It is the intent to permit home occupations in residential dwellings which do not change the appearance of the residence nor the
conditions of its residential character. The following conditions shall apply: (1) No person other than members of the family residing
on the premises shall be engaged in such operation; (2) The use of the dwelling unit for home occupation shall be clearly inci-
dental and subordinate to its use for residential purposes by its occupants and not more than twenty-five percent (25%) of floor
area of dwelling unit shall be used in the conduct of the home occupation; (3) No article shall be sold or offered for sale on the
premise except. such as is produced by the occupants on the premises and no mechanical or electrical equipment shall be installed
or maintained other than such as is customarily incidental to domestic use; (4) No significant traffic shall be generated by the con-
duct of such home occupation, and any need for parking generated by the conduct of such home occupation shall meet the off-
street parking requirements as specified in City Ordinance and shall not be located in a required front yard; (5) No equipment or
process shall be used in such home occupation which creates noise, vibration, glare, fumes, odor, or electrical interference
detectable to the normal senses off the lot if the occupation is conducted in a single family residence; (6) In no way shall the
appearance of the residence be altered nor the occupation be conducted in a manner which would cause the premises to differ from
its residential character in the use of construction, lighting, signs, and in the emission of noise, fumes, odors, vibrations or elec-
trical interference

The above entitled accessory use permit application having come before the
Meridian Planning 8c Zoning Commission on March 4, 2004, at the Meridian City Hall,
33 Eat Idaho Street, Meridian, Idaho, at the hour of 7:00 o'clock p.m., and the
Commission having received the report of Wendy Kirkpatrick of the Meridian City
Platming & Zoning Department, and Anna Powell Planning and Zoning Director, Wendy
Kirkpatrick of the Meridian City Planning 8t Zoning Department, the Applicant -Susan
Rice, and Charlene Rokovitz, appeared and testified, aad the Commission having duly
considered the matter makes the following Endings of Fact and Conclusions of Law and
Decision of Order.
FINDINGS OF FACT
1. The Commission takes judicial notice of the Meridian City Zoning, Subdivision
and Development Ordinances, codified at 11 Municipal Code of the City of Meridian and
all cwretrt coning maps tluneof and the amended Comprehensive Flan of the City of
Meridian adopted August 6, 2002, Resolution No. 02-382.

2. Staff has complied with the requirements of I.C. §§ 6?-b509, 67-6512, and §§ 11-
2, 11-3 end 11-9-4 of the Meridian City Code.
3. The Punning and Zoning Commission takes judicial notice of its zoning,
subdivisions and development ordinances codified at Tine i 1, Municipal Code of the
City of Meridian, and all cwrent zoning maps thereof; and the amended Comprehenssve
Plan of the City of Meridian adopted August 6, 2002, Resolution Na 02-382, and maps
and the ordinance Establishing the Impact Area Boundary.
4. 'fhe Applicant is Susan Rice, and the owner of record of the property- is Merlyn
Schmeckpeper.
S. The proposed location for tl~e Applicant's accessory use is located at 230 West
Pine Street, and is withis- an R-4 zone.
6. The principal permitted use of~the subject property is residential.
7. The proposed accessory use would be gr,~ for a bookkeeping office out of the
home looted at 230 W. Pine Street.
8: Applicant was presetrt at ttu March 4, 2004 Bearing before the Commission to
testify or to field pions and comments frnm the Commission.
9. The Commission received testimony from Charlene Rokovitz, owner of the
property located at 918 West 3'~ and whose son is presently a tenant of the property, and
which residence is hosted directly behind the subject property. Charlene Rokovitz
testified as to the illegtt operation of business being conducted out of the detached.garage
as well as the residence at 230 W. Pine Avenue, atong with noise and traffic issues, and
which her and her son have written letters of concern to the City in these matters, and

which are on file in the City Clerk's office, ~.'he Applicant also testified to her ovYn
opposition to the accessory use permit as well as that of her son and neighbors.
10. The Commission took into consideration letters of objection/opposition from
Charlene Rokovitz and Darrin Rokovitz, neighboring property owner and tenant located
~ the proper#y at 918 W. 3'~ Street.
CONCLUSIdNS OF LAW
1. That § 11-9-4 of the Meridian City Code establishes the factors involved in a
determination of the Commission as to whether to grant or dew an accessory use permit.
2. That-the provisions of §11-9-4 of the Meridian City Code apply to the present
application.
3. .That the accessary use of a residential property as a bookkeeping office is a use
that is habitually or commonly established as reasonably incidental under the
requirements of §11-9-4(A)(l) of the Meridian-City Code.
4. That a factor to be considered by the Conunission in its determination of an
Accessory Use application far a bookkeeping office is the potential adverse impact of
such accessory use up¢n adjacent Property. (§11-9 4(1)(e}}.
5. That the Applicant has provided sufficient proof to show that the requested
accessory use would not provide an adverse impact to other property in the affected area.
6. That the neighboring property owners have not provided sufl7cient evidence
before the Commission to show the probability that such a permit, if allowed, would have
an adverse impact to properties in the affected area.

NOW, TH~R~ORE, BASED UPON THE ABOVE-AND FOREGOING
FINDINGS OF FACT AND CONCLUSIONS OF LAW, AND GOOD CAUSE
APPEARING, the above named Applicant is hereby granted the Accessory Use Permit
for reasons stated above.
The Planning & Zoning Commission of the City of Meridian hereby adopts and
approves this Decision and Order Granting Accessory Uae Permit.
By action of the planning azut Zoning Commission at its regular meeting held on
the 4th day of March, 2004.

This is a letter of objection in response to the notice of application, dated Jan. 2,2004 for the
property at 230 West Pine, Meridian.
The objections are due to the fact that there is no one residing at this home as stated in the
application. I do not believe you can consider a person resides at a place who does not physically
live at the residence 7 days a week. Showing up mon-frt. during the day and leaving the lights on
all night to make it appear there is someone there and leaving a car parked behind the house just
shows what lengths they will go to to make it appear someone is there. However, these facts make
it a total misrepresentation of the application given to P&Z for a bookkeeping office being run out
of her home.
The only time there is someone at the house is on weekdays during work hours. Then the
bookkeeping business turns into something else altogether with trucks continually coming and
going throughout the day, loading and unloading supplies and equipment from the garage. While I
rely on my renter and son to keep me informed, there has been only a handful of times that I have
gone to my house on a week day during the daytime that the trucks were `not' unloading supplies in
the garage.
You said to give you proof, well I believe you have the proof in the meetings with the
Schmeclq~pers and the people who are working ILLEGALLY out of that house. You have been
informed by another neighbor as to the comings and goings for months that has not been legal. The
Mayor (both the old and new) has been contacted by the other neighbor and all to no avail with
false promises and veiled threats of shutting them down. They were told at the meeting that they
were to stop or they would be cited They have not stopped doing business on a daily basis nor
from my understanding have they been cited. Please, tell me why nothing has been followed up on
and action taken as was promised to the neighbor. If it were an average taxpayer and not a
contractor you would be following the letter of the law with the citations and no waivers of any
kind
The neighborhood has spoken in the past year on this property saying they did not want a business
operating out of there. The fact that they falsely filed for a bookkeeping business instead of
whatever the real business is does not change the facts that the neighbors in close proximity still do
not want a business run out of that house due to the extra noise and traffic. We will get into all of
that at the P&Z public hearing of application.
I am also enclosing a letter from my renter/son who lives next door to this house so you can get a
better understanding of what the activities are here.

1) The actual residence in this neighborhood have already spoken up about not wanting a business placed
where we live, in a prior action of the owner to place a business at his rental property.
2) The owner has rented and allowed a full business to be operated anyways, disregarding the neighbors
wishes,against the official rulings of the P&Z and Ciry Counsel and after being told by P&Z it needed
to stop all operations, continues to run their business out of the rental property.
3) There has been no party "living" at the residence (they have shown up early in the morning and left in
the evening). Lights being left on all night and a work truck being left onsite does not alter that the
parties have left each night and do not show up on weekends or holidays (further proves a business
n,nn_ninng, not a residence)
4) The business has banged aluminum ladders, doors, revved engines (while jump starting and other
times), brought dogs that are not leached which causes local fenced animals to bark at all hours and
caused other noises as early as Gam without any regard to the people who live here and are trying to
sleep.
5) This illegally operated business has increased the traffic flow in and out of the alleyway and on the
streets (they park everywhere) which further increases the danger to all the children who walk to
school each and every day.
This action is being falsely represented where no one resides at the address part time nor full time and we
want to keep our neighborhood a place to live, where our families can live peacefully without the noise
and interruptions and where the kids can walk to school as safely as possible, not a business zone.

NOTICE OF APPLICATION
NOTICE IS HEREBY GIVEN, pursuant to the Ordinances of the City of Meridian
and the laws of the State of Idaho, that Susan Rice has filed with the Zoning
Administrator of the City of Meridian an application for an Accessory Use Permit
for the operation of a bookkeeping office out of her home at 230 West Pine
Avenue, Meridian, Idaho. Comments, either for or against, said application must
be filed with the Zoning Administrator within fifteen (15) days after the initial
publication of this notice and shall be addressed to Anna Borchers Powell,
Zoning Administrator, City of Meridian, 660 E. Watertower Ln., Suite #202,
Meridian, Idaho. If there are objections filed within the time allowed, the Planning
and Zoning Commission shall hold a public hearing on the application, after
proper notice, and may grant or deny the application after making and adopting
Findings of Fact and Conclusions of Law.
The property at 230 West Pine Avenue is more particularly described as
Lot 13 -16 inclusive in Block 3 of NIDAYS Addition, Meridian, Ada County, Idaho.
Any and all interested persons are welcome and invited to submit

Friday and today 1 saw no activity of any kind there. Both trucks are gone (a first) and no one is answering the
door, so it would appear that the secretary who was working there doesn't any more. 1 will continue to keep a
watch on this property and will advise if the situation changes.

I have not received anything in writing from patrol yet. I asked for it by tomorrow at
the latest. I also requested a contact this afternoon by patrol at the residence. In
reviewing the applications for the next comments meeting I noted we had RZ 04-001 and CUP
04-005 up for comment. These seem to directly address the issue. CUP 04-005 is an
application by Seal Co. to operate an accounting office and dispatch office. The page
noted as Item 13 attached to the application seems to sum up the intent of Seal Co. in
terms of placing their operation on the property. Not much of a surprise given they
already seem to be there operating out of the garage.
It is my opinion the submittal of the new applications establish the prior application AUP
03-021 for a residential home business is not accurate and could be construed as being
misleading. The new applications confirm intent to seek rezoning of a residential for
commercial purposes and applied for in the GUP.
I hope to have additional for you tomorrow regarding the current state. However, it is my
impression that if Susan Rice is affiliated with or contracted by Seal Co. the application
as submitted in AUP 03-021 may be fraudulent in nature -this given the submittal of the
subsequent applications RZ 04-001 and CUP 04-005.

2/25/04 at 1230 hrs.
Lt. Bob Stowe observed a silver Chrysler PT Cruiser, lic # PACKLDR parked in the
driveway near the garage at 230 w. Pine. A blue Ford Thunderbird, lic. #lA BN739 was
parked along the north side of the house in the dirt lot at the saw time.
2/26/04 0630 hrs.
Officer hick Murphy observed a white Ford F150 pickup, lic. # lA EV781 drive into the
driveway at 230 W. Pine. At approx. 0635 a second white Foxd F150 with a ladder rack,
lic. # KE5082, pulled into the drive as well. The drivers were seen going urto the
garage. A box was seen loaded into the second pickup. The men then went to the back
door of the residence. They went into the residence for a bit and then came back out to
the garage. They left shortly thereafter.
2/26/04 0'715 hrs.
As I drove past 230 W. Pine and noted the car I had seen there last evening at
approximately 1900 hrs. parked along the north curb was still there. The lic # 1 A
BI-I297. I also noticed a white Ford Ranger pickup with a ladder rack pulling into the
driveway as I drove by. I circled the block and returned to W. Fine and 3rd. I parked
along the south curb across the street from 230 W. Pine. As I was in the process of doing
this a white car with an adult male driver pulled up and parked along the north curb, The
drive of the car wallced up and met the driver of the pickup, They had opened the garage
door on the south side of the garage building. They then opened the SE overhead door of
the garage from inside. They walked out to the truck and took a few small boxes out and
went into the garage. I did not see much more activity until 4'731 hrs.
At 0731 hours a white Ford F150 pickup with Seal Co written in red on the side and a
ladder rack pulled into the driveway and stopped next to the other pickup in front of the
garage. An aduh male got out of the pick up and met with the other two men. They
began to unload what appeared to be orange cooler 5 gallon paurt type cans from one of
the trucks and take them in to the garage. Then they unloaded some smaller packages
and a reddish colored ladder which was taken into the garage.
A short time later they started loading some small boxes into the ranger pickup. The men
chatted for a bit and then they started to close up the garage doors. The man that had
driven his car and parked it curbside wallced back to his car. He got into the driver's area
and took out a coffee mug. He then opened the trunk and took out a hard hat and a heavy
blue colored coat. He closed up his car and walked back up to the garage. The men then
loaded up into the pickups and drove out of the drive heading east on Pine.
I then drove away, too.
0810 hrs.
I met with Lt. Stowe at the Meridian Police department and he provided me with the
information noted earlier. Ike also gave me a note from Officer Murphy which indicated
Oi~cer Murphy had talked to Corporal Parsons about this residence. Cpl. Parsons told
Off. Murphy that he had been out at that residence about a month ago on an early
morning noise complaint. Cpl. Parsons made contact with a man about the noise. The
man was an employee of a roofing business called Seal Co. - Note I do not have a date
for this contact.
Conclusions from Information:
Based on the information I received from Lt. Stow and Officer Murphy coupled with my
own observation this morning at 230 W. Pine there is a business being operated out of the
detached garage located at the residence. This an apparent violation of City of Meridian
zoning requirements.
The white pickups and the PT Cruiser are all registered to Mike and/or Paula De Vaney.
On application CUP 04-005 Paula De Vaney is listed as the President of Seal Co. One of
the pickups (1A CJ322) shows 230 W. Pine as the address of the registered owner,
The blue Ford Thunderbird is registered to Susan Rice the applicant in AUP 03-021.

I was not able to make the meeting due to my work schedule but understood that written testimony was
taken into account as well as given in person.
I would like to voice my objection to the allowance of a business permidlicense to be granted for the
location of 230 West Pine Street for the bookkeeping that has been applied for as well as any other
business.
The residences in the immediate vicinity of the property have voiced their opinion in the past, objecting to a
business being granted or allowed to operate at 230 West Pine Street, where we live there. Some of the
reasons stated, which are still very valid, are the increase in traffic, the danger to the children who walk that
route ever day, and the disruption to our neighborhood where we live. Since then my kids and I have had
to deal with being harassed (an attorney was/is involved). A business being ran illegally out of the
residence that is neither licensed, zoned nor been approved for such action. Loss of sleep from the noise
from the illegally ran business. Because of the noise from the workers, loading/unloading their vehicles as
early as Sam and waking the kids and myself up repeatedly, the police have been called multiple times but
because of being tied up with other issues have not been able to catch the workers at the residence, however
have said they would try to run license plates and contact the owner of the business (Seals) and advise this
must stop. They also mentioned that code enforcement should be made aware of the fact a business is
operating in a residence area. This is just to name a few items caused from the actions of a business (albeit
being illegally operated where it does not have apermit/license nor zoning for such activity). If this is an
indication of how "our"neighborhood is going to be respected and how we will be treated as good
neighbors then granting ~ license will only compound the problem. There is little regard and no respect
for the people who live in the neighborhood, for the planning and zoning committee and city counsel
members and the rulings they make when one person can ignore the rulings, laws and ordinances and
operate a business without any consequences.
I have tried to contact the code enforcement -Joe Vetterman, and the Mayor of Meridian, both offices
promising I would be called back by the officials but I have not heard any word. I know.other residences
have reported the illegal operation of the business at the above address, with many promises of
notifications, citings and the cease of operation would happen and yet after many months of the known
operation of the business, it continues without any consequences.
The application of the permit is only a ploy and has been falsely presented given the fact that until the time
of the objections being filed there were NO people living at 230 West Pine Street. The only activity was the
coming and going of vehicles (a partial list of the many that constantly access the house/property is
provided) during business hours. Tactics such as parking cars and leaving them, and turning on lights in
the house were used but each night during the week all of the people left and did not come back until the
next morning. Holidays and weekends the place remained closed and no one came or left. I've also
attached a sample of the logs that show the activity. Keep in mind the logs only show what happened twice
a day, when I was leaving for work or coming home. I did not go out of my way to watch the place and yet
was able to notice a significant amount of activity.
In closing I ask you deny any permits for a business as it has been misrepresented, claiming false facts such
the house being the persons residence. This is just a shadow of the real intent which is and has always
been the running of a FULL business (which already has been occuring for months), including the coming
and going of vehicles, storage, dropping off and picking up of materials and other related dealings.
Would you want someone to move into your neighborhood where you live and disrupt your families lives,
activities and sleep as described?
