HomeMy WebLinkAboutMartin, Sherrie AUP 02-007~ ^ ~ BEFORE THE MERIDIAN-CITY PLANNING AND ZONING COMMISSION IN THE MATTER OF THE REQUEST FOR AN ACCESSORY ) USE PERNIIT FOR A FAMII.Y DAYCARE ) IN AN R 4 ZONE FOR SHERRIE MARTIN, - ) 2215 EAST MACKAY COURT, ) MERIDIAN, IDAHO ) Case No. AUP-02-007 FINDINGS OF FACT AND CONCLUSIONS OF LAW AND ORDER OF DENIAL OF APPLICATION FOR ACCESSORY USE PERNIIT The above entitled accessory use permit application having come before the Meridian Planning & Zoning Commission on October 17, 2002, at the Meridian City Hall, 33 East Idaho Street, Meridian, Idaho, at the hour of 7:00 o'clock p.m., and the Commission having received the report of David McKinnon of the Meridian City Planning & Zoning Department, and David McKinnon and Andy Tessman, appeared and testified, and the Commission having duly considered the matter makes the following findings of Fact and Conclusions of Law and Decision of Order. FINDINGS OF FACT 1. The Commission takes judicial notice of the Meridian City Zoning, Subdivision and Development Ordinances, codified at 11 Municipal Code of the City of Meridian and all current zoning maps thereof and the amended Comprehensive Plan of the City of Meridian adopted August 6, 2002, Resolution No. 02-382. 2. Staff has complied with the requirements of I.C. §§ 67-6509, 67-6512, and §§ 11- 2, 11-3 and 11-9-4 of the Meridian City Code. DENIAL OF ACCESSORY USE PERMIT FOR SF[ERRIE MARTIN / 2215 E. MACKAY COURT /"~ 3. The Planning and Zoning Commission takes judicial notice of its zoning, subdivisions and development ordinances codified at Title 11, Municipal Code of the City of Meridian, and all current zoting maps thereof, and the amended Comprehensive Plan of the City of Meridian adopted August 6, 2002, Resolution No. 02-382, and maps and the ordinance Establishing the Impact Area Boundary. 4. The applicant/owner is Sherrie Martin whose address is 2215 E. MacKay Court, Meridian, Idaho. 5. The proposed location for the Applicant's accessory use is located at 2215 East MacKay Court, and is within an R-4 zone. The property on which the desired accessory use is located is surrounded entirely by residential use property and is located within the Sherbrooke Hollows Subdivision, all within R-4 zoning. 6. The principal permitted use of the subject property is residential. 7. The proposed accessory use would be a daycare which would be contained within Applicant's residence. The proposed daycare would serve up to five (5) children per day. 8. Applicant was not present at the October 17, 2002 hearing before the Commission to testify or to field questions and comments from the Commission. 9. The Commission received testimony from Mr. Andy Tessman, President of the Sherbrooke Hollows Homeowner's Association. Mr. Tessman testified as to his own opposition to the accessory use permit as well as that of his neighbors and constituents. These objections to the issuance of the permit were based on the perceived incompatibility of a daycare in the Sherbrooke Hollows Subdivision. 10. The Commission took into consideration letters of objection/opposition from Evelyn Tseua, and Paul & Sharron Lewis, neighboring property owners. DENIAL OF ACCESSORY USE PERMIT FOR SHERRIE MARTIN / 2215 E. MACKAY COURT 2 ~~ CONCLUSIONS OF LAW 1. That § 11-9-4 of the Meridian City Code establishes the factors involved in a determination of the Commission as to whether to grant or deny an accessory use permit. 2. That the provisions of §11-9-4 of the Meridian City Code apply to the present application. 3. That the accessory use of a residential property as a day care for up to five (5) children per day is a use that is habitually or commonly established as reasonably incidental under the requirements of §11-9-4(A)(1) ofthe Meridian City Code. 4. That a factor to be considered by the Commission in its determination of an Accessory Use application for a day care facility is the potential adverse impact of such accessory use upon adjacent property. (§11-9-4(1)(e)). 5. That the Applicant has not provided sufficient proof to show that the requested accessory use would not be an adverse impact to other property in the affected area. 6. That the neighboring property owners have provided sufficient evidence before the Commission to show the probability that such a permit, if allowed, would have an adverse impact to properties in the affected area. ORDER OF DENIAL OF APPLICATION NOW, THEREFORE, BASED UPON THE ABOVE AND FOREGOING FINDINGS OF FACT AND CONCLUSIONS OF LAW, AND GOOD CAUSE APPEARING, the above named Applicant is denied the Accessory Use Permit for reasons stated above. Mackay Court, in the Sherbrooke Hollows Subdivision, located in a R-4 Zone, by Sherrie Martin (File No.AUP-02-007). We have reviewed the above referenced submittals and offer the following comments, as conditions of approval. These conditions shall be considered in full, unless expressly modified or deleted by motion of the Meridian City Council: APPLICATION SUMMARY The applicant, Sherrie Martin, has requested approval of an Accessory Use Permit (AUP) for the establishment of a "Family Childcare Home" in order to care for up to five children per day at 2215 E. Mackay Ct., in the Sherbrooke Hollows Subdivision. The Planning and Zoning Commission is required to hold a hearing for an AUP if there are any objections that have been filed concerning the application. Objections to the proposed AUP are required to be submitted within a 15-day comment period that begins on the first day of notice publication in the Valley News. The planning and zoning staff has received three (3) objections to the proposed daycare at this location within the aforementioned 15-day timeframe. Ordinances pertaining to Accessory Use Permits and "Family Childcare Homes" are located in sections 11-9-4A and 11-9-4B2 of the MCC. LOCATION The property is located at 2215 E. Mackay Ct., approximately 1/8th of a mile north of Victory Road and %Z a mile east of Locust Grove. ADDITIONAL BACKGROUND INFORMATION Family Childcare Home Standards (MCC 11-9-4B2)- The following standards are listed as minimum requirements for the establishment of a Family Childcare Home: AUP-02-007 Shortie Marlin AUP Planning & Zan^Commission/Myor & City Council September 30, 2002 Page 2 a. Secure and maintain a childcare license. from the Idaho. State Department of Health and Welfare, Childcaze Licensing Division, if required. b. Acquire an occupancy certificate and/or building permit. c. Provide one off-street parking space per employee which maybe in the driveway of the home. d. Provide for child pickup azea located off of arterial or collector streets. e. Provide for screening of adjacent properties to protect children from adverse impacts and to provide a buffer between properties. f. Provide a fence of appropriate height/construction, to enclose play areas, protection children from traffic on arterial or collector streets. Staff finds that the applicant is in the process of obtaining a childcaze license from the State of Idaho, and that the submitted site plan provides the required parking, pickup azea, fencing and screening. Letters of Objection- As mentioned above, staff has received three (3) letters of objection to the proposed daycare. The objections stem from the fact that the subdivision's CC&Rs prohibit home occupations, and that the applicant's home is allegedly being used for another home occupation (a painting business) with several employees (in violation of the MCC). The City does not have record of the issuance of an Accessory Use Permit for a home occupation at this address. City Code Enforcement has been made aware of the alleged illegal painting business. If it can be determined that there is another home occupation currently operatin from this address, the existing home occupation will require an AUP pursuant to the requirements of the MCC. The City is not responsible for the enforcement of individual subdivision CC&Rs. The Home Owners Association is the agency that is responsible for the implementation and enforcement of the Sherbrooke Hollows Subdivision CC&Rs. RECOMMENDATION Staff recommends that the Planning and Zoning Commission consider the public testimony (written and verbal) presented during the public hearing in order to determine if the proposed daycaze use will adversely affect other properties in the general vicinity. Mackay Court SEP 2 4 200 City of Meridian City Clerk Office The Ada County Highway District (ACHD) staff has received and reviewed the application and site plan for the item referenced above. The ACHD Commission will not heaz this item unless the site plan is changed in such a manner as to require Commission review. However, ACHD receives many calls from neighbors of day Gaze center concerning the volume of traffic and the number of pazked vehicles neaz existing day caze centers. Each parent typically makes two round trips per day (i.e. four one-way trips). The Institute of Transportation Engineers (ITE) data show that a typical day Gazes created 4.52 vehicle trips per day per student. The proposed 5-student facility can be expected to generate 23 total vehicle trips per day. All future design plans and construction shall be in accordance with the Ada County Highway District Policy Manual, ISPWC Standazds and approved supplements, Construction Services procedures and all applicable ACHD Ordinances unless specifically waived in writing by the District. Mackay Ct., Meridian, ID 83642. There is already a business being run out of that address with at least three employees corning to the house and leaving their cars parked there all day. Sometimes as long as twelve hours a day and occasionally on Saturdays. I believe that an additional ~ cars, twice a day we add too much congestion. Mr. Martin is a Painting Contractor and keeps his equipment, supplies and work trucks at this address. Also, they have three (3) employees that meet at the house daily leaving their personal cars parked on the street in front of the Martin's during the day while they are working (which we believe is against Homeowners Association CC&R`s). Sometimes these cars are there as long as 12 hours a day. One car already pazks in front of the mailbox and one of the other cars has been there without moving for at least the past three weeks. We believe that with 5 additional cars coming and going twice each day would add congestion to their house that is already busy in the mornings and evenings. T'he three cars that aze already pazked there during the day would leave no option but for the possible 5 additional cars a day to have to park in front of other neighborhood houses. If the daycare parents were to be dropping off children before the workers arrive, this would make the workers cars have to be parked in front of someone else's house and be left there all day. Also, the Martin's have three children of their own, with the possibility of five additional children, making eight children in the house and outside would add noise and the possibility of many children playing in the street. Our neighborhood is an even combination of families and retired individuals and is, thus faz, a very quiet neighborhood. We believe that two business being operated out of one private residence would be too much due to the tra,J,)Rc congestion that would be added to our Court.
