ZONING CLASSIFICATION FOR REAL PROPERTY THAT
LIES WITHIN THE BOUNDARIES OF THE CITY OF MERIDIAN FROM R-8
(MEDIUM DENSITY RESIDENTIAL DISTRICT) ZONING DISTRICT TO L-O
(LIMITED OFFICE DISTRICT) AS DEFINED UNDER MERIDIAN CITY
CODE ~ i1-~-2 G, REPEALING ALL ORDINANCES, RESOLUTIONS ORDERS
OR PARTS THEREOF IN CONFLICT HEREWITH; AND DIRECTING THE
CITY ENGINEER TO ADD SAID REZONING DESIGNATION TO THE
OFFICL~L MAPS OF THE CITY OF MERIDIAN, IDAHO.
BE IT ORDAINED BY THE MAYOR AND THE COUNCIL OF THE CITY
OF MERIDIAN, COUNTY OF ADA, STATE OF IDAHO:
SECTION ~. FINDINGS:
~. The owner of the following described property has made a written
request for a re-zone of the zoning classification for the subject Real
Property herein described from R-8 (Medium Density Residential)
District to L-O (Limited Office) District as defined under Meridian
City Code ~ ii-~-2 G; and
2. The City of Meridian Planning and Zoning Commission and City
Council having given notice and conducted all public hearings in
accordance with law and having issued its findings of fact and
conclusions of law and Decision and Order granting the application
for rezone and which conditions and requirements Applicant shall
comply; and

3. The real property which is the subject of this ordinance is legally
described as follows:
A parcel located in the SW 1/4 of Section 1, Township 3 North, Range i West, Boise
Meridian, Ada County, Idaho, more particularly described as follows:
Commencing at a 5/8 inch diameter iron pin marking the northeasterly corner of said
SW 1/a (C 1/4 corner). from which a brass cap monument marking the southeasterly
corner of said SW 1/a bears S o°24'So" E a distance of 2647.99 feet;
Thence S o°24'50" E along the easterly boundary of said SW 1/a a distance of 69.49 feet
to the POINT OF BEGINNING;
Thence continuing S o°24'So" E a distance of 589.54 feet to a point;
Thence leaving said easterly boundary S 89°39'50" W a distance of 82.81 feet to a point;
Thence N 2°27'32" W a distance of 166.45 feet to a point;
Thence N 8i°29'o5" W a distance of 76.ii feet to a point;
Thence N 42°48'io" W a distance of 88.80 feet to a point;
Thence N 34°35'20" W a distance of ii8.62 feet to a point;
Thence N o°18'i9" W a distance of 248.66 feet to a point;
Thence N 8g°48'20" E a distance of 289.96 feet to the POINT OF BEINNING.
This parcel contains 2.89 acres and is subject to any easement's existing or in use.
SECTION 2. That the above-described Property be, and the same is hereby re-
zoned and designed (L-O) Limited Office District.
SECTION 3. That the City Engineer is hereby direct to alter all use and area
maps as well as the official zoning maps depicting the City of Meridian land use zones in
accordance with this ordinance.

SECTION 4: All ordinances, resolutions, orders or parts thereof in conflict
herewith are hereby repealed, rescinded and annulled.
SECTION 5. This ordinance shall be in full force and effect from and after its
passage, approval and publication, according to law.
