located in the City of Meridian. This adjoining property houses
Jacksons Food Stores Offices and Warehouse. Jacksons Food Stores
needs to expand their offices into this proposed Office/Storage
Building. This is desirable since it is next door to their existing
operations.

of $13.84 is attached. Total check amount is $288.84.
14. Statement: We agree to pay any additional sewer, water or trash
fees, if any, associated with the proposed use.

Re: Request for Annexation and Zoning to I-L of 2.0 Acres with a Conditional Use
Permit for a Planned Unit Development -General by Jackson's Food Stores, Inc.
We have reviewed this submittal and offer the following comments, as conditions of the
application. These conditions shall be considered in full, unless expressly modified or deleted by
motion of the Meridian City Council:
GENERAL COMMENTS
1. This application is for two buildings on one lot. City Ordinance requires that more than
one principal building on a lot requires that the property be developed as a planned
development under the conditional use permit process.
2. Statement included in No. 9 of application is incorrect. Coors, TEC, and Albertson's are
all still within the County.
3. Although not included in the application, Dale Binning, Project Architect, indicated that
2,000 square feet of the building is storage/warehouse, with the remainder to be office
space.
4. Parking spaces are shown at 18 feet instead of 19 feet required by Ordinance. Due to the
provision of ten-foot-wide sidewalks, staff supports the 18-foot dimension with
allowance given for bumper overhang.
5. Sewer and water service to this site will be via existing mains in Commercial Court.
6. The Settlers Canal is adjacent to the northern boundary of this lot.

7. As part of a planned unit development, a minimum often percent of the gross land area
of the lot must be open space (8,712 square feet).
The site plan contains no legend to show details of landscaping or other features.
9. A minimum of one (1) three-inch (3") caliper tree per 1,500 square feet of asphalt is
required for the entire lot.
GENERAL REQUIREMENTS
Any existing irrigation/drainage ditches adjacent to or crossing the property to be
included in this project shall be tiled per City Ordinance 11-9-605.M. Plans will need to
be approved by the appropriate irrigation/drainage district, or lateral users association,
with written confirmation of said approval submitted to the Public Works Department.
2. Any existing domestic wells and/or septic systems within this project will have to be
removed from their domestic service per City Ordinance Section 5-7-517. Wells may be
used for non-domestic purposes such as landscape irrigation.
3. Provide 5' wide sidewalks in accordance with City Ordinance Section 11-9-606.B.
4. Coordinate fire hydrant placement with the City of Meridian Public Works Department.
5. All drainage shall be retained on site per City Ordinance. Special attention needs to be
paid to the design due to shallow groundwater depth.
SITE SPECIFIC REQUIREMENTS:
1. Designer to coordinate sewer and water line sizing and routing with the Public Works
Department. Applicant shall be responsible for payment of sewer and water latecomers
fees at the time of building permit issuance.
2. Identify all existing ditch easements on the site plan. Show their location, width, and
proposal for relocation or piping. Provide information from Settlers Irrigation District
regarding the pipe size that would be required for this ditch. If the canal is not proposed
to be tiled, a waiver of the tiling requirement will need to be granted by the Meridian City
Council.
Provide calculations of asphalt and total landscaped area so conformance with Ordinance
requirements may be determined; revise site plan to comply.
4. Revise site plan to include legend and detailed landscape plan for review and approval.
5. Per Uniform Plumbing Code requirements, each building shall be served by independent
sewer and water services.

6. If a waiver of the tiling requirement is granted, permanent non-combustible fencing is to
be installed along the easement line for the Settlers Canal. Fencing is to be in place prior
to applying for building permits.
Staff recommends annexation and zoning of this parcel provided an acceptable site plan is
submitted for review and approval and all terms of the approved conditional use permit are met.

The Nampa & Meridian Irrigation District requires that a Land Use Change/Site
Development application be filed for review prior to final platting. Contact Donna
Moore at 466-7861 for further information.
All laterals and waste ways must be protected. All municipal surface drainage
must be retained on site. If any surface drainage leaves the site, the Nampa &
Meridian Irrigation District must review drainage plans. The developer must
comply with Idaho Code 31-3805. It is recommended that irrigation water be
made available to all developments within the Nampa & Meridian Irrigation
District.

Dear Jacksons:
Enclosed please find a Land Use Change Application for your use to file with the
Irrigation District for its review on the above-referenced development. If this
development is under a "rush° to be finalized, I would recommend that you submit a
cashier's check, money order or cash as payment of the fees in order to speed the
process up. If you submit a company or personal check, it must clear the bank before
processing the application.
Should this development be planning a pressure urban irrigation system that will be
owned, operated and maintained by the Irrigation District, I strongly urge you to
coordinate with John P. Anderson, Water Superintendent for the District, conceming the
installation of the pressure system. Enclosed is a questionnaire that you must fill out
and return in order to initiate the process of contractual agreements between the owner
or developer and the Irrigation District for the ownership, operation and maintenance of
the pressure urban irrigation system.

The Ada County Highway District (ACHD) staff has received and reviewed the application
and site plan for the item referenced above. This item will not be heard by the ACRD
Commission unless the site plan is changed in such a manner as to require Commission
review.
All future design plans and construction shall be in accordance with the Ada County
Highway District Policy Manual, ISPWC Standards and approved supplements, Construction
Services procedures and all applicable ACHD Ordinances unless specifically waived in
writing by the District.
Contact Ms. Joyce Newton for payment of possible road impact fees prior to building
construction in accordance with Ordinance #188, also known as Ada County Highway
District Road Impact Fee Ordinance.

INTRODUCTION
1 • The property is located north of Franklin Road, east of Eagle Road at
3420 Commercial Court, Meridian, Idaho.
2. The owner of record of the subject property is Jackson's Food Stores,
Inc. of 3500 Commercial Court, Meridian, Idaho.
3. Applicant is the owner of record.
4. The subject property is currently zoned Ada County Limited Industrial
(M-1). The proposed zoning designation is Meridian Light Industrial (I-L) The
zoning district of Lig11t Industrial (I-L) is defined within the City of Meridian Zoning
and Development Ordinance, Section 11-2-408(B)(14).
5. The proposed application requests a conditional use permit for a
Planned Unit development to allow construction of an office building. The I-L

zoning designation within the City of Meridian Zoning and Development Ordinance
requires a conditional use permit be obtained for most uses including those requested
by the Applicant. (Meridian City Zoning and Development Ordinance, Section 11-2-
409(B).
6. The use proposed within the subject application will in fact, constitute a
conditional use as determined by City Policy.
RECOMMENDATION
1. The Meridian Planning and Zoning Commission hereby recommends to
the City Council of the City of Meridian that they approve the conditional use
permit as requested by the applicant, subject to the following:
Adopt the Planning and Zoning Administrator and Assistant City Engineer
Recommendations as follows:
1.1 A minimum of ten percent of the gross land area of the lot shall be open
space 0,712 square feet).
1.2 A minimum of one (1) three-inch (3") caliper tree per 1,500 square feet
of asphalt is required for the entire lot.
1.3 Any existing irrigation/drainage ditches adjacent to or crossing the
property to be included in this project shall be tiled per City Ordinance
11 -9-605.M. Plans will need to be approved by the appropriate
irrigation drainage district, or lateral users association, with written
confirmation of said approval submitted to the Public Worlcs
Department.

1.4 Any existing domestic wells and/or septic systems within this project will
have to be removed from their domestic service per City Ordinance
Section 5-7-517. Wells may be used for non-domestic purposes such as
landscape irrigation.
1.5 Provide 5' wide sidewalks in accordance ~,vith City Ordinance Section
11-9-606(B).
1.6 Coordinate fire hydrant placement with the City of Meridian Public
Works Department.
1.7 All drainage shall be retained on site per City Ordinance. Special
attention needs to be paid to the design due to shallow groundwater
depth.
1.8 Sewer and water line sizing and routing shall be coordinated with the
Public Works Department. Applicant shall be responsible for payment
of sewer and water latecomers fees at the time of building permit
issuance.
1.9 Existing ditch easements shall be identified on the site plan including
location, width, and proposal for relocation or piping. Applicant shall
provide information from Settlers Irrigation District regarding the pipe
size that would be required for this ditch. If the canal is not proposed to
be tiled, a waiver of the tiling requirement will need to be granted by
the Meridian City Council.
1.10 Applicant shall revise the site plan to provide calculations of asphalt and
total landscaped area so conformance with Ordinance requirements may
be determined.
1.11 Site plan shall be revised to include legend and detailed landscape plan
for review and approval.
1.12 Per Uniform Plumbing Code requirements, each building shall be served
by independent sewer and water services.

Settlers Canal. Fencing is to be in place prior to applying for building_
permits.
1.14 Applicant shall construct a monument type sign only of no more than
50 sq.ft. having no flashing lights.
Adopt the Meridian Fire Department's Recommendations as follows:
1.15 Applicants shall satisfy all fire code requirements including those
pertaining to water flow and fire hydrants.
1.16 Applicant shall consult with Fire Dept. regarding addition of a fire
hydrant.
Adopt the Nampa & Meridian Irrigation District Recommendations as follows:
1.17 Requires all laterals and wasteways be protected.

The above entitled conditional use permit application having come before
the City Council on August 17, 1999, and Brad Hawkins-Clark, Assistant Planner for the
Planning and Zoning Department, presented the staff report, and the Applicant's
representative, Dale Binning, Architect for Jackson's Food Stores, Inc., having appeared
and testified in favor of the application and no one appearing in opposition, and the City
Council having received the staff report and the record made before the Planning and
Zoning Commission, and being fully advised in the premises, the Council finds and
concludes as follows:

FINDINGS OF FACT
A notice of a public hearing on the conditional use permit was
published for two (2) consecutive weeks prior to the said public hearing scheduled for
August 17, 1999, before the City Council, the first publication appearing and written
notice having been mailed to property owners or purchasers of record within three
hundred (300') feet of the external boundaries of the property under consideration
more than fifteen (15) days prior to said hearing and with the notice of public hearings
having been posted upon the property under consideration more than one ~veelc before
said hearing and the copies of all notices were made available to newspaper, radio and
television stations as public service announcements; and the matter having been duly
considered by the City Council at the said public hearing; and the Applicant, affected
property owners, and government subdivisions providing services within the planning
jurisdiction of the City of Meridian, having been given full opportunity to express
comments and submit evidence.
2. There has been compliance with all notice and hearing
requirements set forth in Idaho Code §§67-6509 and 67-6512; and §§11-2-416E and
11-2-418E as evidenced by the Affidavit of Mailing, and the Affidavit of Publication
and Proof of Posting filed with the staff report.

and all current zoning maps thereof and the Comprehensive Plan of the City of
Meridian adopted December 21, 1993 Ordinance #629 -January 4, 1994 and Maps
and the Ordinance establishing the Impact Area Boundary Ordinance and Map.
4. The property is located north of Franklin Road, east of Eagle Road
at 3420 Commercial Court, Meridian, Idaho.
5. The owner of record of the subject property is Jackson's Food
Stores, Inc., of 3500 Commercial Court, Meridian, Idaho.

include 2,000 square feet of storage/warehouse, with the remaining portion for offices.
The (I-L) Light Industrial zoning designation within the City of Meridian Zoning and
Development Ordinance requires a conditional use permit be obtained for most uses
including those requested by the Applicant. (Meridian City Zoning and Development
Ordinance, Section 11-2-409).

9. The use proposed within the subject application will in fact,
constitute a conditional use as determined by City Ordinance.
10. Giving due consideration to the comments received from the
governmental subdivisions providing services in the City of Meridian planning
jurisdiction, public facilities and services required by the proposed development will not
impose e.~pense upon the public if the following conditions of development are imposed
and the following is also found to be required to mitigate the effects of the proposed
use and development upon services delivered by political subdivisions providing
services to the subject real property within the planning jurisdiction of the City of
Meridian.
10.1 Conditions requested by the City of Meridian Planning and
Zoning Administrator and Assistant City Engineer within their
Memorandum dated July 9, 1999, be required as follows:
10.1.1 Sewer and water service to this site will be via existing
mains in Commercial Court.
10.1.2 The Settlers Canal is adjacent to the northern boundary of
this lot.
10.1.3 Any existing irrigation drainage ditches adjacent to or
crossing the property to be included in this project shall be
tiled per City Ordinance 11-9-605.M. Plans will need to be
approved by the appropriate irrigation/drainage district, or
lateral users association, with written confirmation of said
approval submitted to the Public Worlcs Department.

10.2 Recommendations requested by the Meridian Fire Department,
dated June 14, 1999, be required as follows:
10.2.1 Applicant shall satisfy all fire code requirements including
those pertaining to water flow and fire hydrants.
10.2.2Applicant shall consult with Fire Dept., regarding addition
of a fire hydrant.
10.3 Recommendations of the Nampa ~ Meridian Irrigation District in
their letter dated June 15, 1999, be required as follows:
10.3.1 Requires all laterals and waste ways be protected.
10.3.2A11 municipal surface drainage shall be retained on site. If
any surface drainage leaves the site, the Nampa & Meridian
Irrigation District must review drainage plans.
10.3.3Developer must comply with Idaho Code 31-3805.
11. The proposed uses within the subject application will be
harmonious with and in accordance with the Meridian Comprehensive Plan and the
City of Meridian Zoning and Development Ordinance. The Council refers to and
incorporates those Findings of Fact regarding the Comprehensive Plan as stated: "In the
Matter of the Application of Jackson's Food Stores, Inc.., the Application for
Annexation and Zoning of 2.0 Acres for Commerce Subdivision Lot 3, Case No. AZ-
99-011, Findings of Fact and Conclusions of Law and Decision and Order Granting
Application for Annexation and Zoning numbers 21.1 through 21.11 at pages 7 and 8
thereof, and which are incorporated herein by reference.

12. To assure that the uses proposed within the subject application
will be designed, constructed, operated and maintained to be harmonious and
appropriate in appearance or intended character of the general vicinity and that such
uses will not change the intended essential character of the same area, the same will be
subject to the conditions set forth herein as follows:
12.1 The application is for two buildings on one lot. City
Ordinance requires that more than one principal building on
a lot requires that the property be developed as a planned
development under the conditional use permit process.
12.2 Dale Binning, Project Architect, indicated that 2,000 sq. ft.
of the building is storage/warehouse, with the remainder to
be office space.
12.3 Parking spaces are shown at 18 feet instead of 19 feet
required by Ordinance. Due to the provisions of ten-foot-
wide sidewalks, staff reports the 18-foot dimension with
allowance given for bumper overhang.
12.4 As part of a planned unit development, a minimum of ten
percent of the gross land area of the lot must be open space
(8,712 square feet).
12.5 A minimum of one (1) three-inch (3") caliper tree per 1,500
square feet of asphalt is required for the entire lot.
12.6 Provide calculations of asphalt and total landscape area so
conformance with Ordinance requirements may be
determined; revise site plan to comply.
12.7 Revise site plan to include legend and detailed landscape
plan for review and approval.

12.8 That the development be in accordance generally with the
site plan submitted, denoted as: "Jackson's Food Stores
Office Building, Inc., dated August 11, 1999, Sheet S-1 d,
Dale Binning, Architect.
13. The uses proposed within the subject application will not be
hazardous or disturbing to existing or future neighboring uses.
14. The uses proposed within the subject application will be served
adequately by central public facilities and services such as highways, streets, police and
fire protection, drainage structures, refuse disposal, water, and sewer.
15. The uses proposed within the subject application will not involve
uses, activities, processes, materials, equipment and conditions of operation that will be
detrimental to any persons, property or the general welfare by reason of excessive
production of traffic, noise, smoke, fumes, glare or odors.
16. Sufficient off-street parking for the property and the proposed uses
of the property will be provided.
17. The development will not result in the destruction, loss or damage
of natural or scenic feature of major importance relating to the property.
CONCLUSIONS OF LAW
Idaho Code § 67-6512 provides in part that:

(A) As part of a zoning ordinance the City Council may provide for the
processing of applications for special or conditional use permits;
and
(B) That a special use permit may be granted to an applicant if the
proposed use is otherwise prohibited by the terms of the zoning
ordinance, but may be allowed with conditions under specific
provisions of the zoning ordinance, subject to the ability of
political subdivisions, including school districts, to provide services
for the proposed use, and when it is not in conflict with the plan;
and
(C) That upon the granting of a special use permit, conditions may be
attached to a special use permit, including, but not limited to,
those:
1) Minimizing adverse impact on other development;
2) Controlling the sequence and timing of development;
3) Controlling the duration of development;
4) Assuring that development is maintained properly;
5) Designating the exact location and nature of development;
requiring the provision for on-site or off-site public facilities
or services; requiring more restrictive standards than those
generally required in an ordinance; requiring mitigation of
effects of the proposed development upon service delivery
by any political subdivision, including school districts,
providing services within the planning jurisdiction.
2. The City of Meridian has exercised its authority to provide for the
processing of applications for Conditional Use Permits by the enactment of § 11-2-418
Municipal Code.

3. Idaho Code § 67-6504 provides that the City Council may exercise all of
the powers required and authorized by Chapter 65 of Title 67 Idaho Code which Act is
lc~zown as the "Local Land Use Planning Act of 1975."
4. As part of a zoning ordinance the City Council can, subject to hearing
and notice provision required, provide for the process of special and/or conditional use
permits which a proposed use is otherwise prohibited by the terms of the ordinance but
allowed with conditions under the specific provisions of the ordinance which the City
of Meridian has done in the adoption of its zoning ordinance.
5. Prior to granting a conditional use permit in a Light Industrial (I-L), a
public hearing shall be conducted with notice to be published and provided to property
owners or purchasers or record within three hundred feet (300') of the external
boundaries of the land under consideration for the conditional use permit all in
accordance with the provisions of Section 11-2-408(B)(14) City of Meridian Zoning
and Development Ordinance, which provides as follows:
(I-L~ LIGHT INDUSTRIAL: The purpose of the (I-L) Light Industrial District
is to provide for light industrial development and opportunities for employment
of Meridian citizens and area residents and reduce the need to commute to
neighboring cities; to encourage the development of manufacturing and
wholesale establishments which are clean, quiet and free of hazardous or
objectionable elements, such as noise, odor, dust, smoke or glare and that are
operated entirely or almost entirely within enclosed structures; to delineate areas
best suited for industrial development because of location, topography, existing
facilities and relationship to other land uses. This district must also be in such

6. Following the public hearing and within 45 days after the conclusion of
the public hearing the Commission shall transmit its recommendations to the Meridian
City Council with supportive reasons. The Commission shall recommend that the
application be approved, approved with conditions or denied. The Commission shall
ensure that any approval or approval with conditions of an application shall be in
accordance with Meridian Comprehensive Plan, City of Meridian Zoning and
Development Ordinance, and Idaho State law. (Section 11-2-408(B)(14), City of

granted the proposed application for a conditional use permit for the construction and
use of a new Jackson's 10,000 sq. ft. office building, which will include 2,000 sq. ft. of
storage/warehouse, with the remaining portion for offices, as described in the Site Plan,
denoted as: "Jackson's Food Stores Office Building, Inc., dated August 11, 1999, Sheet
S-1 d, Dale Binning, Architect, with the following conditions:
Adopt the Planning and Zoning Administrator and Assistant City Engineer
Recommendations as follows:
1.1 A minimum of ten percent of the gross land area of the lot shall be open
space (8,712 square feet).
1.2 A minimum of one (1) three-inch (3") caliper tree per 1,500 square feet of
asphalt is required for the entire lot.
1.3 Any existing irrigation/drainage ditches adjacent to or crossing the property
to be included in this project shall be tiled per City Ordinance 11 -9-605.M.
Plans will need to be approved by the appropriate irrigation/drainage
district, or lateral users association, with written confirmation of said
approval submitted to the Public Worlcs Department.
1.4 Any existing domestic wells and/or septic systems within this project v~~ill
have to be removed from their domestic service per City Ordinance Section
5-7-517. Wells may be used for non-domestic purposes such as landscape
irrigation.
1.5 Provide 5' wide sidewalks in accordance with City Ordinance Section 11-9-
606(B).

1.7 All drainage shall be retained on site per City Ordinance. Special attention
needs to be paid to the design due to shallow groundwater depth.
1.8 Sewer and water line sizing and routing shall be coordinated with the
Public Worlcs Department. Applicant shall be responsible for payment of
sewer and water latecomers fees at the time of building permit issuance.
1.9 Existing ditch easements shall be identified on the site plan including
location, width, and proposal for relocation or piping. Applicant shall
provide information from Settlers Irrigation District regarding the pipe size
that would be required for this ditch. If the canal is not proposed to be
tiled, a waiver of the tiling requirement will need to be granted by the
Meridian City Council.
1.10 Applicant shall revise the site plan to provide calculations of asphalt and
total landscaped area so conformance with Ordinance requirements maybe
determined.
1.11 Site plan shall be revised to include legend and detailed landscape plan for
review and approval.
1.12 Per Uniform Plumbing Code requirements, each building shall be served by
independent sewer and water services.
1.13 If a waiver of the tiling requirement is granted, permanent non-combustible
fencing is to be installed along the easement line for the Settlers Canal.
Fencing is to be in place prior to applying for building permits.
1.14 Applicant shall construct a morniment type sign only of no more than 50
sq. ft. having no flashing lights.

We do not have any concerns at this time with regard to them sharing the dumpster in

Re: Trash Enclosure on E. Commercial Parcel
I signed the card for Final Occupancy on this new building today. The approved Site Plan shows a
trash enclosure to be located at the NEC of the building but has been replaced with employee parking.
At Jackson's request, they are planning to use the same trash enclosure as Sherwin Williams,
immediately south of the Jackson's building on the same legal parcel, so will not need an enclosure of
their own. Steve Sedlecek with Sanitary Services Corporation is submitting a letter stating they
approve of the co-location.

Jackson's is proposing to construct an 18'x20' canopy at approx. 18' height at their Old-Town
location (existing Circle K). The canopy would be apre-fab job direct from the manufacturer, so
they do not have construction drawings available right now. Before they order the canopy, they
want to know if the location is suitable. They aze proposing a 1' 9" setback from the property
line, but the canopy has rounded corners, so it may actually be more. The SE corner of canopy
only has 1-foot clearance from the existing sign -are there potential wind load issues on this?
Please look it over and let me know if you see any potential problems with the proposed size and
