I have a couple of concerns. These include: 1. Hours the day care will be open and are weekends included?, 2. The letter states five or fewer kids does this include her own children? 3. The next door neighbors have 2 large dogs that bark when you get near the fence. I am concerned that the kids will taunt the dogs and make them bark more, increasing the noise level of our quiet neighborhood. Stonebridge Dr, Meridian, Idaho. The notice is dated for April 9, 2004. The family day care that is being requested has already been in operation since March 29, of 2004. We had no advance notice of this occurring. The request states that it is for five or fewer children. We live next door and have counted up to seven children on one occasion. We have noticed an increase in traffic at several times during the day due to the parents dropping off and picking up their children. This causes an increased risk for the children who live in the neighborhood. In the past, during the summer when the sprinklers are on, the back half of the yard remains flooded for the whole summer under 4 to 6" inches of water. Unless this was fined as part of the sale on March 25, 2004 this remains a hazard for anyone that uses the home. This is a hazard to all of those children, as well as everyone else; due to the great increase in mosquitoes and the bad water. Children might find themselves drinking or drowning in the water. Lisa Eichler also works an occasional night shift and has to sleep during the day. The increased traffic and noise make this very difficult. Day Cares have also been known to adversely affect property values. If and when we should decide to sell our house, it could be hard to find buyers that want to move in next to a Day Care. Would HB 256aa (sections 67-8002, 8003, Idaho code) be an issue in this problem? Article 4.4 in our Declaration of Covenants, Conditions and Restrictions for Macaile Meadows contains a Deed Restriction in a Corporate Warranty Deed recorded the 31 ' day of October 2001 with the Ada County Recorder as instrument No. 101114300. This deed restriction clearly states that residents are for residential purposes only and no commercial use is to be permitted. The buyers of the above property on or before March 25th 2004 when the property closed were given the CC&R's and should have signed an agreement acknowledging their receiving and understanding of CC&R's for Macaile Meadows. Attached you will find a notice to Sarah Morris of 4174 E. Stonebridge, Meridian, Idaho regarding the violation of CC&R's. Attached you will also find an email sent to the Board of directors for Macaile Meadows about the Day Care. Mr. and Mrs. Jeff Morris have indicated a great desire to try and come to an agreement that we can all agree too. We too would like to settle this manner'in a peaceful way so that we can come to enjoy our new neighbors. We would like to suggest that Sarah Morris is given an Accessory Use Permit with the following conditions. The permit is a restrictive permit with a stipulation that she can never expand her Day Care and seek after State License allowing her to have more kids. We would also like to know the conditions of what kids count in the Day Care. The Morris's have two small children already. We would also like to know what happens if Sarah Morris violates the permit. If these conditions are met we will welcome the Day Care into our neighborhood. Stonebridge Dr. Meridian, Idaho 83642 As per Article 2.3 of above CC&R's which deals with enforcement of said covenants you are hereby notified that you are in violation of said CC&R's. This is to be understood to include a Day Care business run out of a home. Article 11.8 of the CC&R's also gives owners the right of enforcement on non- compliance issues. As the home was purchased on March 25, of 2004 the owners of this property were presented with CC&R's and then signed an agreement at that time to follow the conditions of the CC&R's. Home was purchased with a complete knowledge that a commercial business is not allowed. It is noted that on the weekend after you had moved into the residence that a day care was then established on your premises in violation of the CC&R's. It has also been noted that the number of children in the daycare has been at seven or greater on all weekdays in violation of the Ordinances of the City of Meridian and the laws of the State of Idaho. We have been informed by the City of Meridian of your application for an Accessory Use Permit for the operation of a Family Day Care on April 9, 2004 weeks after the Day Care had already been established. On March 30, 2004 the Board of Directors for Macaile Meadows was informed of your Day Care operating at 4174 E. Stonebridge.
