Muscovy Avenue, Meridian, Idaho. I would like to announce my objection to granting this permit. Since Mr. Gomez has been a back -yard neighbor to me, I have endured piles of cigarette butts flicked into my back yard, two "lean- to" structures that are an eye -sore that stand against my fence, as well as a flooded backyard due to his inability to regulate his irrigation system. All of this is very disheartening to a 7 -year member of Mallard Landing Subdivision, who enjoys the orderly lifestyle that the CC&R's afford complying members. Therefore, I vehemently object to allowing Mr. Gomez to continue to ignore the standards of living set forth by our sudivision by parking various vehicles at this address. I do not believe that this use permit is appropriate for this subdivision. The owner currently has a landscaping business, parks his vehicles on the street, has people (workers) milling about in the front yard in the mornings, and often has as many as 5 autos on the street, day and nite. He now has a "taco wagon" parked beside his garage in the front and it overhangs the sidewalk. I have recommended that he park his vehicles in a storage yard like most businesses, with no action. He has been subject to the actions of the "abandoned vehicles" dept of Meridian. If there is a hearing, I would like to attend, hopefully it is in the morning so I can attend as I am a small business owner myself and time off is not easy in the afternoons. Thanks for the notification, as this situation has not been fun for the local residents. MERIDIAN, IDAHO 83642 Dear Ramon Gomez, The Board of Directors of MALLARD LANDING HOA requested this letter to be sent to you in response to your letter to the City of Meridian for a special use permit for the catering truck/mobile food stand vehicle located at 711 S. MUSCOVY AVE. After the last board meeting, the board recommended to deny your plans for a special use permit for the catering truck/mobile food stand vehicle. The Board asks that a letter notifying you of the violation of Mallard landings Codes Covenants and Restrictions if this vehicle is not removed from the subdivision. A copy of this letter has been sent to the City of Meridian letting them know that even if the City grants this permit to you, the association will continue the legal enforcement through Neal & UHL PLLC to force you to remove this vehicle. If the thought process of this a special use permit for the catering truck/mobile food stand vehicle it to short circuit the enforcement of Mallard Landings CCRs, you will be mistaken. Remove the vehicle from the subdivision before your legal expenses grow out of hand. You have been sent numerous letters about many problems on your property, followed up with certified mail, and now you have forced the association to take this to a legal matter. Muscovy Avenue. I am writing to express some of the concerns I have regarding this request. Mr. Gomez is already currently operating a landscaping business from his home and appears to have employees coming and going from his dwelling for business purposes. I am concerned that adding the vending truck will further increase the traffic in our residential area. Since there appears to be more than one family living in the home and there is already one business being operated at this home, there is already a considerable amount of traffic related to that dwelling. Additionally, since the vending truck arrived at Mr. Gomez's home about a month ago, it has routinely been parked in a manner that it blocks the sidewalk, forcing pedestrians out into the street. Furthermore, I have seen people working on the truck drain some type of liquid into the street. I don't feel that these actions are conducive to an inviting family atmosphere and I believe the numerous vehicles, including the landscaping trailer and vending truck, along with the excessive amount of oil that they have leaked out onto the street, detract from the visual appeal and therefore overall value of my property. I respect that Mr. Gomez is working hard to provide for his family as a small business entrepreneur. Should you decide to grant Mr. Gomez's request, please consider requiring him to park his vending truck and landscaping trailer behind his fence as required in our home owners' association CC&Rs. I know that it wasn't until the HOA board of directors sent him several CC&R violation letters that he started parking his trailer behind the fence. Until then it was regularly parked in front of the house. I appreciated your letter providing me with the opportunity to express my views on this matter. In conclusion I just want to say that my wife and I chose to purchase a home in Meridian and in this specific neighborhood because we believed it was the type of quiet, clean, residential area we wanted to raise our family. Please don't allow businesses to destroy our residential neighborhood with unsightly large trucks and trailers, increased traffic and business employees who do not live in, or have any reason to be in, our neighborhood every day.
