BEFORE THE MERIDIAN CITY COUNCIL IN THE MATTER OF THE ) Case No. CUP -99-007 APPLICATION OF OLSON &- ) ASSOCIATES ARCHITECTS ) (HOME FEDERAL), FORA FINDINGS OF FACT AND ) CONDITIONAL USE PERMIT ) CONCLUSIONS OF LAW AND DECISION AND ORDER FOR CONSTRUCTION AND ) DEVELOPMENT OF A BANK GRANTING CONDITIONAL USE ) WITH THREE DRIVE-THRU ) PERMIT SUBJECT TO CONDITIONS LANES, SOUTHEAST CORNER ) OF FRANKLIN AND MERIDIAN ROAD, MERIDIAN, IDAHO The above entitled conditional use permit application having come before the City Council on the 1st day of June, 1999, and Shari Stiles, Planning and Zoning Administrator, having appeared and testified, and no one appeared in opposition of the application, and the City Council having received the staff report and the record made before the Planning and Zoning Commission, and being fully advised in the premises, the Council finds and concludes as follows: FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT SUBJECT TO CONDITIONS BY OLSON & ASSOCIATES ARCHITECTS (HOME FEDERAL) - I 0 FINDINGS OF FACT 1. A notice of a public hearing on the conditional use permit was published for two (2) consecutive weeks prior to the said public hearing scheduled for June 1, 1999, before the City Council, the first publication appearing and written notice having been mailed to property owners or purchasers of record within three hundred (300') feet of the external boundaries of the property under consideration more than fifteen (15) days prior to said hearing and with the notice of public hearings having been posted upon the property under consideration more than one week before said hearing and the copies of all notices were made available to newspaper, radio and television stations as public service announcements; and the matter having been duly considered by the City Council at the June 1, 1999, said public hearing; and the Applicant, affected property owners, and government subdivisions providing services within the planning jurisdiction of the City of Meridian, having been given full opportunity to express comments and submit evidence. 2. There has been compliance with all notice and hearing requirements set forth in Idaho Code §§67-6509 and 67-6512; and §§11-2-416E and 11-2-418E as evidenced by the Affidavit of Mailing, and the Affidavit of Publication and Proof of Posting filed with the staff report. 3. The property is located at the southeast corner of Franklin and Meridian FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT SUBJECT TO CONDITIONS BY OLSON & ASSOCIATES ARCHITECTS (HOME FEDERAL) - 2 Road, Meridian, Idaho. 4. The owner of record of the subject property is Earl Coryell of 97 E. 1st St., Meridian, Idaho. 5. Applicant is Home Federal of 500 12th Ave. S., Nampa, Idaho. 6. The subject property is currently zoned General Retail and Service Commercial (C -G). The zoning district of General Retail and Service Commercial (C -G) is defined within the City of Meridian Zoning and Development Ordinance, Section 11-2-408 (11). 7. The proposed application requests a conditional use permit for construction and development of a bank with three drive-thru lanes. The General Retail and Service Commercial (C -G) zoning designation within the City of Meridian Zoning and Development Ordinance requires a conditional use permit be obtained for most uses including those requested by the Applicant. (Meridian City Zoning and Development Ordinance, Section 11-2-409). 8. The use proposed within the subject application will in fact, constitute a conditional use as determined by City Policy. 9. The Meridian City Council takes judicial notice of its Zoning, Subdivision and Development Ordinances codified at Title 11, Municipal Code of the City of Meridian and all current zoning maps thereof and the Comprehensive Plan of FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT SUBJECT TO CONDITIONS BY OLSON & ASSOCIATES ARCHITECTS (HOME FEDERAL) - 3 i the City of Meridian, adopted December 21, 1993, Ord. No. 629 -Jan. 4, 1994 and Maps and the Ordinance establishing the Impact Area Boundary. 10. Giving due consideration to the comment received from the governmental subdivisions providing services in the City of Meridian planning jurisdiction public facilities and services required by the proposed development will not impose expense upon the public if the following conditions of development are imposed and the following is also found to be required to mitigate the effects of the proposed use and development upon services delivered by political subdivisions providing services to the subject real property within the planning jurisdiction of the City of Meridian: Adopt the Planning and Zoning Administrator and Assistant City Engineer Recommendations as follows: 10.1 Any existing irrigation/drainage ditches crossing or adjacent to the property shall be tiled per City Ordinance 1 1-9-605.M. The ditches to be piped should be shown on the site plans. Plans will need to be approved by the appropriate irrigation/drainage district, or lateral users' association, with written confirmation of said approval submitted to the Public Works Department. No variances have been requested for tiling of any ditches crossing this project. 10.2 Any existing domestic wells and/or septic systems within this project will have to be removed from their domestic service per City Ordinance Section 5-7-5 17. Wells may be used for non-domestic purposes such as landscape irrigation. FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT SUBJECT TO CONDITIONS BY OLSON & ASSOCIATES ARCHITECTS (HOME FEDERAL) - 4 10.3 Off-street parking shall be provided in accordance with Section 11-2-414 of the City of Meridian Zoning and Development Ordinance and/or as detailed in site-specific requirements. 10.4 Paving and striping shall be in accordance with the standards set forth in Sections 11-2-414.D.4 and 11-2-414.D.5 of the City of Meridian Zoning and Development Ordinance and in accordance with Americans with Disabilities Act (ADA) requirements. 10.5 A drainage plan designed by a State of Idaho licensed architect or engineer is required and shall be submitted to the City Engineer (Ord. 557, 10-1-91) for all off-street parking areas. All site drainage shall be contained and disposed of on-site. 10.6 Outside lighting shall be designed and placed so as not to direct illumination on any nearby residential areas and in accordance with City Ordinance Section 11-2-14.D.3. 10.7 All signage shall be in accordance with the standards set forth in Section 11-2-415 of the City of Meridian Zoning and Development Ordinance. No temporary signage or flashing signs will be permitted. 10.8 Applicants shall provide five -foot -wide sidewalks in accordance with City Ordinance Section 11-9-606.B. 10.9 All construction shall conform to the requirements of the Americans with Disabilities Act. 10.10 Applicant shall provide revised site plan detailing all existing and proposed utilities for review by the Meridian Public Works Department. Designer shall coordinate sizing and routing of sanitary sewer and water within the development with the Public Works Department. 10.11 Applicant shall provide the Public Works Department with information on anticipated fire flow and domestic water requirements for the proposed site. Flow and pressure from the existing mains shall be monitored with FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT SUBJECT TO CONDITIONS BY OLSON & ASSOCIATES ARCHITECTS (HOME FEDERAL) - 5 the Meridian Water Department to determine whether adequate fire protection exists. 10.12 Applicant shall be required to enter into an Assessment Agreement with the City of Meridian. In addition to these assessments, "Late Comers" fees may also be charged against this parcel to help reimburse the parties responsible for installing mains to their current points. 10.13 Applicant shall provide calculation of asphalt area. A minimum of one (1) three-inch (3") caliper tree per 1,500 square feet of asphalt are required per Ordinance. Austrian Pines should be a minimum of 6'-8' in height to be included as trees meeting this requirement. 10.14 Landscaping of 20 -foot -wide strip adjacent to Meridian Road shall be provided south of proposed property line as part of this development. 10.15 Coordinate locations and construction requirements of trash enclosure with Sanitary Services, Inc., and provide a letter of approval from their office prior to applying for building permits. 10.16 Applicant shall provide letter of approval from Ada County Highway District with submittal of site plan prior to issuance of Certificate of Zoning Compliance. 10.17 Applicant shall provide handicapped accessible parking spaces and associated signage in accordance with the Americans with Disabilities Act. All building and parking lot construction shall meet the requirements of the Americans with Disabilities Act. 10.18 Seventeen -foot long parking spaces shall be allowed due to overhang area provided. 10.19 Site plan shall be revised to include correct street names. Adopt the Meridian Fire Department's Recommendations as follows: 10.20 Applicants shall satisfy all fire code requirements. FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT SUBJECT TO CONDITIONS BY OLSON & ASSOCIATES ARCHITECTS (HOME FEDERAL) - 6 10.21 A fire hydrant shall be added. Adopt the Ada County Highway District's Recommendations as follows: 10.22 The applicant shall provide a minimum of 100 -feet of stacking before the teller window. 10.23 Applicant shall construct a 24 to 30 -foot wide curb return driveway on Franklin Road located approximately 200 -feet east of Meridian Road (approximately the mid -block position) with 25 -foot curb radii abutting Franklin Road. The driveway shall be paved its full width and at least 30 - feet beyond the edge of pavement of Franklin Road. This driveway may be restricted to right-in/right-out operations in the future if necessary. 10.24 The existing 30 -foot wide curb return driveway on Meridian Road located approximately 315 -feet south of Franklin Road is approved with this application. The driveway shall be paved its full width and at least 30 -feet beyond the edge of pavement of Meridian Road. 10.25 Applicant shall provide a recorded cross access easement for the parcels to the south and east to use this parcel for access to the public streets prior to issuance of a building permit (or other required permits). 10.26 Applicant shall replace unused curb cuts on Franklin Road and Meridian Road with standard curb, gutter and 5 -foot wide concrete sidewalk to match existing improvements. 10.27 Restrictions on width, number and location of driveways shall be placed on future development of this parcel. 10.28 Other than the access points specifically approved with this application, direct lot or parcel access to Franklin Road or Meridian Road is prohibited. Adopt the Nampa Sz Meridian Irrigation District Recommendations as follows: 10.29 Requires all laterals and wasteways be protected. FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT SUBJECT TO CONDITIONS BY OLSON & ASSOCIATES ARCHITECTS (HOME FEDERAL) - 7 10.30 All municipal surface drainage shall be retained on site. If any surface drainage leaves the site, the Nampa SL Meridian Irrigation District must review drainage plans. 10.31 The developer must comply with Idaho Code § 31-3805. 11. To maintain compliance with the Comprehensive Plan, the project should be designed, constructed, operated and maintained to be harmonious and appropriate in appearance with the existing and intended character of the general vicinity and that such intended conditional use will not change the essential character of the requests. CONCLUSIONS OF LAW 1. The City Council adopts as its Conclusions of Law the Recommendations 10.1 through 10.31 of the Recommendations to City Council made in the above entitled matter by the Planning and Zoning Commission which are incorporated herein by reference as if set forth at length. 2. The City of Meridian shall exercise the powers conferred upon it by the "Local Land Use Planning Act of 1975" hereinafter referred to for convenience as the "Act" codified at Chapter 65, Title 67, Idaho Code (I.C. §67-6503). 3. The Meridian Planning and Zoning Commission may exercise all the FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT SUBJECT TO CONDITIONS BY OLSON & ASSOCIATES ARCHITECTS (HOME FEDERAL) - 8 0 0 powers required and authorized under the "Act" except the power to adopt ordinances by the establishment of a Planning and Zoning Commission by ordinance pursuant to Idaho Code Section 67-6504 which the City Council of the City of Meridian has established by the passage of the "City of Meridian Zoning and Development Ordinance" at Title XI, Chapter 1, Municipal Code of the City of Meridian. 4. As part of a zoning ordinance the City Council can, subject to hearing and notice provision required, provide for the process of special and/or conditional use permits which a proposed use is otherwise prohibited by the terms of the ordinance but allowed with conditions under the specific provisions of the ordinance which the City of Meridian has done in the adoption of its zoning ordinances. 5. The City Council has the duty and responsibility to review the facts and circumstances of each application for conditional use permit to determine prior to granting the same that the evidential showing supports the finding that the following standards are met and that the proposed development: (Section 11-2-418, City of Meridian Zoning and Development Ord.): a. Will, in fact, constitute a conditional use as determined by City policy; b. Will be harmonious with and in accordance with the Comprehensive Plan and this Ordinance; FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT SUBJECT TO CONDITIONS BY OLSON & ASSOCIATES ARCHITECTS (HOME FEDERAL) - 9 0 0 Will be designed, constructed, operated and maintained to be harmonious and appropriate in appearance with the existing or intended character of the general vicinity and that such use will not change the essential character of the same area; d. Will not be hazardous or disturbing to existing or future neighboring uses; e. Will be served adequately by essential public facilities and services such as highways, streets, police and fire protection, drainage structures, refuse disposal, water, sewer or that the person responsible for the establishment of proposed conditional use shall be able to provide adequately any such services; f. Will not create excessive additional requirements at public cost for public facilities and services and will not be detrimental to the economic welfare of the community; g. Will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property or the general welfare by reason of excessive production of traffic, noise, smoke, fumes, glare or odors; h. Will have vehicular approaches to the property which shall be so designed as not to create an interference with traffic on surrounding public streets; and Will not result in the destruction, loss or damage of a natural or scenic feature of major importance. 6. Prior to granting a conditional use permit in a General Retail and Service Commercial District (C -G), a public hearing shall be conducted with notice to be published and provided to property owners or purchasers of record within three hundred feet (300') of the external boundaries of the land under consideration for the FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT SUBJECT TO CONDITIONS BY OLSON & ASSOCIATES ARCHITECTS (HOME FEDERAL) -10 conditional use permit all in accordance with the provisions of Section 11-2-418E City of Meridian Zoning and Development Ordinance, which provides as follows: "Prior to approving a Conditional Use Permit, the applicant and the Commission and Council shall follow notice and hearing procedures provided in Section 11-2-416, Zoning Amendment Procedures, of this Ordinance. Provided, however, that Conditional Use applications for land in Old Town and in Industrial and Commercial Districts shall only be required to have one public hearing which shall be held before the Planning and Zoning Commission and after the recommendation of the Commission is made the application shall go before the City Council without a public hearing and the Council may approve, deny, or modify the recommendation of the Commission." 7. Following the public hearing and within 45 days after the conclusion of the public hearing the Commission shall, transmit its recommendations to the Meridian City Council with supportive reasons. The Commission shall recommend that the application be approved, approved with conditions or denied. The Commission shall ensure that any approval or approval with conditions of an application shall be in accordance with Meridian Comprehensive Plan, City of Meridian Zoning and Development Ordinance, and Idaho State law. (Section 11-2- 418(f), City of Meridian Zoning and Development Ordinance.) 8. When the City Council approves a conditional use permit it may impose conditions of that approval that reasonably: 8.1 Minimize adverse impact on other development; 8.2 Control the sequence and timing of development; FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT SUBJECT TO CONDITIONS BY OLSON & ASSOCIATES ARCHITECTS (HOME FEDERAL) - 11 8.3 Control the duration of development; 8.4 Assure that the development is maintained property; 8.5 Designate the exact location and nature of the development; 8.6 Require the provision for on-site public facilities or services; and 8.7 Require more restrictive standards than those generally required, in this Ordinance. 9. The City of Meridian has, by ordinance, established the Impact Area and the Comprehensive Plan of the City of Meridian, which was adopted December 21, 1993, Ord. 629, January 4, 1994 and Maps. DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT SUBJECT TO CONDITIONS NOW, THEREFORE, BASED UPON THE ABOVE AND FOREGOING FINDINGS OF FACT AND CONCLUSIONS OF LAW, the City Council does hereby ORDER and this does Order that: That the above named applicant is granted a conditional use permit to use the property for the construction and development of a bank with three drive-thru lanes, subject to the following conditions of use and development: 1.1 Any existing irrigation/drainage ditches crossing or adjacent to the property shall be tiled per City Ordinance 1 1-9-605.M. The above conditions are concluded to be reasonable and the applicant shall meet such requirements as a condition of approval of the application for a conditional use permit. 4. That the City Attorney draft an Order Granting Conditional Use Permit in accordance with this Decision, which shall be signed by the Mayor and City Clerk and then a copy served by the Cleric upon the applicant, the Planning and Zoning Department, the Public Works Department and any affected party requesting notice. FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT SUBJECT TO CONDITIONS BY OLSON & ASSOCIATES ARCHITECTS (HOME FEDERAL) - 16 • NOTICE OF FINAL ACTION Please take notice that this is a final action of the governing body of the City of Meridian, pursuant to Idaho Code § 67-6521 an affected person being a person who has an interest in real property which may be adversely affected by the issuance or denial of the conditional use permit may within twenty-eight (28) days after the date of this decision and order seek a judicial review as provided by Chapter 52, Title 67, Idaho Code. The property is located at the southeast corner of Franklin and Meridian Road, Meridian, Idaho. 2. The owner of record of the subject property is Earl Coryell of 97 E. 1 st St., Meridian, Idaho. 3. Applicant is Home Federal of 500 12th Ave. S., Nampa, Idaho. 4. The subject property is currently zoned General Retail and Service Commercial (C -G). The zoning district of General Retail and Service Commercial (C -G) is defined within the City of Meridian Zoning and Development Ordinance, Section 11-2-408(11). 5. The proposed application requests a conditional use permit for construction and development of a bank with three drive-thru lanes. The General Retail and Service Commercial (C -G) zoning designation within the City of Meridian RECOMMENDATION TO CITY COUNCIL - 1 CONDITIONAL USE PERMIT - BANK WITH DRIVE-THRU LANES - HOME FEDERAL SAVINGS AND LOAN, INC. Zoning and Development Ordinance requires a conditional use permit be obtained for most uses including those requested by the Applicant. (Meridian City Zoning and Development Ordinance, Section 11-2-409). 6. The use proposed within the subject application will in fact, constitute a conditional use as determined by City Policy. RECOMMENDATION The Meridian Planning and Zoning Commission hereby recommends to the City Council of the City of Meridian that they approve the conditional use permit as requested by the applicant, subject to the following: Adopt the Planning and Zoning Administrator and Assistant City Engineer Recommendations as follows: 1.1 Any existing irrigation/drainage ditches crossing or adjacent to the property shall be tiled per City Ordinance 1 1-9-605.M. The ditches to be piped should be shown on the site plans. Plans will need to be approved by the appropriate irrigation/drainage district, or lateral users' association, with written confirmation of said approval submitted to the Public Works Department. No variances have been requested for tiling of any ditches crossing this project. 1.2 Any existing domestic wells and/or septic systems within this project will have to be removed from their domestic service per City Ordinance Section 5-7-5 17. Wells may be used for non-domestic purposes such as landscape irrigation. 1.3 Off-street parking shall be provided in accordance with Section 11-2-414 of the City of Meridian Zoning and Development Ordinance and/or as detailed in site-specific requirements. 1.4 Paving and striping shall be in accordance with the standards set forth in Sections 11-2-414.D.4 and 11-2-414.D.5 of the City of RECOMMENDATION TO CITY COUNCIL - 2 CONDITIONAL USE PERMIT - BANK WITH DRIVE-THRU LANES - HOME FEDERAL SAVINGS AND LOAN, INC. 0 • Meridian Zoning and Development Ordinance and in accordance with Americans with Disabilities Act (ADA) requirements. 1.5 A drainage plan designed by a State of Idaho licensed architect or engineer is required and shall be submitted to the City Engineer (Ord. 557, 10-1-91) for all off-street parldng areas. All site drainage shall be contained and disposed of on-site. 1.6 Outside lighting shall be designed and placed so as not to direct illumination on any nearby residential areas and in accordance with City Ordinance Section 11-2-14.D.3. 1.7 All signage shall be in accordance with the standards set forth in Section 11-2-415 of the City of Meridian Zoning and Development Ordinance. No temporary signage or flashing signs will be permitted. 1.8 Applicants shall provide five -foot -wide sidewalks in accordance with City Ordinance Section 11-9-606.B. 1.9 All construction shall conform to the requirements of the Americans with Disabilities Act. 1.10 Applicant shall provide revised site plan detailing all existing and proposed utilities for review by the Meridian Public Works Department. Designer shall coordinate sizing and routing of sanitary sewer and water within the development with the Public Worlcs Department. 1.11 Applicant shall provide the Public Works Department with information on anticipated fire flow and domestic water requirements for the proposed site. Flow and pressure from the existing mains shall be monitored with the Meridian Water Department to determine whether adequate fire protection exists. 1.12 Applicant shall be required to enter into an Assessment Agreement with the City of Meridian. In addition to these assessments, "Late Comers" fees may also be charged against this parcel to help reimburse the parties responsible for installing mains to their current points. 1.13 Applicant shall provide calculation of asphalt area. Austrian Pines should be a minimum of 6'-8' in height to be included as trees meeting this requirement. 1.14 Landscaping of 20 -foot -wide strip adjacent to Meridian Road shall be provided south of proposed property line as part of this development. 1.15. Coordinate locations and construction requirements of trash enclosure with Sanitary Services, Inc., and provide a letter of approval from their office prior to applying for building permits. 1.16 Applicant shall provide letter of approval from Ada County Highway District with submittal of site plan prior to issuance of Certificate of Zoning Compliance. 1.17 Applicant shall provide handicapped accessible parking spaces and associated signage in accordance with the Americans with Disabilities Act. All building and parking lot construction shall meet the requirements of the Americans with Disabilities Act. 1.18 Parking spaces shall be seventeen -feet long. 1.19 Site plan shall be revised to include correct street names. Adopt the Meridian Fire Department's Recommendations as follows: 1.20 Applicants shall satisfy all fire code requirements. 1.21 A fire hydrant shall be added. Adopt the Ada County Highway District's Recommendations as follows: 1.22 The applicant shall provide a minimum of 100 -feet of stacking before the teller window. 1.23 Applicant shall construct a 24 to 30 -foot wide curb return driveway on Franklin Road located approximately 200 -feet east of Meridian Road (approximately the mid -block position) with 25 -foot curb radii abutting Franklin Road. The driveway shall be paved its full width and at least 30 -feet beyond the edge of pavement of Meridian Road. 1.25 Applicant shall provide a recorded cross access easement for the parcels to the south and east to use this parcel for access to the public streets prior to issuance of a building permit (or other required permits). 1.26 Applicant shall replace unused curb cuts on Franklin Road and Meridian Road with standard curb, gutter and 5 -foot wide concrete sidewalk to match existing improvements. 1.27 Restrictions on width, number and location of driveways shall be placed on future development of this parcel. 1.28 Other than the access points specifically approved with this application, direct lot or parcel access to Franklin Road or Meridian Road is prohibited. Stiles: I haven't had a direct objection to it. They did mention it in the Planning and Zoning pubic hearing. They're proposing for their access to the property to be quite a bit south of where they propose to split the property. The property is not split right now, 0 0 Meridian City Council Meeting June 1, 1999 Page 13 and their access to the property would be quite a bit south of that proposed line. We've asked that that 20 foot strip in between Meridian Road and where the driveway would be that they landscape that now. Corrie: And they agreed? Stiles: I don't know that they agreed, no. ITEM NO. 13: PUBLIC HEARING: REQUEST FOR CONDITIONAL USE PERMIT FOR A BANK WITH DRIVE-THRU LANES BY OLSON & ASSOCIATES (HOME FEDERAL)—SOUTHEAST CORNER OF FRANKLIN AND MERIDIAN ROAD: MacCoy: Is the applicant here? As he is walking forward, staff do you have any comments at this point? Stiles: Well, I guess I'll explain something. Mr. Chairman, commissioners, this is at the southeast corner of Franklin and Meridian Road, currently there is a JJ Recreation building there. They did come into our office and went over the plan. We asked them to provide the 20 foot across the street from the mobile home park, which they did, they had room to accommodate that. I know that we've been asking for anything from 20-35 feet on these, what we've termed as our entry way corridors. In this case because of • 0 Meridian Planning and Zoning Commission May 11, 1999 Page 113 the landscaping and the plan that they did provide we had no problem going down tc what they show at 7' 8" on Franklin Road. That was primarily considering there is zero landscaping to the north. Kitty corner from this site they had been approved to, I believe go down to ten feet on Franklin Road. The fact that the mobile home park, it's not a mobile home park, it's an actual subdivision on the southwest corner has no landscaping so, it's a nice plan, we did ask for the landscaping all along the frontage of Meridian to be completed with this building. I still don't have any response to our comments as part of their presentation. This is my bank and I want you to hurry. Rossman: Thanks for disclosing the conflict of interest. De Weerd: Good thing you don't have a vote. MacCoy: I hope the architect cleans his drawing up. He's not really sure where this building is. Okay. Applicant? STEVE PAVLICK, OLSON & ASSOCIATES ARCHITECTS, 1789 BROADWAY. Pavlick: Home Federal will be moving across from their current location on E. 1St and Franklin to this new location. Their access will be off of Franklin Road, their main access which will be a common access for a future development to the east also. Their secondary access will be off Meridian Road which is approximately 250 from the intersection. ACHD would not allow an access on their property directly on their property so they have another access off of Meridian Road, and that landscaped area, I think Shari was talking about was the piece that Home Federal would not own and which they're probably not in agreement to go ahead and landscape. They would not go own it or have any way to landscape it or maintain or anything like that. Utilities on the project will be all located on the rear which is the south part of the building. Gas, water and power will come off of Meridian Road, and they'll be underground and the meters will be on the back side of the project. Drainage will all be kept on site. There will be a drainage swale on Meridian Road side with retention fit. A retention fit on the entrance into Franklin. The landscaping plan that we show include 11 trees which meets the city's requirements for three inch caliper trees, and the other issue that came up was providing more landscaping along the drive through area to the east and the reason there wasn't any landscaping shown there was for security purposes on that. Bob Golley from Home Federal is here and could express that in more detail if you would like. If there's any more questions from the Board, I would be more than happy to answer or Bob also. MacCoy: Any questions from the Commissioners? Borup: Yes, Mr. Chairman. That access road from the south, you say that is south of the bank's property line then? 0 • Meridian Planning and Zoning Commission May 11, 1999 Page 114 Pavlick: Yes. We show it colored right now. That is their property line where the coloring stops. Borup: What's the situation on the road to the south then? Pavlick: That would be a common access. Borup: Owned by? Pavlick: Owned by the seller. The people that they're buying the property from. They'll have access from that owner across that property to Home Federal. Borup: Okay, so he owns additional property there. Pavlick: Yes, the owner who is selling this parcel owns from Meridian Road to E.1st, that whole '/2 block. Borup: I'm talking about to the south. Pavlick: (Inaudible) Borup: Okay, and it's the piece between that access road and Meridian that the discussion was on landscaping that. (Inaudible) Borup: But apparently you've worked out some agreement on the access road though. (Inaudible) Pavlick: Franklin Road may become a right in / right out in the future, so they would like to have a second access off there to their property and ACHD would not allow us to have a curb cut on the property because it was too close to the — Borup: Right, it would be. Well maybe — one of the staff's questions on landscaping along that easement I think maybe the question in my mind would be and maybe I need some more input from Shari, but if you can negotiate across an access in there, an access road, probably something could be negotiated on taking care of landscaping in there too. That's just going to be a graveled weed patch along that area then? Pavlick: It will be fine graded out. The access will be paved asphalt. • Meridian Planning and Zoning Commission May 11, 1999 Page 115 Borup: No, I knew the road would be, but — Pavlick: We're not sure what may happen in that future development of that may change that the way that access happens there. That may become a parking lot or so forth. De Weerd: So you think you may not have that access? Pavlick: No, that access will stay, but I'm saying how it comes in may get changed. There's a possibility that it could change. De Weerd: I think Commissioner Borup is asking if you can get that access, that area between the access road and Meridian Road, why can that not be landscaped? That would be my question if that's not Commissioner Borup's. Pavlick: You're asking Home Federal to landscape someone else's property and then maintain it. Borup: Who is maintaining the access road? Pavlick: It would be up to Home Federal. It would be a brand new road they're paying to put in now. Borup: But that's just what you just got through saying. Pavlick: The access will be — Borup: Home Federal would be maintaining that access road that — Pavlick: The little maintenance that there will be on there. Borup: I don't know if anybody asked Home Federal to maintain it. Maybe they did. Maybe the present property owner needs to. De Weerd: I have no questions at this time. Number nine, the 17 foot parking spaces, have you gotten resolution on that or is that still an issue? Stiles: No, I think that's okay since they do provide additional sidewalk area. They're going to have the overhang anyway, and it should function just fine. De Weerd: Okay. Barbeiro: With Commissioner De Weerd's – MacCoy: You want to either restate this or how do you want to do it? Barbeiro: I would like to withdraw my motion and defer to Commissioner De Weerd. De Weerd: That's what I get for trying to be specific. Okay, well I would move that we recommend approval of the conditional use permit for a bank with drive-thru lanes and to omit the last sentence of site specific comment No. 5. Also to disregard No. 9 about the 17 foot—well, I don't need to do that. This last sentence clarifies it. Okay. That was really easy Tom. MacCoy: Still waiting for a second though. Rossman: I have a question, where you say just strike the last sentence of site specific comment No. 5, in other words are you requiring that they landscape the 20 foot wide strip that they don't own? De Weerd: I would certainly like to see them pursue the possibility of doing that. Rossman: Okay. That will require a further, I guess easement agreement with the owner of the property. MacCoy: That's what I gather. A motion is still on the floor, do I hear anything or are we going to die for something else. Borup: Shari what would happen with our little no mans land there then as far as maintenance of the just under city ordinance as far as weed control, etc.? Stiles: There is no other use of the property except for landscaping. They are using the driveway, they are accessing their development from that driveway. It doesn't make sense not to improve it now. It is not going to change. Stiles: I'm not sure the lot has even been split yet, it's not a—like I say, it's just section land. It's never been part of a plat. Even if it were just grass, it would be better than dirt. MacCoy: Somebody has to mow the grass then. Borup: I would think that Home Federal would be concerned about their image, someone driving through an area like that. MacCoy: I agree. ITEM NO. 14: PUBLIC HEARING: REQUEST FOR A CONDITIONAL USE PERMIT FOR SPECIALTY RETAIL MUSIC STORE BY JOHN BEAGLEY—NORTH OF OVERLAND ROAD, BETWEEN S. LOCUST GROVE ROAD & S. EAGLE ROAD (2400 E. OVERLAND RD): MacCoy: Staff? Stiles: Mr. Chairman, commissioners, our staff report dated May 6, 1999 we ask that you incorporate those comments. Probably could look at something more than a 64 foot monument sign on the freeway there. We would like to see some details of the signage here. This property was originally annexed when St. Luke's was annexed. It was all part of the same process. There is a development agreement required as a condition of the annexation and I'm sure there is some future use of this property because there is a whole lot that is still open there but they have come back with their revision to show a 35 foot landscape strip on the freeway and on Overland Road. I believe they realize that all the parking and driveway areas will need to be paved. I would like them to maybe think a little bit more about the design of their southern exterior elevation there. It makes it look a little difficult to know where you are going, but Facts and Findings: A. Meridian Road Minor arterial with bike lane designation Traffic count of 11,063 on 9-14-95 300 -feet of frontage 80 -feet existing right-of-way (40 -feet from centerline) No additional right-of-way required The abutting segment of Meridian Road was recently improved with a 3 -lane street section with curb, gutter and sidewalk abutting the site. B. Utility street cuts in new pavement less than five years old are not allowed unless approved in writing by the District. Contact Construction Services at 387-6280 (with file numbers) for details. C. District policy states that direct access to arterials and collectors is normally restricted and that the developer shall try to use combined access points. In accordance with District policy the applicant should be required to provide a recorded cross access easement for the parcels to the south and east to use this parcel for access to the public streets prior to issuance of a building permit (or other required permits). The District intends to require a similar agreement of the owner of the parcels to the south and east if they are the subject of a future development application. MCUP9907.CMM Page 2 D. The applicant is proposing a driveway on Franklin Road approximately 200 -feet east of the Meridian Road intersection at the site's east property line. The driveway will align with an existing driveway on the north side of the road. The driveway will be located mid -block between Meridian Road and First Street and matches the desired location identified in the proposed Policy Manual update. District Policy requires that driveways on arterials be offset 220 -feet from controlled intersections for right-in/right-out driveway and 440 -feet for a full access driveway. A proposed change in policy allows full access driveways at mid -block locations in downtown areas. Staff recommends a variance for this driveway because the site has insufficient frontage to offset a driveway from both First Street and Meridian Road. The District has a proposed policy revision which allows driveways at midblock locations in downtown business districts. The applicant's site is in a downtown business district and the driveway is located midblock. Allowing the driveway full access is consistent with the District's past action with similar development applications. The applicant should construct the driveway as a 24 to 30 -foot wide curb return driveway on Franklin Road with 15 -foot curb radii abutting Franklin Road. The District may restrict this driveway to right-in/right-out operations if safety becomes an issue when traffic volumes increase on Franklin Road. E. The applicant has an existing driveway on Meridian Road approximately 315 -feet south of the Franklin Road intersection at the site's south property line. The driveway meets District policy. The applicant should be required to pave the driveway its full width to a point 30 -feet beyond the edge of pavement of Meridian Road. F. Graveled driveways abutting public streets create maintenance problems due to gravel being tracked onto the roadway. In accordance with past action by the District the applicant should be required to pave the driveway its full width and at least 30 -feet beyond the edge of pavement of Franklin Road. G. The applicant is proposing to close an existing curb cut driveway on Franklin Road located approximately 84 -feet east of the Meridian Road intersection. The applicant should be required to replace the unused curb cut on Franklin Road with standard curb, gutter and 5 -foot wide concrete sidewalk to match existing improvements. H. The applicant is proposing to close an existing curb cut driveway on Meridian Road located approximately 95 -feet south of the Franklin Road intersection. The applicant should be required to replace the curb cut on Meridian Road with standard curb, gutter and 5 -foot wide concrete sidewalk to match existing improvements. I. The applicant is proposing a drive-thru banking facility. The applicant should provide 100 -feet of stacking before the teller window. The applicant is providing adequate stacking before the teller window. As required by District policy, restrictions on the width, number and locations of driveways, may be placed on future development of this parcel. NICUP9907.CMM Pale 3 r: K. The existing transportation system will be adequate to accommodate the additional traffic generated by this proposed development with the requirements outlined within this report. Special Recommendation to the City of Meridian: The applicant should be required to provide a minimum of 100 -feet of stacking before the teller window. The following requirements are provided as conditions for approval: Site Specific Requirements: Construct a 24 to 30 -foot wide curb return driveway on Franklin Road located approximately 200 -feet east of Meridian Road (approximately the mid -block position) with 25 -foot curb radii abutting Franklin Road. Pave the driveway its full width and at least 30 -feet beyond the edge of pavement of Franklin Road. This driveway may be restricted to right-in/right-out operations in the future if necessary. 2. The existing 30 -foot wide curb return driveway on Meridian Road located approximately 315 - feet south of Franklin Road is approved with this application. Pave the driveway its full width and at least 30 -feet beyond the edge of pavement of Meridian Road. 3. Provide a recorded cross access easement for the parcels to the south and east to use this parcel for access to the public streets prior to issuance of a building permit (or other required permits). 4. Replace unused curb cuts on Franklin Road and Meridian Road with standard curb, gutter and 5 -foot wide concrete sidewalk to match existing improvements. As required by District policy, restrictions on the width, number and locations of driveways, shall be placed on future development of this parcel. 6. Other than the access points specifically approved with this application, direct lot or parcel access to Franklin Road or Meridian Road is prohibited. Standard Requirements: A request for modification, variance or waiver of any requirement or policy outlined herein shall be made in writing to the ACHD Planning and Development Supervisor. The re nest shall specifically identify each requirement to be reconsidered and include a written explanation of whysuch requirement would result in a substantial hardship or inegwty. The written Wiest shall be submitted to the District no later than 9.00 a.m. on the day scheduled for A HD Commission action. Those items shall be rescheduled for discussion with the Commission on the next available meeting agenda. The request for reconsideration shall specifically identify each requirement to he reconsidered and include written documentation of data hawas not available to the Commission at the time of its original decision The request for reconsideration will be heard by the District Commission at the next regular meeting of the Commission. If the Commission agrees to reconsider the action, the applicant will be notified of the date and time of the Commission meeting at which the reconsideration will be heard. Payment of applicable road impact fees are required prior to building constriction in accordance with Ordinance #188, also known as Ada County Highway District Road Impact Fee Ordinance. 4. All design and construction shall be in accordance with the Ada County Highway District Policy Manual, ISPWC Standards and approved supplements, Construction Services procedures and all applicable ACHD Ordinances unless specifically waived herein. 5. The applicant shall submit revised plans for staff approval, prior to issuance of building permit (or other required permits), which incorporates any required design changes. 6. Construction, use and property development shall be in conformance with all applicable requirements of the Ada County Highway District prior to District approval for occupancy. 7. It is the responsibility of the applicant to verify all existing utilities within the right-of-way. Existing utilities damaged by the applicant shall be repaired by the applicant at no cost to ACRD. The applicant shall be required to call DIGLINE (1-800-342-1585) at least two full business days prior to breaking ground within ACHD right-of-way. The applicant shall contact ACHD Traffic Operations 387-6190 in the event any ACHD conduits (spare or filled) are compromised during any phase of construction. S. No change in the terms and conditions of this approval shall be valid unless they are in writing and signed by the applicant or the applicant's authorized representative and an authorized representative of the Ada County Highway District. The burden shall be upon the applicant to obtain written confirmation of any change from the Ada County Highway District. Any change by the applicant in the planned use of the property which is the subject of this application, shall require the applicant to comply with all rules, regulations, ordinances, plans, or other regulatory and legal restrictions in force at the time the applicant or its successors in interest advises the Highway District of its intent to change the planned use of the subject property unless a waiver/variance of said requirements or other legal relief is granted pursuant to the law in effect at the time the change in use is sought. The driveway will align with an existing driveway on the north side of the road. District Policy requires that driveways on arterials be offset 220 -feet from controlled intersections for right-in/right-out driveway and 440 -feet for a full access driveway. The applicant should construct the driveway as a 24 to 30 -foot wide curb return driveway on Franklin Road with 15 -foot curb radii abutting Franklin Road. The District may restrict this driveway to right-in/right-out operations if safety becomes an issue when traffic volumes increase on Franklin Road. E. The applicant has an existing driveway on Meridian Road approximately 315 -feet south of the Franklin Road intersection at the site's south property line. The driveway meets District policy. The applicant should be required to pave the driveway its full width to a point 30 -feet beyond the edge of pavement of Meridian Road. F.
