Linkershim Drive. Your approval of the subject application is conditioned upon ongoing compliance with the standards for home occupations listed in Unified Development Code (UDC) 11-4-3-21, including but not limited to, the following: A. In no way shall the home occupation cause the premises to differ from its residential character in the appearance, lighting, signs, or in the emission of noise, fumes, odors, vibrations, or electrical interference. B. The home occupation shall be conducted entirely in the dwelling, and not more than twenty-five percent (25%) of the gross floor area of said dwelling shall be used for a home occupation or for storing goods associated with the home occupation. No activity connected to the home occupation or any storage of goods, materials, or products connected with a home occupation shall be allowed in any detached accessory structure. D. The home occupation shall not have more than two (2) out -going pickups per day from a common carrier. E. The home occupation shall not serve as a headquarters or main office where employees come to the site and are dispatched to other locations. G. No retail sales shall be permitted from the dwelling except the sale of. a) services or items produced or fabricated on the premises as a result of the home occupation; or b) products secondarily related to the personal service aspect of the home occupation. H. Off-street parking shall be provided as set forth in UDC 11-3C-6, in addition to the required off-street parking for the dwelling. I. All visits by clients, customers, and/or employees shall occur between the hours of 8:00 a.m. and 8:00 p.m. J. The home occupation shall only be allowed as an accessory use to an allowed residential use. K. The home occupation shall only be allowed as an .accessory use to an allowed residential use. If you fail to maintain compliance with the above standards or limitations your approval may be revoked or modified by City Council in accord with UDC 11-1-11 D. The applicant, director, or a party of record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Department on or before May 30, 2013, within fifteen (15) days after the written decision is issued, and contain the information listed in UDC 11 -5A -6B. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. APPLICABLE CODE The property is zoned R-4, which allows for a home occupation with written approval from the Community Development Director. We understand licenses are not permitted in residential zoning to keep residents from opening a bar and preventing retail sales of beer and wine from homes. We understand the reasoning behind the ordinance and support it. We recently purchased an established on-line gift basket business called Creative Gift Baskets from a retiring couple in Garden City, Idaho. The three websites are www.idahogiftbaskets.net, www.idahowinebaskets.com & www.redneckgifts.net. We will take ownership May 9th. Our company will assemble, deliver and ship over 50 different types of gift baskets featuring gourmet Idaho foods and wines to retail and commercial businesses around the region. Some of the baskets contain beer or wine. The current business does not have, nor will we have, any type of store front or exterior advertising, and the business would be completely contained within our home. There will be no business related beer or wine consumed on the premises, and no direct sales from our home. In noway will our residence cause the premises to differ from its residential character. We are currently looking to be a part of the Entrepreneur Think -Tank Co-op (ETC) which is similar to a business incubator located in the old Meridian City Hall for occasional client meetings. With this in place, there will be no client meetings at our residence. Warriner Companies Inc has secured all other necessary permits and licenses to conduct a legitimate, legal business except a beer and wine license. Our hope is to market the business to the point we could purchase or rent a building in a commercial area to conduct business, but we simply are not there yet. We are asking for a conditional use permit or variance, as operating a gift basket business does not violate the intent of the beer and wine license restriction in residential zoning. Boise, Nampa and Garden City allow permits in residential areas as long as State, County, and Planning & Zoning allow them. We are the third owners of this 10 year old business, all of who operated out of their homes with no issues. We have lived and worked in Meridian for the past 8 years.
