and Cpuncil, by the City Engineer or his authorized representativeTherein called "CITY" and Primeland Development heroin called
"Developer",
NOW WHEREFORE, the parties borate agree as follows:
The City agrees to include with the White Drain Sanitary Sewer Tntnk 1?roject a bid unit price item far 4" sewer service
stubs. If the City's unlt bid price par each is less than ~ 125.00 the City will inel~tda twenty-four A" sewer service stubs with
the 'Ihu,k Line Project. The Developer shall reimbursement the City 52,400A0 payable to the City withu130 days of work
compie*aon. If the City's bid unit pride per each is greater than 5125.00, ar unreasonable, the 4" scwcr service stubs will not
be included in the City's Project. The City will allow the Developer the option to install 4" sewer service stubs at
Developer's expense. If the Developer chooses this option the City will direct their project Contractor to coordinate with the
Developer far installation of the Q" sewer service stubs. Coordination is anticipatmd to consist of the Gity°s Project
Gonti•actor not baelcfilling (leaving open) construeied trench segments, estimated at 250 lineal feet, for 24 hours to
acgommodate the Developer's Contractor m install the 4" sewer service stubs.
2. The ]]eveloper shall provide the Giry information on the horizontal atld vertical location of the 4" sewer service stubs ono
week prior to bidding.
IN WITNESS WHFIZEOF, the panties have executed this Contract the day and year first above written,
