3. We hereby request a Zoning Amendment as part of this Annexation
Application. The subject property is currently zoned M-1 and is
in Ada County. This is our Notarized Request.
4. Legal Description signed and stamped by a land surveyor registered
in Idaho is attached.
5. The present land use is a 10,000 SF Warehouse/Office Building
which is owned by Jacksons Food Stores Inc. and leased to the
Sherwin-Williams Paint Company. This building occupies the front
half of this lot. This back half of the lot is vacant and is
planned for a 10,000 SF Office/Storage Building which will be
occupied by Jacksons Food Stores, Inc.
6. The proposed land use would be the new Jacksons Office Building
which would be built on the back half of the lot and become
additional Office/Storage space for the existing Jacksons Food
Stores Warehouse/Office Building on the adjoining lot.
7. The present zoning district is M-1, and is located in Ada County.
8. The proposed zoning district is I-L and is located in the City of
Meridian.
9. Statement: The subject property is the only parcel on Commercial
Court that is still located in Ada County. All other properties
have been annexed, and rezoned from M-1 to I-L.
10. Statement: The subject property currently received full services
from the City of Meridian. The property is surrounded by parcels

Re: Request for Annexation and Zoning to I-L of 2.0 Acres with a Conditional Use
Permit for a Planned Unit Development -General by Jackson's Food Stores, Inc.
We have reviewed this submittal and offer the following comments, as conditions of the
application. These conditions shall be considered in full, unless expressly modified or deleted by
motion of the Meridian City Council:
GENERAL COMMENTS
1. This application is for two buildings on one lot. City Ordinance requires that more than
one principal building on a lot requires that the property be developed as a planned
development under the conditional use permit process.
2. Statement included in No. 9 of application is incorrect. Coors, TEC, and Albertson's aze
all still within the County.
3. Although not included in the application, Dale Binning, Project Architect, indicated that
2,000 squaze feet of the building is storage/wazehouse, with the remainder to be office
space.
4. Pazking spaces aze shown at 18 feet instead of 19 feet required by Ordinance. Due to the
provision of ten-foot-wide sidewalks, staff supports the 18-foot dimension with
allowance given for bumper overhang.
5. Sewer and water service to this site will be via existing mains in Commercial Court.
6. The Settlers Canal is adjacent to the northern boundary of this lot.

7. As part of a planned unit development, a minimum often percent of the gross land azea
of the lot must be open space (8,712 squaze feet).
8. The site plan contains no legend to show details of landscaping or other features.
9. A minimum of one (1) three-inch (3") caliper tree per 1,500 squaze feet of asphalt is
required for the entire lot.
GENERAL REQUIREMENTS
1 • Any existing irrigation/drainage ditches adjacent to or crossing the property to be
included in this project shall be tiled per City Ordinance 11-9-605.M. Plans will need to
be approved by the appropriate irrigation drainage district, or lateral users association,
with written confirmation of said approval submitted to the Public Works Department.
2. Any existing domestic wells and/or septic systems within this project will have to be
removed from their domestic service per City Ordinance Section 5-7-517. Wells may be
used for non-domestic purposes such as landscape irrigation.
3. Provide 5' wide sidewalks in accordance with City Ordinance Section 11-9-606.B.
4. Coordinate fire hydrant placement with the City of Meridian Public Works Department.
5. All drainage shall be retained on site per City Ordinance. Special attention needs to be
paid to the design due to shallow groundwater depth.
SITE SPECIFIC REQUIREMENTS:
1. Designer to coordinate sewer and water line sizing and routing with the Public Works
Department. Applicant shall be responsible for payment of sewer and water latecomers
fees at the time of building permit issuance.
2. Identify all existing ditch easements on the site plan. Show their location, width, and
proposal for relocation or piping. Provide information from Settlers Irrigation District
regarding the pipe size that would be required for this ditch. If the canal is not proposed
to be tiled, a waiver of the tiling requirement will need to be granted by the Meridian City
Council.
3. Provide calculations of asphah and total landscaped area so conformance with Ordinance
requirements may be determined; revise site plan to comply.
4. Revise site plan to include legend and detailed landscape plan for review and approval.
5. Per Uniform Plumbing Code requirements, each building shall be served by independent
sewer and water services.

6. If a waiver of the tiling requirement is granted, permanent non-combustible fencing is to
be installed along the easement line for the Settlers Canal. Fencing is to be in place prior
to applying for building permits.
Staff recommends annexation and zoning of this parcel provided an acceptable site plan is
submitted for review and approval and all terms of the approved conditional use permit aze met.

INTRODUCTION
The property is approximately 2.0 acres in size. The property is located
north of Franklin Road and East of Eagle Road (3500 Coiilmercial Court). The
property is designated as Commerce Park Subdivision Lot 3
2. The owner of record of the subject property is Jacksons Food Stores,
Inc., of 3500 Commercial Court, Meridian, Idaho.
3. Applicant is the owner of record.
4. The property is presently zoned by Ada County as Limited Industrial
(M-1) , and consists of retail/warehouse/vacant.
5. The Applicant requested the property be zoned as Light Industrial (I-L)
which is defined at Meridian City Development Ordinance 11-2-408(B)(14).
6. The proposed site of the subject propene is located at 3500 Commercial
Court, north of Franklin Road east of Eagle Road.

ANNEXATION AND ZONING -JACKSON'S FOOD STORES, INC.
7. The subject property is bordered to the east, west and south by
commercial development and the city limits of the City of Meridian are adjacent and
abut to the north of the subject property.
8. The property which is the subject of this application is within the Area
of Impact of the City of Meridian.
9. The entire parcel of the property is included within the Meridian Urban
Service Planning Area as the Urban Service Planning Area is defined in the Meridian
Comprehensive Plan.
10. The Applicant proposes to develop the subject property in the following
manner: by construction and development of an office building.
11. The Applicant request zoning of the subject real property as Light
Industrial (I-L). It ~is consistent with the Meridian Comprehensive Plan Generalized
Land Use Map which designates the subject property as Light Industrial.
12. There are no significant or scenic features of major importance that
affect the consideration of this application.
RECOMMENDATION
1. The Meridian Planning and Zoning Conuilission hereby recommends to
the City Council of the City of Meridian that they approve the requested annexation
and zoning as requested by the Applicant for the property described in the
application, subject to the following:

Recommendations as follows:
1.1 Anv existing irrigation drainage ditches adjacent to or crossing the
property to be included in this project shall be tiled per City Ordinance
ll -9-605.M. Plans will need to be approved by the appropriate
irrigation/drainage district, or lateral users association, with written
confirmation of said approval submitted to the Public Worlcs
Department.
1.2 Any e_Yisting domestic wells and/or septic systems within this project will
have to be removed from their domestic service per City Ordinance
Section 5-i-517. Wells may be used for non-domestic purposes such as
landscape irrigation.
1.3 Sewer and water line sizing and routing shall be coordinated with the
Public Worlcs Department. Applicant shall be responsible for payment
of sewer and water latecomers fees at the time of building permit
issuance.
1.4 Existing ditch easements shall be identified on the site plan including
location, width, and proposal for relocation or piping. Applicant shall
provide information from Settlers Irrigation District regarding the pipe
size that would be required for this ditch. If the canal is not proposed to
be tiled, a waiver of the tiling requirement will need to be granted by
the Meridian City Council.

Applicant
INTRODUCTION
1. The property is located north of Franklin Road, east of Eagle Road at
3420 Commercial Court, Meridian, Idaho.
2. The owner of record of the subject property is Jackson's Food Stores,
Inc. of 3500 Commercial Court, Meridian, Idaho.
3. Applicant is the owner of record.
4. The subject property is currently zoned Ada County Limited Industrial
(M-1). The proposed zoning designation is Meridian Light Industrial (I-L) The
zoning district of Light Industrial (I-L) is defined within the City of Meridian Zoning
and Development Ordinance, Section 11-2-408(B)(14).
5. The proposed application requests a conditional use permit for a
Planned Unit development to allow construction of an office building. The I-L

zoning designation within the City of Meridian Zoning and Development Ordinance
requires a conditional use permit be obtained for most uses including those requested
by the Applicant. (Meridian City Zoning and Development Ordinance, Section 11-2-
409(B).
6. The use proposed within the subject application will in fact, constitute a
conditional use as determined by City Policy.
RECOMMENDATION
The Meridian Planning and Zoning Commission hereby recommends to
the City Council of the City of Meridian that then approve the conditional use
permit as requested by the applicant, subject to the following:
Adopt the Planning and Zoning Administrator and Assistant City Engineer
Recommendations as follows:
1.1 A minimum of ten percent of the gross land area of the lot shall be open
space (8,i 12 square feet).
1.2 A minimum of one (1) three-inch (3") caliper tree per 1,500 square feet
of asphalt is required for the entire lot.
1.3 Anv existing irrigation drainage ditches adjacent to or crossing the
property to be included in this project shall be tiled per City Ordinance
11 -9-605.M. Plans will need to be approved by the appropriate
irrigation/drainage district, or lateral users association, ~yith written
confirmation of said approval submitted to the Public Worlcs
Department.

Works Department.
1.7 All drainage shall be retained on site per City Ordinance. Special
attention needs to be paid to the design due to shallow groundwater
depth.
1.8 Sewer and water line sizing and routing shall be coordinated with the
Public Works Department. Applicant shall be responsible for payment
of sewer and water latecomers fees at the dine of building permit
issuance.

1.10 Applicant shall revise the site plan to provide calculations of asphalt and
total landscaped area so conformance with Ordinance requirements may
be determined.
1.1 1 Site plan shall be revised to include legend and detailed landscape plan
for review and approval.
1.12 Per Uniform Plumbing Code requirements, each building shall be served
by independent sewer and water services.
1.13 If a waiver of the tiling requirement is granted, permanent non-

1.14 Applicant shall construct a monument type sign only of no more than
50 sq.ft. having no flashing lights.
Adopt the Meridian Fire Department's Recommendations as follows:
1.15 Applicants shall satisfy all fire code requirements including those
pertaining to water flow and fire hydrants.
1.16 Applicant shall consult with Fire Dept. regarding addition of a fire
hydrant.
Adopt the Nampa ~ Meridian Irrigation District Recommendations as follows:
1.17 Requires all laterals and wastewavs be protected.
1.18 All municipal surface drainage shall be retained on site. If any surface
drainage leaves the site, the Nampa ~ Meridian Irrigation District must
review drainage plans.
1.19 Developer must comply with Idaho Code § 31-3805.

EAGLE ROAD.
MacCoy: This is again a public hearing. Going to staff, Shari do you have any
commen#s you want to make on this now?
Stiles: Mr. Chairman, Commissioners, just to incorporate the testimony from the
previous public hearing.
MacCoy: Okay, thank you. Does the applicant want to come back and make his
statement along the same general line or add #o it or whatever.
Benning: Dale Benning again. The comments, general requirements and site specific
requirements that are listed here have all been addressed and are incorporated into the
site plan that we have here. We will provide the exact calculations to show the
landscaping and paving and the requirements that follow this. We exceed all those
requirements as it is shown at this time with the only thing that is not indicated on that
plan that would bring us into compliance with the site specific requirements is the non
combustible fence along the back property line by the ditch and that's if it is not tiled. I
don't think it will be. I think it's too big.
MacCoy: Any questions for him at this point?
De Weerd: Just what kind of fence that would be.

the next property over since Jackson's owns that as well?
Benning: Oh, yes. That wraps around to the back of their property, yes.
De Weerd: Will that landscaped area also continue over'?
Benning: What we have proposed now, it stops right where it's shown right there.
De Weerd: And that fence would also stop right there? I have nothing further.
MacCoy: Ail right, thank you. Again does anybodye here that's willcng to have anyor of

your decision on the final piece of this?
De Weerd: Shari, I guess I have a question for you. As far as the grassy areas that are
kept for retention areas, are those also irrigated? I mean, are they only when there is
City water are they green?
Stiles: They certainly can be irrigated. They can be designed to be irrigated. They can
be designed so that they are merely a swale that's incorporated in the landscape and
they could have trees around the upper areas, but depend on what volume of water
there going to have to be--
De Weerd: Is that something that the staff looks at?
Stiles: We're going to have to look at that, especially there is shallow ground water in
that area and I don't know-that will all have to be done by their architect when they
come in for building permits and we'll have to look at the design of that and make sure
that it can be included as part of that 10 percent, based on the design.
De Weerd: Yeah, I guess my concern is, if it's not irrigated, it is going to be brown. It's
not going to be green grass, it's going to be brown grass.
Stiles: I don't know if the applicant is to that point yet, but I am sure it will all be
designed to be -
De Weerd: Green grass.
Stiles: Any place that's planted will have to have underground sprinkling.
De Weerd: Okay. That's my question. Thank you. Mr. Chairman, I had nothing

We have reviewed this submittal and offer the following comments, as conditions of the
application. These conditions shall be considered in full, unless expressly modified or deleted by
motion of the Meridian City Council:
GENERAL COMMENTS
1. This application is for two buildings on one lot. City Ordinance requires that more than
one principal building on a lot requires that the property be developed as a planned
development under the conditional use permit process.
2. Statement included in No. 9 of application is incorrect. Coors, TEC, and Albertson's are
all still within the County.
3. Although not included in the application, Dale Binning, Project Architect, indicated that
2,000 square feet of the building is storage/warehouse, with the remainder to be office
space.
4. Parking spaces are shown at 18 feet instead of 19 feet required by Ordinance. Due to the
provision of ten-foot-wide sidewalks, staff supports the 18-foot dimension with
allowance given for bumper overhang.
5. Sewer and water service to This site will be via existing mains in Commercial Court.
6. The Settlers Canal is adjacent to the northern boundary of this lot.

7. As part of a planned unit development, a minimum of ten percent of the gross land area
of the lot must be open space (8,712 square feet).
The site plan contains no legend to show details of landscaping or other features.
9. A minimum of one (1) three-inch (3") caliper tree per 1,500 square feet of asphalt is
required for the entire lot.
GENERAL REQUIREMENTS
1. Any existing irrigation drainage ditches adjacent to or crossing the property to be
included in this project shall be tiled per City Ordinance 11-9-605.M. Plans will need to
be approved by the appropriate irrigation drainage district, or lateral users association,
with written confirmation of said approval submitted to the Public Works Department.
2. Any existing domestic wells and/or septic systems within this project will have to be
removed from their domestic service per City Ordinance Section 5-7-517. Wells may be
used for non-domestic purposes such as landscape irrigation.
Provide 5' wide sidewalks in accordance with City Ordinance Section 11-9-606.B.
4. Coordinate fire hydrant placement with the City of Meridian Public Works Department.
5. All drainage shall be retained on site per City Ordinance. Special attention needs to be
paid to the design due to shallow groundwater depth.
SITE SPECIFIC REQUIREMENTS:
Designer to coordinate sewer and water line sizing and routing with the Public Works
Department. Applicant shall be responsible for payment of sewer and water latecomers
fees at the time of building permit issuance.
2. Identify all existing ditch easements on the site plan. Show their location, width, and
proposal for relocation or piping. Provide information from Settlers Irrigation District
regarding the pipe size that would be required for this ditch. If the canal is not proposed
to be tiled, a waiver of the tiling requirement will need to be granted by the Meridian City
Council.
3. Provide calculations of asphalt and total landscaped area so conformance with Ordinance
requirements may be determined; revise site plan to comply.
4. Revise site plan to include legend and detailed landscape plan for review and approval.
5. Per Uniform Plumbing Code requirements, each building shall be served by independent
sewer and water services.

6. If a waiver of the tiling requirement is granted, permanent non-combustible fencing is-to
be installed along the easement line for the Settlers Canal. Fencing is to be in place prior
to applying for building permits.
Staff recommends annexation and zoning of this parcel provided an acceptable site plan is
submitted for review and approval and all terms of the approved conditional use permit are met.

The above entitled annexation and zoning application having come on
for public hearing on August 17, 1999, at the hour of 7:00 o'clock p.m., and Brad-
Hawkins-Clarlc, Assistant Planner for the Planning and Zoning Department,
presented the staff report, and the Applicant's representative, Dale Binning, Architect

appearing and written notice having been mailed to property owners or purchasers of
record within three hundred (300') feet of the external boundaries of the property
under consideration more than fifteen (15) days prior to said hearing and with the
notice of public hearing having been posted upon the property under consideration
more than one week before said hearing; and that copies of all notices were made
available to newspaper, radio and television stations as public service announcements;
and the matter having been duly considered by the City Council at the August 17,
1999, public hearing; and the applicant, affected property owners, and government
subdivisions providing services within the planning jurisdiction of the City of
Meridian, having been given full opportunity to express comments and submit
evidence.
2. There has been compliance with all notice and hearing requirements set
forth in Idaho Code §§ 67-6509 and 67-6511, and §§11-2-416E and 11-2-417A,
Municipal Code of the City of Meridian.
3. The City Council takes judicial notice of its zoning, subdivisions and
development ordinances codified at Title 11, Municipal Code of the City of
Meridian, and all current zoning maps thereof, and the Comprehensive Plan of the
City of Meridian adopted December 21, 1993, Ordinance No. 629, January 4,1994,
and maps and the ordinance Establishing the Impact Area Boundary.

4. The property which is the subject to the application for annexation and
zoning is described in the application, and by this reference is incorporated herein as
if set forth in full. The property is approximately 2.0 acres in size. The property is
located north of Franklin Road and east of Eagle Road (3500 Commercial Court),
Meridian, Idaho.
5. The Applicant is the record owner of the property of 3500 Commercial
Court, Meridian, Idaho, and has filed a written request for annexation and zoning.
6. The property is presently zoned by Ada County as Limited Industrial
(M-1), and consists of retai]/warehouse/vacant.
7. The Applicant requests the property be zoned as Light Industrial (I-L)
which is defined at Meridian City Development Ordinance § 11-2-408(B)(14).
8. The Applicant has requested the annexation and this zoning, and the
application was not initiated at the request of the City of Meridian.
9. The property is located at 3500 Commercial Court, north of Franklin
Road and east of Eagle Road, Meridian, Idaho.
10. The proposed site of the subject property is bordered to the east, west
and south by commercial development and the city limits of the City of Meridian are
adjacent and abut to the north of the subject property.

13. The entire parcel of the property is included within the Meridian Urban
Service Planning Area as the Urban Service Planning Area is defined in the Meridian
Comprehensive Plan.
14. The applicant proposes to develop the subject property in the following
manner: for the construction and use of a new Jackson's 10,000 square foot office
building, which will include 2,000 square feet of storage/warehouse, with the
remaining portion for offices.
15. Giving due consideration to the comment received from the
governmental subdivisions providing services in the City of Meridian planning
jurisdiction, public facilities and services required by the proposed development will
not impose expense upon the public if the following conditions of development are
imposed:
Adopt the Planning and ~?oning Administrator and Assistant City Engineer
Recommendations as follows:
15.1 Any existing irrigation/drainage ditches adjacent to or crossing the
property to be included in this project shall be tiled per City Ordinance
11 -9-605.M. Plans will need to be approved by the appropriate
irrigation/drainage district, or lateral users association, with written
confirmation of said approval submitted to the Public Worlcs

15.2 Any existing domestic wells and/or septic systems within this project will
have to be removed from their domestic service per City Ordinance
Section 5-7-517. Wells may be used for non-domestic purposes such as
landscape irrigation.
15.3 Sewer and water line sizing and routing shall be coordinated with the
Public Worlcs Department. Applicant shall be responsible for payment
of sewer and water latecomers fees at the time of building permit
issuance.
15.4 Existing ditch easements shall be identified on the site plan including
location, width, and proposal for relocation or piping. Applicant shall
provide information from Settlers Irrigation District regarding the pipe
size that would be required for this ditch. If the canal is not proposed to
be tiled, a waiver of the tiling requirement will need to be granted by
the Meridian City Council.
16. It is found that if the developer pays for the requested improvements
and complies with the conditions set forth in these findings of fact no. 15, and all
subparts, the economic welfare of the City and its residents and tax and rate payers
will be protected, which requirement shall be included in a conditional use permit for
the proposed development.
17. It is found that the following are development considerations which
must be taken into account, in order to assure the proposed development is designed,
constructed, operated and maintained in a manner which is harmonious and
appropriate in appearance with the existing, or intended character of the general
vicinity, in order to assure that the proposed use will not change the essential

character of the affected vicinity and will insure that the proposed uses will not be
hazardous or disturbing to the existing, or future neighboring uses, particularly
considering the impact of proposed development on potential to produce excessive
traffic, noise, smoke, fumes, glare and odors:
17.1 That the subject property be used in accordance with the
representations in the application and in accordance generally with the
Site Plan submitted, denoted as "Jackson's Food Stores Office Building,
Inc.", datedAug~ist 11, 1999, Sheet S-ld, Dale Binning Architect.
18. The Applicant request zoning of the subject real property as Light
Industrial (I-L). It is consistent with the Meridian Comprehensive Plan Generalized
Land Use Map which designates the subject property as Light Industrial.
19. The development of the property as a (1-L) Light Industrial, as requested
by the Applicant, will be compatible to the development in the surrounding area
subject to the conditions of development herein found to be reasonable in relation to
the requested zone (1-L) Light Industrial District and is accordance with the adoptive
Comprehensive Plan of the City of Meridian.
20. There are no major or scenic features of major importance that affect
the consideration of this application.
21. The subject annexation request and zoning designation and proposed
development relates to the goals and policies of the Comprehensive plan of the City
as follows:

2 1.1 The consideration. of the provisions of the Comprehensive plan and the
requirements of the Zoning ordinance assure that the processing of such
application is the management of growth with the aim to achieve high-
quality development. Enhancement of Meridian's quality of life for all
residents is achieved by applying the criteria of the Comprehensive plan
and the Zoning ordinances of the City to all applications such as the
subject application.
21.2 This proposed new growth development will finance public service
expansion by the requirement herein that the applicant comply with the
requests submitted of the political subdivisions responses within the
Meridian Urban Service Planning Area submitted in the record of this
matter.
21.3 The application is consistent with Meridian's self identity.
21.4 The proposed development will be consistent with the goal of supplying
employment and economic self-sufficiency for the existing and future
residents of the City and the reduction of the reliance upon Boise and
the strengthening of the City's ability to finance and implement public
improvements, services and its open space character.
21.5 The preservation and improvement of the character and quality of
Meridian's man-made environment while maintaining its identity as a
self-sufficient community is achieved by applying the criteria of the
Comprehensive plan and the Zoning ordinances of the City to the
subject application.
21.6 Compliance with the requests of the political subdivisions providing
services, assures that community services are being provided for existing
and projected needs and that the land use patterns of the City are
balanced to insure that revenues pay for services and that the Urban
Service Planning Area is visually attractive, efficiently managed and
clearly identifiable.
21.7 Compatible and efficient use of land through innovative and functional
site design is achieved by applying the criteria of the Comprehensive
plan and the Zoning ordinances of the City to the subject application.

22. There is a companion application of the Applicant pending which
requests a conditional use permit for a Planned Unit Development to allow
construction of an office building. The (I-L) zoning designation within the City of
Meridian Zoning and Development Ordinance requires a conditional use permit be
obtained for most uses including those requested by the Applicant. (Meridian City
Zoning and Development Ordinance, Section 11-2-409(B).
23. The property can be physically serviced with City water and sewer, if
applicant extends the lines.
CONCLUSIONS OF LAW
1. The City of Meridian has authority to annex real property upon written
request for annexation and the real property being contiguous or adjacent to city
boundaries and that said property lies within the area of city impact as provided by
Idaho Code Section SO-222. The Municipal Code of the City of Meridian Section 11-
2-417 provides the City may annex real property that is within the Meridian Urban

2. The City Council may take judicial notice of government ordinances,
and policies, and of actual conditions existing within the City and State.
3. The City of Meridian has exercised its authority and responsibility as
provided by "Local Land Use Planning Act of 1975', codified at Chapter 65, Title 67,
Idaho Code by the adoption of `Comprehensive Plan City of Meridian adopted
December 2 I , 1993, Ord. No. h~29, January 4, 1994.
4. The following are found to be pertinent provisions of the City of
Meridian Comprehensive Plan and are applicable to this Application:
4.1 The Goals of the Comprehensive Plan are set forth at Page 5 and
include:
4.1.1 To preserve Meridian's environmental quality and to make
provi sions for and improve the total natural environment
by adopting City-wide and Urban Service Planning Area
policies, which deal with area-specific policies and
programs.
4.1.2 To ensure that growth and development occur in an
orderly fashion in accordance with adopted policies and
procedures governing the use of land, residential
development the provision of services and the distribution
of new housing units within the Urban Service Planning
Area.
4.1.3 To encourage the kind of economic growth and
development which supplies employment and economic
self-sufficiency For existing and future residents, reduces
the present reliance on Boise and strengthens the City's

5. The requested zoning of Light Industrial, (1-L) is defined in the Zoning
Ordinance at 11-2-408 B. 14. as follows:
(1-L) Light Industrial: The purpose of the (1-L) Light Industrial District
is to provide for light industrial development and opportunities for
employment of Meridian citizens and area residents and reduce the
need to commute to neighboring cities; to encourage the development of
manufacturing and. wholesale establishments which are clean, quiet and
free of hazardous or objectionable elements, such as noise, odor, dust,
smoke or glare and that are operated entirely or almost entirely within
enclosed structures; to delineate areas best suited for industrial
development because of location, topography, existing facilities and
relationship to other land uses. This district must also be in such
proximity to insure connection to the Municipal Water and Sewer
systems of the City of Meridian. Uses incompatible with light industry
are not permitted, and strip development is prohibited.
6. That Section 11-2-409, ZONING SCHEDULE OF USE CONTROL, B,
Commercial, lists commercial uses allowed in the various zoning districts of the City;
that office/warehouses are listed as permitted for offices and warehouses as
conditional uses in the Light Industrial (1-L) District.

7. The development of the annexed land, if annexed, shall meet and
comply `with the Ordinances of the City of Meridian including, but not limited to:
Section 11-9-616 which pertains to development time schedules and requirements;
Section 11-9-605 M, which pertains to the piping of ditches; and Section 11-9-606 B
1 ~., which pertains to pressurized irrigation systems.
8. The development of the property shall be subject to and controlled by
the Zoning and Subdivision and Development Ordinance of the City of Meridian.
DECISION AND ORDER
NOW, THEREFORE, BASED UPON THE ABOVE AND FOREGOING
FINDINGS OF FACT AND CONCLUSIONS OF LAW, the City Council does
hereby Order and this does Order:
1. That the City Attorney shall prepare for consideration by the City
Council the appropriate ordinance for the annexation and zoning designation, (I-L)
Light Industrial Ordinance.

are hereby repealed, rescinded and annulled.
SECTION 6: This ordinance shall be in full force and effect from and after its passage,
approval and publication, according to law.
SECTION 7: The Cleric of the City of Meridian shall, within ten (10) days following the
effective date of this ordinance, duly file a certified copy of this ordinance and a map prepared in
a draftsman manner plainly and clearly designating the boundaries of the Citv of IVleridian,

PLANS ACCEPTANCE
The District has reviewed the plans for the above referenced project, acid they are accepted for public street
construction. By stamping and stgning the improvement plans, the Registered Engineer ensures t11e District
that the plans conform to all District policies and standards. Variances or waivers mast be specifically and
previously approved by the Dish ict in writing. Acceptance of the improvement plans by the District does not
relieve the Registered Engineer of these responsibilities. The District will assess the followtt~g impact fee for
this project. The impact fee must be paid prior to issuance of a building permit.
Total Impact Fee due: $34,020.00
Standard Requirements:
1~ Utility street cuts iti new pavement less than five years old are not allowed unless approved in
wnttng by the District.
]I. All irrigation facilities must be located outside the public right-of--way unless otherwise
approved by the Dislnct.
III. Replace damaged curb, gutter, and sidewalk with new curb, gutter, and sidewalk to match
existing improvements.
IV. All facilities to be constructed with a proposed development, and to be owned and maintained by
the District, tntist be constructed according to the latest edition of I.S.P.W.C. and the District's
Supplemental Standard Specifications.
~' Any work in the public right-of-way requires a permit from ACRD Construction Servtces.
VI. An engineer registered in the State of Idaho shall prepare and certify all improvement plans.
