I am writing on behalf of my client, the Settlers Irrigation District ("Settlers"), concerning the
above referenced matter. Settlers recently became awaze of the fact that the Sundance Place
Subdivision is representing to the City of Meridian that it intends to utilize a pressurized urban
irrigation system to be owned and operated by the Nampa & Meridian Irrigation District. I
have enclosed copies of documentation which demonstrates this fact, See, The Nampa &
Meridian Irritation District Questionnaire for Construction Contract for the Pressurized Urban
Irrigation System dated February 3, 2004.
This documentation conflicts directly with the representation made in the request for
Subdivision Approval Final Plat Application, item 13.e., indicating that the Sundance Place
Homeowners Association will own and operate the pressurized irrigation system in the
development. You will also note that the imtation district listed as Nampa & Meridian
Irrigation District is incorrect (copy enclosed). In fact, this land is located almost entirely
within the Settlers Irrigation District boundaries. Because of this fact, the Settlers Board
believes it is essential that you be advised that Nampa & Meridian Irrgation District has no
legal authority to own and operate a pressurized urban irrigation system within the boundaries
of Settlers Irrigation District unless a mutually agreeable contract authorizing such action has
been executed by both Districts and the land owner, pursuant to Idaho Code section 43-330G.
Despite the best efforts of Settlers and Nampa & Meridian Irrigation District to negotiate such a
mutually agreeable contract, none was agreed upon by the two Districts and the land owner.
Idaho Code section 43-330A provides authority for an irrigation district to enter into contracts

with the owners of property for construction and operation of a pressurized system only with
property located within an irrigation district.
Consequently, Settlers believes that Meridian City approval of this development which affirms
or allows construction and the operation and ownership of such a system by Nampa & Meridian
Irrigation District within Settlers boundaries would be based upon an unauthorized, illegal
contract.
In short, Nampa & Meridian Irrigation District has no authority to levy assessments for the
operation of a pressurized urban irrigation system within the boundaries of the Settlers
Irrigation District, unless Settlers consents to such an arrangement pursuant to a contract
entered into under the specific authority of Idaho Code section 43-330G. In fact, even in that
circumstance, the statute specifically states:
...the contract ...shall provide that all assessments for
construction costs and for costs of operation, maintenance, repair
and replacement against any tract of land included in the contract
shall be levied and collected by the district in which that tract is
located.
Because of the difficulties involved with negotiations of an acceptable contact among Settlers,
Nampa & Meridian Irrigation District and the developer, Settlers believes that there is a
possibi]ity chat efforts may be made to obtain approval from the City of Meridian, incorporating
the pressurized urban irrigation system operation, maintenance, and ownership by Nampa &
Meridian Irrigation District. As the elected representatives of the land owners within Settlers,
the Boazd of Dtrectors is very concerned that the City of Meridian should exercise its
governmental authorities to approve this development only on the basis of appropriate, legal
arrangements. It is Settlers position that should an illegal contract for ownership, operation and
maintenance of the pressurized irrigation system be entered into with Nampa & Meridian
Irrigation District and assessments be sent to the property owners who will purchase lots within
this development, it will create a substantial dispute with public relations problems and liability
exposure for all involved entities. Settlers hopes that the City of Meridian will exercise its
discretion and avoid such a consequence in its decision process involving this development.
Settlers believes that the only legal resolution to this matter will involve a contract among
Settlers, Nampa & Meridian Imgation District, and the developer of the property or a condition
of approval of the final plat which requires the ownership, operation, and maintenance of a
pressurized irrigation urban system by the homeowners association.

1. The proposed steers, curbs, gutters and sidewalks will be constnscted to standards as
required by Ada County Aighway District and Meridian Gity Ordinance. Dimensions will be
determined by the City Engineer. All sidewalks will be five (5) feet in width unless
otherwise approved.
2. The proposed development is in conformance with the Ciry's Comprehensive Plan and
Zoning and Subdivision Ordzaaace. This area is designated as Medium-Density Residential
oa the Comprehensive Plan Lead Use Map.
3. The development will connect to existing City water and sewer facilities. Sewer and water
pans have been provided for Public Works' review.
4. The final plat is is conformance with acceptable eo1gitteeriag, architectural and surveying
practices and Ioeal standards.
