Broadway Avenue Meridian, ID 83642 RE: Southern Highlands Subdivision - A~13-016, PP-13-033 Staff Report Comments Dear Sonya: On behalf of BHH Investments 1, LLC, this letter is to provide comments and clarification on the Staff Report provided on November 15, 2013 for the Southern Highlands Subdivision prior to our Planning Commission hearing on November 2 i, 2013: 1. Ci Park a. Section VII. The applicant proposes to deed a 3.6 acre park to the City of Meridian, not 7 acres. b. Section IX. B. City Park. The applicant proposes to deed a 3.6 acre park in the configuration as depicted on the submitted preliminary plat. The park land will be deeded at no cost to the City of Meridian and improved with half-street improvements, grading, 10' perimeter pathway and trees, sprinkler system, and hydroseed prior to the 120th building permit for the 79 acre site. Plans shall be reviewed and approved by the City of Meridian Parks Department prior to construction. The applicant is requesting improvement cost reimbursement with Park Impact Fee funds. c. Section 1.1.1. Site Specific Conditions of Approval. We request the first bullet condition be replaced with 1 b. above. 2. Mufti-Use Pathway and Eagle Road landscaaing a. Section IX.B. Multi-Use Pathway and Landscaping. The Ten Mile Creek and Eagle Road frontage improvements are not within the applicant's property and should be a condition of the development of the future 45 acre development upon future preliminary plat submittal, not as a condition of the first phase final plat of Southern Highlands located.'/: mile away. b. Section 1.1.1. Site Specific Conditions of Approval We request the deletion of the Multi-Use Pathway easement dedication item and the Eagle Road Landscaping item as requirements of the first phase final plat of Southern Highlands Subdivision. 3. Development Agreement. Section 1.1.1. Site Specific Conditions of Approval. The Development Agreement shall apply to the western 79 acres to be purchased by the Applicant only. The 12,000 SF lot minimum lot size, 2,000 minimum house size, and 162 lot maximum residential lot count shall be defined in the Development Agreement. We are requesting that the eastern 45 acre portion not be required to +~ have a Development Agreement. The 45 acre portion shall be developed with R-4 zoning standards in accordance with City Code and site specific conditions in conjunction with a future preliminary plat submittal. 4. Sewer. Section X. Exhibits. Whitebark Temporary Sanitary Sewer Plan. a> Page 4. We are requesting. that the Whitebark Temporary Sewer Plan be modified to include the entire 79 acres (1621ots) of the Southern Highlands Subdivision and exclude the portion south of Taconic Road. b. Page 5. Table 1. We are requesting the Service Area Table be modified to specifically list the 79 acres (162 lots) north of Taconic Road. c. Section 2.1.1. Public Works Site Specific Conditions of Approval. The condition specifies sewer permits will be allocated on a first-come, first serve basis. To be consistent with our Public Works discussions, we request the condition be clarified that the allocation of 1 b2 sewer permits will be vested to the 79 acre portion (162 lots) upon preliminary plat approval. Please include this letter in the documentation provided to StaiTand Planning Commissioners prior to our hearing on Thursday night.
