RECEIVED FEB 1 S 200 City of Meridian City Clerk t)ffics TO: Mayor DeWeerd and Members of the Meridian City Council 33 East Idaho Avenue Meridian, ID 83642 DATE: February 10, 2004 RE:' Saguaro Canyon Estates Recommendations Dear Mayor and Council: After reviewing the recommendation of the Meridian Planning and Zoning Commission we have prepared the following responses to the conditions found in the recommendation: Annexation Recommendatiods (AZ-03-027) A. Commission- 1. 'Applicant agrees., 2. Applicant asks that this condition' be removed. This condition requires a secondary access to be constructed on site prior to the issuance of a building permit for the 236`h .lot within the' subdivision. This requirement was not :requested, by the Fire Department for safety reasons, nor was; it requested by ACRD for traffic flow requirements related to the traffic study 'prepared for this subdivision at build out. The traffic study and ACHD agree that a secondary access is not warranted for this subdivision and the prior condition satisfies the fire access issue.- A secondazy access will more .than likely be created by the development of the adjacent land, with connections to the stub-streets .provided within Sag'uazo Canyon. The recommendation puts the developer of the, property at the mercy of the adjacent land owners/developers to provide a secondary access when one is not warranted. If this remains a requirement, we ask that the paving requirement be removed from the recommendation because the pavement for the access will, ultimately be torn out when the actual roadway is constructed. 3. Applicant agrees. B. Planning and Zoning Staff Recommendations (revised)- I. Applicanfagrees. 2. Applicant agrees, however the Public Works Department has indicated that a new well and septc system shall be permitted for the construction of a new single familg dwelling on the Boyack parcel (Lot34, Block 28). Applicant agrees. 4. Applicant agrees Conditional Use Permit Recommendations (CUP-03-058) A. Commission- 1. Applicant agrees. 2. 'Applicant agrees. 3. a) Applicant agrees. b) Revise conditions to reflect approval of a 6' wide detached sidewalk beginning at the collector roadway and extending to the east property line. Signage will be provided. This was discussed at the Public Hearing, but was not included in the motion. ~ c) Applicant agrees. 4: 'Applicant agrees. 5. Applicant agrees, however the minimum frontage proposed is now 24' wide for the public street frontage for the Boyack parcel. Discussions with planning staff have indicated support of this request. 6. Applicant agrees. 7. Applicant agrees. 8. Applicant agrees: _ B. Fire Department- _ 1: Applicant agrees. ` Preliminary Plat Recommendations (PP-03-32) A: Commission- 1. Applicant agrees. 2. Applicant agrees, (all weather gravel has been deemed acceptable to-the Fire Department). 3. - Applicant requests the removal of this conditiori. As noted above, the traffic study, ACRD, the Fire Department do not indicate a need for a secondary access prior to the construction of the 236th. building within the subdivision. Planning and Zoning Staff- , 1. Applicant agrees. 2. Applicant agrees. 3. Applicant agrees, and requests that no fence be .required along the McMillan frontage if the landscape berm is over eight feet in height. 4. Applicant agrees. 5. Applicant agrees, and will address this issue again for the. City Council. 6. Applicant agrees, however a 10' wide asphalt pathway has been approved by ACRD on the McMillar frontage in lieu of a standard concrete sidewalk. 7. Applicant. agrees, with the exclusion of the proposed septic' and well for the Boyack parcel. 8. " Additionally, we request that the second 'paragraph' be removed or revised, as noted above, in regazds to the secondary access road. 9. Applicant agrees, and requests the following modification: Add Fire Department turn-around requirements as submitted, approval of well and septic for one single family dwelling and require a different subdivision name for the final plat of the Boyack property because it will not contiguous to phase 1 of Saguaro Canyon (per Ada County requirement). 10. Applicant agrees, and will address issue at City Council hearing. 11: Applicant agrees, however, the 6' detached sidewalk portiori of the pathway will not meet the Pazks Pathway standards. Please revise this comment accordingly. 12. Applicant will correct plat. 13. Applicant agrees. C036316 Comm Response Letter 021004 14. Applicant agrees. 15. Applicant agrees, with-the exclusion of the Boyack pazcel, which will be recorded - with adifferent name, as it will-not be contiguous to the remainder to the plat until later phases of Saguaro. 16. Applicant Agrees. The applicant agrees with the remaining standard conditions and agency comments: Your staff and the Planning and Zoning Commission have been very helpful throughout the project and it appeazs that we have come to an agreement on almost all of the major issues related to its approval.
